- The institution is required to submit earmarked building plan showing availability of land & built up area for the proposed course and also for the existing course being run by the institution. The land and building of the institution shall be separate & exclusive for running the B.Ed (Teacher Education Programme)
- Language Learning Lab. is on sharing basis with other courses. The same shall be provided as per the NCTE norms.
- Presently the Education Library is placed alongwith the central Library. The same shall be provided as per the NCTE norms.

The Committee considered the case of the institution along with the Visiting Team Report, relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that letter of intent prior to permission under Clause 7(9) of Regulations, 2007 may be issued giving 30 days time with a direction to the institution to comply the following deficiencies:
- The institution shall make appointment of faculty/staff by a duly constituted selection committee and ensure selection of candidates possessing qualifications as prescribed under rules.
- An Affidavit on Rs. 100/- Non-Judicial stamp paper by the Applicant is required to be submitted alongwith individual affidavits on Rs.10/- Non-Judicial stamp paper as per the prescribed format to be submitted by the academic staff duly selected and appointed.
- The institution may submit countersigned statement of staff appointed as per the NCTE norms as per approval of the concerned affiliating body. The same be submitted in the prescribed format duly countersigned by the concerned affiliating body. In such case the institution shall submit the same alongwith an affidavit on Rs.100/- Non-judicial stamp paper duly signed by the authorized representative of the management of the institution as per the prescribed format. Individual affidavit is not required to be submitted in such cases
- The institution shall launch its website covering, inter alia, the details of the institution, its location, name of the course applied for with intake, availability of physical infrastructure (land, building, office, classrooms, and other facilities/amenities), instructional facilities (laboratory, library etc.) and the particulars of their proposed teaching and non-teaching staff etc. with photographs. The downloaded copies of the website are required to be submitted.

- Psychology lab not available as per the NCTE norms.
- Language learning lab not available as per the NCTE norms.
- Journals are not in the library. Old books are damaged. Books are not available in new syllabus. The institution is required to provide the same as per the NCTE norms.
- The built up area of the building is 10,000 Sq. Ft. which is less than the required. The same shall be as per the NCTE norms.
- State Govt. certificate not submitted regarding course is not self finance basis
- Two Classrooms are not in a condition of teaching students. Infrastructures are broken and damaged. They are not in usable condition.
- The institution is required to submit an undertaking from the Director, Research and Training, Govt. of Bihar regarding removal of deficiencies as per the NCTE norms.

- The List of Teaching Staff submitted by the institution list was not countersigned by the Competent Authority.

The Committee considered the case in details and noted the following:-
The application from the institution viz. Jharkhand Teachers’ Training College, Rajgaria Road, Near Mahadeo Modi Mandir, Jhumri Teliya, Dist-Koderma, Jharkhand-825409 seeking grant of recognition for B.Ed. course was received in this office on 30.11.2006 which was acknowledged vide this office letter No.JH-S/N-1/2006/4760 dated 07.12.2006.
Since the institution had not submitted the required documents, it was advised vide letter No.5391 dated 10.01.2007 to remove the deficiencies mentioned therein within 90 days from the date of issue of the letter.
In continuation to the aforesaid letter dt. 10.01.2007, the institution vide letter No. 7293 dt. 29.03.2007 was further advised to remove the deficiencies mentioned therein within 90 days from the date of the issue of the letter dt. 10.01.2007. In response, the institution submitted reply dt. 15.05.2007 along with supporting documents.
The ERC in its 76th meeting considered the reply dt. 15.05.2007 submitted by the institution and observed that the institution was still in deficiencies stage. As per the decision, a Final Notice u/s 14(3)(b) was issued vide No. 8227 dt. 29.05.2007 to make a written representation within 30 days from the date of the issue of the Notice. In response, the institution submitted reply dt. 13.06.2007 along with supporting documents.
Acceptance letter before inspection was issued to the institution vide ERC letter No. 9140 dated 08.08.2007. The institution vide its letter dt. 24.09.2007 conveyed its readiness for inspection preferably in the month of October, 2007.
The ERC in its 81st meeting considered the reply dt. 24.09.2007 and advised the institution vide letter No. 10247 dt. 14.11.2007 to submit required documents within 60 days from the date of the issue of the letter.
The ERC in its 82nd meeting considered the reply dt. 22.11.2007 in response to ERC letter dt. 14.11.2007 and as per decision, Notice u/s 14(3) (b) was issued vide No. 103683 dt. 14.12.2007 giving 60 days time with a direction to comply the deficiencies mentioned therein.
The ERC in its 83rd meeting considered the reply dt. 25.01.2008 in response to ERC letter dt. 14.12.2007 and the institution was advised vide letter dt. 19.02.2008 to make good the deficiencies within 30 days from the date of issue of the letter.
The institution submitted reply dt. 05.03.2008 in response to ERC Notice dt. 19.02.2008. The institution had not fulfill the deficiencies, it was further advised vide Notice dt. 14.04.2008 to make a written representation within 30 days from the date of issue of the Notice.
The ERC in its 87th meeting noted that a complaint from Pravat Kumar Bhadanai vide letter dt. 20.03.2008 was received against the institution regarding lease agreement. As per the decision, the institution was requested vide letter No. 11972 dt. 05.08.2008 to furnish comments on the points of complaint mentioned therein within 21 days.
The institution submitted reply dated 16.09.2008 in response to ERC Notice dt. 05.08.2008 along with relevant documents which was considered in 89th ERC meeting and as per the decision, Notice u/s 14(3)(b) was issued vide No. 13435 dt. 20.10.2008 to make a written representation within 30 days from the date of the Notice but the same returned undelivered.
The State Govt. Jharkhand was requested vide letter No. 13585 dt. 06.11.2008 to furnished recommendations within the stipulated time period of 60 days.
In response to ERC letter No. 13685 dt. 05.11.2008, the institution submitted willingness letter for inspection on 10.11.2008. The institution was visited by the inspection team on 15.12.2008.
The complainants Prabhat Kumar Bhadani once again made a complaint vide letter dt. 24.11.2008 regarding the submission of false affidavit for which the Commissioner & Secretary, HRD Department, Govt. of Jharkhand vide letter No. 14541 dt. 04.12.2008 was requested to kindly investigate the matter and to submit report to that effect.
In the meantime, the NCTE Hqrs. vide letter No. 89486 dt. 31.12.2008 forwarded a copy of the complaint against the aforesaid institution received from Shri B.D. Gupta & others.
In continuation to this office letter No. 14541 dt. 04.12.2008, the State Govt. Jharkhand was once again requested vide Reminder letter No. 15086 dt. 10.02.2009 to make an enquiry on the above complaint and to submit report on the matter. The NCTE Hqrs. was informed accordingly vide letter No. 15300 dt. 24.02.2009.
As per the decision of 92nd ERC meeting, Notice u/s 14(3)(b) vide No. 15085 dt. 10.02.2009 was issued to the institution to make a representation within 30 days.
The ERC in its 93rd meeting considered the reply received dt. 25.02.2009 in response to ERC Notice dt. 10.02.2009. As per the decision, another notice vide No. 15700 dt. 14.03.2009 was issued to make a written representation for the following deficiencies:-
- Principal’s Experience certificate is not enclosed, hence qualification cannot be ascertained.
- 2 teachers are not qualified as per NCTE norms.
- Govt. report is awaited. We have reported Hqrs. in the matter in the complaint received against the institution.
The State Govt. of Jharkhand was requested vide second reminder letter No. 15932 dt. 23.03.2009 & also third reminder vide No. 15985 dt. 27.03.2009 to kindly investigate the matter of complaint regarding the land of institution and to give a report within a stipulated time of 30 days.
As per the decision of 95th ERC meeting, the institution was requested vide letter No. 16604 dt. 18.05.2009 to clarify about its representation dt. 04.04.2009 & 10.04.2009 relating to experience certificate of Dr. Raj Kishore Jena who is the Principal of this B.Ed. College and to send a reply with supporting documents within 30 days from the issue of the letter.
The Committee noted the letter dt.10.4.2009 received from the institution enclosing therewith the details of experience certificate of Dr. Raj Kishore Jena. The Committee also noted letter dt. 23.5.2009 clarifying that some wrong person has dispatched a letter to ERC regarding withdrawal of amount as FDR and Endowment amount of the institution.
In the meantime in response to the letter of ERC for NOC, the State Govt. conveyed its objection due to some infrastructural deficiencies. However the State Govt. view has been received much after the stipulated 60 days period. The infrastructural aspects have been seen by the Visiting Team which has given a favorable recommendation. There is no response from the State Govt. to the complaints made against the institution inspite of repeated reminders.
Keeping the above facts in view, the ERC in its 96th meeting considered the case with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Recognition Order under Clause 7(11) of Regulations, 2007 for annual intake of 100 for B.Ed. Course from the session 2009-2010 may be issued after verification of website and receipt of the downloaded copies of the website.

The case was considered by the ERC and after perusal of the letter No.F.65-1/2009/NCTE/Legal/95153 dt.19.05.09 of Shri C.K. Ramaswamy, Under Secretary, NCTE (Hqrs.) New Delhi forwarding the copy of the representation dt. 06.05.2009 along with a copy of the Hon’ble Commission’s order dt. 23.04.2009.
The Committee decided to request NCTE Hqrs. To advise ERC as to what specific appropriate action would be taken by ERC in the given circumstances. A history of the case is to be furnished and an immediate response solicited to comply with Hon’ble Commission order.
