The Committee considered the reply               dt. 19.01.2010 received on 27.01.2010 in response to ERC Notice                dt. 08.01.2010 along with relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that Order under Clause 7(11) of Regulations, 2007 for annual intake of 100 for B.Ed. Course from the session 2009-2010 may be issued as per the NCTE Regulations 2007.

The Committee considered the reply               dt. 22.01.2010 received on 27.01.2010 in response to ERC Notice Notice dt. 08.01.2010 along with relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that Notice                      u/s 14(3) (b)  may be issued giving 30 days for the following deficiencies.

·         The institution be directed to submit site plan duly earmarked for the teacher education course approved by the competent authority alongwith the necessary documents.

Further, the Committee decided that the reference to the State Government for comments may also be sent.

The Committee considered the judgement passed by the Hon’ble High Court of Delhi in W.P. No. _____ and also communication from NCTE-HQrs and decided that as per the Order of the Hon’ble Court, the representative of the institution be directed to appear in person for personal hearing in the next meeting of ERC.

CWJC No. 13927 of 2009 filed by Vijay Kumar-Vs- The State of Bihar & Ors., in the Hon’ble High Court at Patna (File No. ERC/05-436/2009/)

The Committee considered the judgement passed by the Hon’ble High Court of Patna in W.P. No. 13927 on 19.01.2010 wherein the Hon’ble Court has directed the Apex Body of NCTE to conduct inspections u/s 13 of the NCTE Act, Legal opinion received from Legal Counsel dated 26.01.2010 and decided to defer all the cases under Section 17 having B.Ed courses in Bihar alolngwith the B.R. Amebdkar College, Gaya.

CWJC No. 13651 of 2009 filed by Radha Shayam Singh-Vs- The OI &         Ors. (File No. ERC/05-437/2009/)

The Committee noted the judgement of the Hon’ble High Court of Patna in CWJC No. 13651 of 2009 and decided that the matter will be dealt with in accordance with the Hon’ble High Court orders after receipt of petitioners application as per direction of the Hon’ble Court.  Steps should be taken by ERC office immediately.

The Committee noted that the Secretary of the college had written a letter to NCTE requesting for withdrawal of recognition for the B.Ed course granted to the institution and decided that the comments with regard to the above be sought from the institution.

The Committee noted the contents of the complaint received against the institution regarding payment of salary to the staff and decided that the institution be directed to submit its comments on the complaint received.

(I)           Letter dtd 03.01.2010 received from Prof. Surendra Mohan Pany, Former Professor-cum- Principal, Radhanath Institute of Adv. Studies in Education, Cuttack , Orissa regarding the  improvement of Teacher Education Programme in the State of Orissa (File No. ERC/06-2/OR/2004/IV/ ).

(II)          Letter from the Joint Secretary, Old student Association, Radhanath I.A.S.E., Cuttack vide letter No. 035/10 dt. 13.010.2009 received in this office on 20.01.2010 mentioning that “a news relating to the Admission into the B.Ed. course was published in the Samaja on 28 December’ 2009.

The Committee considered the same and decided that the comments from the State Government of Orissa be sought on the above two representations.

The Committee noted the contents of the complaint received against the institution and decided that the institution be directed to submit its comments on the complaint received.

The Committee noted the contents of the complaint and also the directions of the CP, NCTE-HQrs and decided that Inspection of the institution u/s 17 of the NCTE Act be conducted to verify the infrastructural and instructional facilities available in the institution.

4.         Complaint received from Shree Anil Kumar Sharma & N. Azam received on 01.12.09

5.         Complaint received from Mohit Kumar received on 13.01.2010 regarding S. M. Zaheer Alam Teacher Training College.

6.         Complaint received from S.K. Das Part Time Lecturer, Barpeta B.T. College, Barpeta regarding false qualification of the Principal and formation & functioning of the Governing Body of Barpeta B.T. College.

7.         Complaint received from Anil Kumar Sharma, Devchandidih, Dumaria, Gaya regarding Magadh Teacher’s Training College, Gaya.

 

With regard to complaints at Sr. No. 01 to 05 and 07, the Committee noted that the complaints are with regard to B.Ed colleges in the Bihar State, for which, as per the decision of the Hon’ble High Court of Patna in CWJC No. 13297/ 2009, the Apex Body of NCTE is already conducting inspections u/s 13 of the NCTE Act (Agenda Item No. 104.07.02)

 

 

With regard to complaint at Sr. No. 06, the ERC noted the contents of the complaint received against the institution and decided that the institution be directed to submit its comments on the complaint received.
