The 101st Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was held on 6th – 8th October, 2009 at Conference Hall, ERC, NCTE, Bhubaneswar, Orissa.

The Sub-Group of the Eastern Regional Committee perused & considered all the cases and taking into consideration the recommendations made by the Sub-Group, the Eastern Regional Committee considered & decided the following matters/cases as per the proceeding noted below:-

ER – 101.4 Appeal Cases  
ER – 101.4.1 Gobindapur Sephali Memorial PTTI, Vill- Gobindapur, Po- Keleti, Dist- Burdwan, West Bengal (PTT) (Private) (West Bengal Board of Primary Education )Code No. APE00772 The Committee considered the reply dt. 05.09.2009 received on 11.09.2009 in response to ERC Letter of Intent dt. 31.08.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice u/s 14(3) (b) may be issued giving 30 days time with a direction to the institution to comply the following deficiencies:
(i) One teacher namely Shri Kamal Kanta Rana is not qualified as per norms 2007
ER – 101.4.2 Reapara Primary Teachers Training Institute, Vill/Po.- Reapara, Ps.-Nandigram, Dist.- Purba Medinipur, West Bengal- 721 650 (PTT) (Private) (West Bengal Board of Primary Education) Code No.APE00849 The Committee considered the reply dt. 16.09.2009 received on 01.10.2009 in response to ERC Letter of Intent dt. 31.08.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that a Clarification letter may be issued giving 30 days time to the institution, seeking clarification regarding Principal’s Experience whether it is upto the year 2008 or 2009.
ER – 101.4.3 Sunderwati Mahila Mahavidyalaya, Vill – Bhagalpur Sadar, Po – Head Post Office, City/Dist – Bhagalpur, Bihar – 812001 (B.Ed.) (Private) (T.M.Bhagalpur University) Code No. APE00951 The Committee considered the reply dt. 11.09.2009 received on 14.09.2009 and dt.30.09.2009 received on 05.10.2009 in response to ERC Letter of Intent along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice / Clarification may be issued u/s 14(3) (b) giving 30 days time with a direction to the institution to comply the following deficiencies:
  1. Details of Principal / HOD with experience not given. The institution is required to submit the same in the prescribed format of the Affidavit alongwith experience certificate of the Principal.
  2. The website of the institution is functioning. However, all the documents affidavit of the teaching staff, affidavit regarding land and list of teaching staff are not displayed in the website.
  3. Affidavit on Rs.100/- stamp paper submitted by the institution is not in the prescribed format
ER – 101.4.4 Z. Education Primary Teacher’s Training Institute, Po.- Andran Fulbary (West), Ps- Tufanganj, Dist.- Cooch Behar, West Bengal (PTT) (Private) (West Bengal Board of Primary Education) Code No. APE00761 The Committee noted that no reply has been received in response ERC acceptance letter dt. 01.09.2009 and considered along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice may be issued u/s 14(3) (b) giving 30 days time with a direction to the institution to comply the following deficiency.

ER – 101.4.5 Ghol Digrui Sikshan Mandir (B.Ed.) College, Vill/Po.- Ghol Digrui, Dist.- Hooghly, West Bengal- 712 401 (B.Ed.) (Private) (Calcutta University) Code No. APE00896 The Committee considered the reply dt.16.09.2009 received on 01.10.2009 in response to ERC Letter of Intent dt. 31.08.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Clarification letter may be issued giving 30 days time with a direction to the institution to comply the following deficiency.
  1. Individual affidavit on Rs.10/- stamp paper by the teaching staff in prescribed format not submitted.
  2. Experience of the Principal is not clear as per the NCTE Norms. The institution is required to submit the experience certificate of the Principal.
  3. 3 Nos. of teaching staff are not qualified as per NCTE norms.
  4. The Caste certificate of S/Shri Chinmay Mondal, Gopa Mondal & Anup Kr. Malik not submitted.
  5. The institution has not submitted any supporting documentary proof in support of purchase of books for the library.
  6. The institution is required to submit supporting documentary proof of Science Lab., Psychology Lab., ET Lab and Language Learning Lab.
ER – 101.4.6 Mahatma Gandhi Shikshak Prashikshan Mahavidyalaya, Vill/Po – Kotoria, Dist – Banka, Bihar – 813106. (B.Ed) (Private) (Tilaka Manjhi Bhagalpur University) Code No. APE00913 The Committee considered the reply received on dt. 01.10.2009 in response to ERC Letter of Intent dt.31.08.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice may be issued u/s 14(3) (b) giving 30 days time with a direction to the institution to comply the following deficiencies:
  1. Approved building plan with plot no., Khata No., Khasra No., total area, built up area not submitted by the institution.
  2. Building Completion certificate with total area, built up area not given.
  3. Total area given in the Building Plan and affidavit is different.
  4. Application form not in prescribed format.
  5. Downloaded copies of Rs.10/- & Rs.100/- stamp paper not submitted by the institution.
  6. Affidavit on Rs.100/- stamp paper regarding appointment of staff is not in prescribed format.
  7. Principal is not appointed as per affidavit Rs.10/- stamp paper but as per the list and individual format principal is appointed which is not clear. Experience Certificate of the Principal not submitted by the institution. Educational qualification Certificate not submitted by the institution. Hence qualification can not be ascertained.
ER – 101.4.7 Kharagpur Tribal B.Ed. Training College, PO.- Matkatpur, Paschim Medinipur, West Bengal- 721 305 (B.Ed.) (Private) (Vidyasagar University) Code No.APE01033 The Committee considered the reply dt.28.09.2009 received on 01.10.2009 in response to ERC Acceptance Letter dt.01.09.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Visiting Team may be sent to the institution as per the request of the institution.
ER – 101.4.8 Aurangabad Primary Teacher’s Training Institute, Vill-Aurangabad, PO-Aurangabad, West Bengal-742201 (PTT) (Private) (West Bengal Board of Primary Education) (Code No. APE01199) The Committee considered case of the institution, appeal order received from appeal committee along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Order under Clause 7(11) of Regulations, 2007 for annual intake of 50 for PTT (D.Ed.) Course from the session 2009-2010 may be issued after verification of the website of the institution.

ER – 101.4.9

Sree Sree Ramakrishna B.Ed. College, Nischintapur, Ps – Kulpi, Dist – 24 pargans (S), West Bengal – 743374 (B.Ed.) (Private) (University of Calcutta) Code No.APE00749 The Committee considered the reply received on dt. 31.08.2009 in response to ERC Letter of Intent dt.31.08.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that a Clarification letter may be issued giving 30 days time with a direction to the institution to comply the following deficiencies:
  1. (i) The institution is required to submit experience certificate of the principal as per the NCTE norms.
  2. (ii) The institution is required to submit Rs.10/- affidavit consisting details of individual teaching staff as per the prescribed format.
  3. (iii) The website of the institution are not displaying the documents mandatory disclosure format, affidavit of the teaching staff, affidavit regarding land and list of teaching staff.

ER – 101.4.10

Dainhat Joy Matara Primary Teacher’s Training Institute Plot No. – 64,109,110,111,112,115, Street No. – Dainhat Subhash Road, Dist- Burdwan, West Bengal – 713502 (PTT) (Private) (West Bengal Board of Primary Education) Code No.APE00922 The Committee considered the reply dt. 03.09.2009 and 10.09.2009 received on 04.09.2009 and 11.09.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice may be issued u/s 14(3) (b) giving 30 days time with a direction to the institution to comply the following deficiency:
  1. The institution is required to submit details regarding qualification, experience and age of the Principal with supporting documents as per the NCTE norms in the prescribed format.

ER – 101.4.11

Mahabodhi Teacher’s Training College, Vill – Tapowan-Rajgir Road, Po – Tetar, Tehsil – Jethian, Dist – Gaya, Bihar. (B.Ed. Course) The Committee noted the following that:-
An order dt. 11.09.2009 has been received on 01.10.2009 from the NCTE Hqrs. passed on the appeal made by Mahabodhi Teachers Training College, Bihar whereby the NCTE Hqrs. has remanded back the case of the appellant institution to take necessary action for causing inspection of the institution to ascertain the availability of the staff in particular and other facilities as per NCTE Norms and thereafter pass the appropriate order.

It is pertinent to mention here that recognition of Mahabodhi Teachers Training College, Gaya, Bihar for conducting B.Ed. Course was refused vide order No. ERC/7.95.8.118/2009/16486 (1) dt. 13.05.2009 for the reasons stated therein. The institution preferred an appeal dt. 30.06.2009 to the NCTE (HQ) against the ERC order dt. 13.05.2009 and the Appellate Authority has been pleased to pass the aforesaid order. However, it is further mentioned that the institution has also filed a writ petition bearing CWJC No. 5535 of 2009 before the Hon’ble High Court at Patna for an order directing the respondents to get the inspection done by the verification team in respect of the petitioner institution. However, the matter is subjudice before the Hon’ble Court.

The original records including the institution’s representation dt.15.09.2009 along with Court Case file is placed on the table.
The Committee considered case of the institution and noted that the case was mainly refused under provision of 8(7) & 8 (8) of the NCTE Regulation, 2007 as the institution got the land registered to the proposed college on 12.12.2008 that is beyond the expiry date of 31.10.2008 which was prescribed in the NCTE Regulation, 2007.

The Committee opined that since a no. of cases have earlier been refused by the ERC on similar ground (Regd. of land in the name of the institution after the cut off date), it was decided to bring it to the notice of the NCTE Hqrs. regarding the impact of the decision of the Appellate Authority on all such cases. It may also be brought to the notice of NCTE Hqrs. that the matter was sub-judice before the Hon’ble High Court of Bihar, Patna when the appeal decision was made.

Necessary advice from the NCTE Hqrs. may be sought on the above line.
The Regional Director, ERC was of the view that direction of the Appellate Authority would be carried out expeditiously.
In view of the above the ERC decided that the Visiting Team may be sent as per the Appellate Authority order.
ER – 101.4.12 Ghatsila College, Po – Ghatsila, College Road, Ps – Ghatsila, Dist – East Singhbhum, Jharkhand – 832903 (B.Ed.) (Constituent Unit of Ranchi University) Ranchi University, Ranchi The Committee considered the reply dt.16.09.2009 received on dt.01.01.2009 in response to ERC acceptance letter dt. 31.08.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that the Visiting Team may be sent from the other approved panel of 100th ERC meeting.
ER –101.5(I) Visiting Team Reports – Under Section 14/15
ER –101.5(I).1 Magadh College of Education, Vill – Dubhal (Gaya), Po – Chand Chaura, Dist – Gaya, Bihar – 823001 (B.Ed.) (Private) (Magadh University) Code No. APE001116 The Committee considered case of the institution and noted that it is also the similar cases which was mainly refused under provision of 8(7) & 8 (8) of the NCTE Regulation, 2007 as the institution got the land registered after the prescribed last date as per the NCTE Regulation, 2007.

In the matter the Regional Director opined that the matter be considered as per the direction of the Appellate Authority and necessary decision be taken on the basis of Visiting Team Reports and facts & figures submitted by the institution in view of the NCTE Rules & Regulations.

The Committee decided to defer the issue to the next meeting in view of the advice sought for from the NCTE Hqrs. in respect of Mahabodhi Teacher’s Training College, Gaya, Bihar. Both the case are of similar nature as in both the cases ERC refused the cases under section 8(7) & 8(8) of the NCTE Regulations, 2007 and Appellate Authority reversed ERC’s decision.
ER –101.5(II) Visiting Team Reports – Under Section-17
ER –101.5(II).1 Teacher Training College, C/o – Buddha Public School, 83, Ashok Nagar, Gaya, Bihar – 823001. (B.Ed.) (Private) (Magadh University) Code No. APE00283 The Committee considered the Visiting Team report along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice may be issued u/s 17 of the NCTE Act giving 30 days time with a direction to the institution to comply the following deficiency:
  1. Requisite no. of teaching staff are not qualified as per the NCTE Norms. The List of teaching staff are not countersigned by the competent authority of the concerned affiliating body.
  2. Affidavit Rs. 10/- & Rs. 100/- stamp paper regarding teaching staff not submitted by the institution.
  3. Language learning lab not available
  4. As per affidavit total Area less is then the required as per the NCTE norms.
  5. As per VT Built up area less than the required for all the recognized courses.
  6. Building completion certificate not submitted.
  7. The institution earlier recognized for NTT Course in 2004. The institution was granted recognition vide No. ERC/7-64.7.5/2006/222-227 dtd. 15.02.2006. The institution also recognized for ETE Course. The institution still running lease premises.
ER –101.5(II).3 Teacher Training College, C/o – Buddha Public School, 83, Ashok Nagar, Gaya, Bihar – 823001. (NTT – Additional Course) (Private) (Bihar School Examination Board) Code No. APE00348 The Committee considered the Visiting Team report along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Show Cause Notice under section 17 of the NCTE Act may be issued to the institution giving 30 days time for the following deficiencies.
  1. Total Area less than the required.
  2. Building completion certificate not submitted.
  3. As per the Regulation, 2007 the duration of the C.Ed. Course is One year. The institution is running two years Course.
  4. Teaching staff does not possess qualification as per C.Ed. Norms. Details of the teaching staff is not clear as per the list.
  5. Requisite number of teaching staff have not been appointed as per the NCTE norms.
  6. Affidavit on Rs.10/- and Rs.100/- stamp paper regarding teaching staff and selection committee not submitted.
  7. The institution was granted recognition vide No. ERC/7-44(ER-44.5.1)/2004/1555, Dtd. 13.05.2004. The institution also recognized for ETE Course. The institution still running lease premises.
ER –101.5(II).4 Teacher Training College, C/o – Buddha Public School, 83, Ashok Nagar, Gaya, Bihar – 823001. (ETE) (Private) (Bihar School Examination Board) Code No. APE00678 The Committee considered the Visiting Team report along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Show Cause Notice under section 17 of the NCTE Act may be issued to the institution giving 30 days time for the following deficiencies.
  1. Language learning lab not available.
  2. ETE & NTE programmes are running in same building.
  3. Building completion certificate not submitted.
  4. Teaching staff does not possess qualification as per NCTE Norms.
  5. Rs. 100/- & Rs.10/- stamp paper regarding teaching staff not submitted by the institution. List is not countersigned by the competent Authority of the concerned affiliating body. As per the list requisite no. of teaching staff not qualified as per NCTE norms.
  6. The institution earlier recognized for NTT & B.Ed. Course in 2004 & 2006. The institution was granted recognition vide No. ERC/7-76.6(I).10/2007/8165 dtd. 04.06.2007. The institution still running lease premises.
ER –101.6(I) Representation of the institutions after the letter of intent issued under Article 7(11) of old Regulations, 2005/ 7(9) of new Regulations, 2007. – Nil Noted
ER –101.6(II) Representations of the institutions in response to show cause notice
ER –101.6(II).1 Sunil Dhar Memorial B.P.Ed. College, Vill + PO: Panchthupi, P.S. : Burdwan, Block-Burdwan, Dist:Murshidabad, West Bengal – 742161 (B.P.Ed.) (Private) (University of Kalyani) Code No. APE00669 The Committee considered the reply dt.06.08.2009 received on dt.20.08.2009 in response to ERC Notice dt.08.07.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that recognition to B.P.Ed course of the institution be withdrawn u/s 17 of the NCTE Act from the next session for the following reasons:
  1. Experience certificate of the Principal not submitted by the institution.
  2. Details of part time staff as per NCTE norms not given.
  3. Details of total area and land area not given as per norms. Built up area is less than the requirement. Certified/Notarized coy of the registered land documents along with an affidavit on Rs. 100/- stamp paper duly attested by the Notary regarding land and building not given.
  4. Language learning lab is not available as per the NCTE norms.
  5. Library books are less than as per NCTE norms.
  6. Facilities in the Psychology lab inadequate as per NCTE norms.
  7. As per the complaint the institution has submitted the lease deed of same land as submitted by Maa Sarda College of Education (B.Ed.) code No.APE00907.
ER –101.6(II).2 Dr. B.R. Ambedkar College of Education People education society (Mumbai), Khata – 98, Plot No. – 29, “Nagsenwan”, Ratnaraganga Bigha, Ps – Bodha Gaya, Dist. – Gaya, Bihar – 824231. (B.Ed) (Private) (Magadh University) Code No. APE0753 The Committee considered the reply dt.13.08.2009 received on dt.20.08.2009 in response to ERC Notice dt.18.07.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and noted the sub-group recommendation that “since the inspection report is generally positive and no significant deficiency has been pointed out, there is no need for further action. However since the institution has submitted fee for inspection of his own permanent premises to which the institution has proposed to shift, the another inspection on new premises may be conducted on merit.”

On later examination of files it was found that earlier recognition was granted on the basis of own building on lease land. Records & replies from the institution now seem to indicate that the building may have been on rental basis which was not intimated to ERC at that time. In the circumstances the matter requires further closer scrutiny. As such the matter is deferred to next meeting for detailed consideration.

In view of the Committee decided to defer the cases for the next meeting of the ERC.
ER – 101.7 Court Cases
ER – 101.7.1 Sub: CWJC No.11828/2009 filed by Chaurasia Raj Kishore College, Hajipur, Bihar-vs-the State of Bihar & Ors in the Hon’ble High Court at Patna The Committee decided that the Regional Director should taken immediate steps to implement Hon’ble courts order such as examining ownership documents on merit, causing inspection on the basis of genuineness of ownership and other follow up action.
ER – 101.8 Reply in response to Letter/ Notice giving to fulfill the deficiencies within 90 days. – Nil Noted
ER -101.9 Miscellaneous.
ER -101.9.1 Jharkhand Teacher’s Training College, Rajgaria Road, Near Mahadeo Modi Mandir, Jhumritelaiya, Dist- Koderma, Jharkhand - 825409 (B.Ed.) (Private.) (Vinoba Bhave University) Code No. APE00746 The Committee considered the case along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time together with the advice of the NCTE Hqrs. and decided that a letter may be issued to the University to give the information regarding commencement of the session so that the institution can be inspected under section 17 of the NCTE Act thereafter.
ER -101.9.2 Visva – Bharti, Vinaya Bhawan, Santiniketan, West Bengal The Committee considered the case of the institution and with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Visiting Team may be sent to the institution under Section 17 of the NCTE Act.
