ER-100.6(II)(1S).1 Dr. Jagannath Mishra Mahavidyalay, Vill – Chandwara, PO–Ramna, City – Muzaffarpur, Dist – Muzaffarpur, Bihar – 842001. (B.Ed.) (Private)(B.R.A. Bihar University) Code No. APE00978 The Committee considered the reply of the institution dt. 17.08.2009 received in this office on 24.08.09 in response to ERC notice 04.08.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time. The Committee noted that the Registrar has certified that the faculty appointment is on regular basis and keeping in view the above, decided that Order under Clause 7(11) of Regulations, 2007 for annual intake of 100 for B.Ed. Course from the session 2009-2010 may be issued.
ER-100.6(II)(1S).2 Rajendra Academy for Teacher’s Education, Vill- Gopalpur, Po- Bidhannagar, Town – Durgapur, Dist- Burdwan, West Bengal – 713212 (B.Ed.) (Private)( University of Burdwan) Code No. APE01010 The Committee considered the reply of the institution dt. 11.08.2009 received on 24.08.2009 in response to ERC notice 04.08.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time. The Committee noted that one teacher is not qualified because of result not declared and if result is declared by 31.8.2009 order under 7(11) be issued after receipt of the same by 31.8.2009, failing which the order of refusal of recognition be issued due to non-appointment of qualified staff as per the NCTE norms.
ER-100.6(II)(1S).3 Prabhu Jagatbandu College, Vill.- Jhorehat, Po.- Andul-Mouri, Tehsil- Sankrail, Dist.- Howrah, West Bengal- 711 302 (B.Ed.) (Govt.-Aided) (University of Calcutta) (Code No.APE01145) The Committee noted that no reply received in response to ERC notice 05.08.2009 and considered other relevant documents; NCTE Act, Regulations and guidelines of NCTE published from time and that recognition to B.Ed. course of the institution be refused u/s 14 (3) (b) for the following reason:
  1. The land & building is of degree college and the same is not as per the NCTE norms
  2. The institution has not appointed the teaching staff. However, they have given an undertaking that they will appoint teaching and non-teaching staff for teacher education course.
  3. As per VT remarks the institution is not functioning from its own building. The institution is proposes to function from its own building+3 colleges
  4. It does not have library resources for B.Ed. programme. It does not have the psychology lab, language lab, work experience lab, Art and Music lab.
  5. It does not obtained permission from the appropriate authority to utilize the facilities of the degree college for the self-financing course leading to B.Ed. degree.

(B.Ed.)(Private) (Veer Kunwar Singh University) Code No.APE001115 The Committee considered the reply of the institution dt. 17.08.09 received in this office on 20.08.09 & 21.08.09 received in this office on 24.08.09 in response to ERC notice 04.08.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Order under Clause 7(11) of Regulations, 2007 for annual intake of 100 for B.Ed. Course from the session 2009-2010 may be issued.
ER-100.6(II)(1S).5 Rashidiya Rani Sagari Teacher’s Education College, At – Chand Bajitpur, Po/Ps – Belaganj, Dist – Gaya, Bihar – 804403 (PTT) (Private) (Bihar School Examination Board) Code No. APE00781) The Committee considered the reply of the institution dt. 20.08.09 received in this office on 21.08.09 & 25.08.09 received in this office on 26.08.09 (through fax). in response to ERC notice 31.07.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that recognition to PTT (D.Ed.) course of the institution be refused u/s 14 (3) (b) for the following reason:
  1. The institution has not appointed requisite number of teaching staff qualified as per NCTE norms.
  2. Affidavit Rs. 100/- & Rs. 10/- stamp paper regarding teaching staff not submitted by the institution.
  3. The website of the institute is available but it does not have the Internet connection. And also on seeing of the website it is found that the site is suspended not functioning which is not as per Regulation.
  4. The land and building of the institution are not in the name of the institute but on lease from a Private Person, not from Government as per VT Remarks. The same is not as per the NCTE Norms.
  5. As per VT Remarks the fixed deposits made on the personal name of the Secretary but not in the name of the institute.
  6. The appointed teachers and the Principal are not qualified as per the NCTE Norms.
  7. The Librarian does not have any qualification in Library Science as per VT remarks.
  8. It has appointed non-teaching staff more than the needs as per VT Remarks
  9. As per the VT remarks a part of the building is under construction. In this regard the institution has not submitted any supporting document.
ER-100.7(1S) Court Case
ER-100.7(1S).1 CWJC No. 9447 of 2009 filed by Dr. Ambedkar Hindi Sanskrit Vidyapith, Bihar –cum-Education and Training institute, At – Jokia, Dist – Begusarai, Bihar Versus UOI & Others in the Hon’ble High Court at Patna. The Committee considered case of the institution and decided that the Visiting Team may be sent and a letter of consent be issued to the institution for its readiness for inspection of the infrastructure & instructional facilities provided for running the proposed teacher education programme as per the NCTE norms as per the court order.

  1. Three teachers are regular teachers & other are part time which is not as per the NCTE norms.

(Private) (Calcutta University) Code No. APE00896 The Committee considered the case of the institution along with the Visiting Team Report, relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that letter of intent for appointment of teaching / non teaching staff supporting with required affidavits as per the format enclosed alongwith the downloaded copies of the website as per clause 7(9) of Regulation, 2007 may be issued giving 20 days time with a direction to the institution to comply the following deficiencies:
  1. Library books are less as per norms.
  2. Science lab, psychology lab and ET lab and Language learning lab not available.
  3. Facilities in the psychology lab is not adequate
Consideration of the request of the Govt. of West Bengal for PTT course under Clause-11 of NCTE Regulation - 2007
The Sub-Group while considering the West Bengal Government PTT cases noted that in response to earlier discussion with the Member Secretary, NCTE, New Delhi, Visiting Teams has been sent in these cases after 7(9) was given by the decision of the 99th ERC Meeting. It is also found that despite the relaxation granted in NCTE dated 15th July 2009, 27 Primary Teacher Training Institutions do not have adequate faculty/teaching staff even on adhoc/contract basis. In these circumstances, ERC was inclined to refuse these cases because of the 31st August 2009 date line for final disposal.

However, the Members felt that the matter should be discussed by the Regional Director with NCTE Hqrs before refusing these cases. The Regional Director, ERC contacted Member Secretary who, after consulting the Chairperson, NCTE communicated that 60 days time should be allowed to the institutions to fulfill the deficiencies in the matter of faculty/staff. As such the Sub-Group decided that 60 days time may be allowed for making up deficiencies.

The representative of the West Bengal Government indicated that 60 days time for appointment of faculty/staff on regular/adhoc basis may not be adequate in all cases. In such cases more time is to be given. Secondly, he also indicated the existing teachers appointed for these institutions are regular government servants with long service. They were recruited before NCTE norms were evolved under Government Norms then applicable. In these circumstances these employees cannot be retrenched. As such NCTE Norms for appointment of teachers will have to relaxed in respect of old employees

The Sub-Group appreciated the problems of West Bengal and observed that the West Bengal Government may move NCTE Hqrs. for appropriate consideration with a copy to ERC.

Other Members from North-Eastern States also pointed out similar problem might arise in their States too. The Sub-Group felt that they should also move NCTE Hqrs. for appropriate consideration with a copy to ERC.

The above report of the Sub-Group of the Eastern Regional Committee considered by the Eastern Regional Committee decided that all such cases be considered in the light of the above recommendation.
