No.11353 of 2000 filed by Md. Ashrafulla-Vs.UOI &
The Regional Director, ERC, NCTE, Bhubaneswar.
Shri S.N. Pathak, the Advocate
for ERC at Patna High Court vide his letter
dt.06.03.2010 has forwarded a copy of the aforesaid
contempt petition wherein the ERC, NCTE has been
cited as respondent No.2. It is pertinent to
mentioned herewith that the LPA No.23/2005 filed by
the ERC against the order dt.08.11.2004 passed in
CWJC No.11353 of 2000 was dismissed as withdrawn. As
per the legal advice obtained from the advocate vide
his letter dt.06.11.2007 and 05.06.2008, a letter
vide No.ERC/05-149/2004/11296 dt.27.05.2008 was
issued to the applicant Sh. Ashrafullah in response
to his representation dt.08.10.2007 and 24.03.2008
which returned un-served and again another letter
was sent to him vide letter no.13632 dt.24.10.2008
which was also returned un-served.
In view of the above, Shri
S.N. Pathak has been requested vide letter No.3383
dt.09.03.2010 to defend the matter on the basis of
the legal opinion given by him vide letter
dt.06.11.2007 and 05.06.2008.
However, on telephonic
conversation / fax received from the advocate has
adviced that once again a letter / reasoned order be
issued in consideration to the representation
submitted by the petitioner and his advice is being
followed.

The Committee has utmost respect
for the Hon’ble High Court Orders. The Committee
decided that urgent action may be taken as per the
advice of Advocate for NCTE in the Hon’ble High
Court of Patna. |
