The 109th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was held on 21st-23rd June 2010 at Conference Hall, ERC, NCTE, Bhubaneswar, Orissa. 

The Sub-Group of the Eastern Regional Committee perused & considered all the cases and taking into consideration the  recommendations made  by the Sub-Group, the Eastern Regional Committee considered & decided the following matters/cases as per the proceeding noted below:-

Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received in ERC office dt.15.02.2010 in response to DLI dated 22.12.2009, issued by the office of ERC, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that application of the institution for  B.Ed. course be refused / Rejected as per NCTE Regulations 2009 for the following reason:

i.         The land document not in the name of the institution.

ii.        The institution has submitted various conditional gift deeds in the name of Hon’ble Governor, Bihar / sale deed in the name of institution for the same Khasra Nos.

iii.      The Non-Encumbrance Certificate is in the name of individual.

iv.      As per the affidavit, the land has been gifted in 1981, 1988, 1989 in the name of college.  This shows that the other degree college is being run in the said premises.  The institution has not given demarcated area for the teacher education course & other courses being run in the institution.

v.        In support of Land Use Certificate, the institution has submitted a certificate issued on 29.10.2008 stating that the college is permitted to use the land exclusive for educational activity.

vi.      In support of claim that the land is in single plot, the institution has submitted a certificate from Circle Officer, Saraiya, Aanchal, Muzaffarnagar stating that all the plots are adjacent to each other, however, as per , it appears that the land is not in a single plot.

vii.     In the application form, building plan, building completion certificate, Non-encumbrance certificate, the institution has mentioned the Khasra Nos as 9,18,38,45,62 whereas in the Affidavit on Rs. 100 stamp paper, it has mentioned the Khasra Nos as 9, 38 & 45.

Kumaresh International B.Ed. College,  Vill/Po- Rajwadih, Tehsil- Medininagar, Dist- Palamu, Jharkhand – 822101 (Private) (B.Ed) (Nilamber Pitamber University) Code No. ERCAPP176      

Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received in ERC office dt.20.01.2010 in response to DLI dated 22.12.2009, issued by the office of ERC, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that application of the institution for  B.Ed. course be refused / Rejected as per NCTE Regulations 2009 for the following reason:

(i)          Notarised CLU is not submitted.  In support of Change of Land Use Certificate, the institution had submitted a notarized copy of inspection report dated 11th Jan 2010 submitted by Circle Inspector to Aanchal Adhikari stating that previously this land was agricultural but presently one college has been constructed on the said land.

(ii)         In the application form, the website address of the institution is not mentioned.

(iii)        The Plinth area in the building is 6284 q.ft  whereas as per Regulations 1500 sqm is required on the Ground floor only.  The NCTE-HQrs vide letter No. F.No. 48-34/2010/NCTE/N&S/A13303 dated 9th April 2010 had clarified that required built-up-area as prescribed in the concerned norms in the Regulations 2009 refers to the total  built up area available in a single storey or multi-storey building constructed upon the prescribed land area.

(iv)        The institution has proposed to college at five different plots.  It is not clear as to whether they are in a single plot or not.

(v)         In the approved building plan submitted, it is approved for Plot No. 772, whereas the institution has proposed the college at five different plots i.e. 772,279,298,299,576. 

(vi)        The institution has not submitted the Non-encumbrance certificate issued by the competent authority.

(vii)       In the affidavit the institution mentioned that the land is on ownership basis for a period of 53 years.

(viii)      The date of registration of land documents in the Affidavit is not clear.

(ix)        In the Affidavit submitted , the institution has mentioned the land area as 4 acres 78 decimals whereas in the application form and also the land documents are submitted for one acre of land.

Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received in ERC office, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that application of the institution is confirmed for  B.Ed. programme and decided that Visiting Team may be sent for inspection of the infrastructure & instructional facilities provided for running the proposed teacher education  programme as per the NCTE norms.

(i)          Built up area is less than required as per NCTE norms and regulation.

(ii)         Notarized copy of Change of Land Use Certificate issued by the competent authority

(iii)        Certified Copy of registered lease deed/ Sale Deed/ Gift Deed in the name of the institution or Society/ Trust.

(iv)        Approved Building Plan with the plot number, Khata No., total area and built up area from the competent authority

(v)         Undertaking not submitted in the prescribed format.

(vi)        Non- Encumbrance Certificate from Revenue Authority.

(vii)       Building Completion Certificate with the Plot No., Khata No., Total area & Built up area, Plinth area etc from competent Civil Authority.

(viii)      In case of application under section 15 three years of condition of NAAC certificate not submitted.

Appeal Cases: Cases under process on being remanded back / Reversed by the Appeal Committee.

ER-109.4.1

Mithila Teacher’s Training College, Vill – Ekmighat (Mansukhnagar), Taluka/City-Darbhanga, Bihar – 846001 (Private) (B.Ed) L.N.Mithila University (Code No. APE00902)

The Committee considered the reply received in ERC office               dt. 08.06.2010 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that recognition to B.Ed. course of the institution be refused u/s 14 (3) (b) for the following reason:

1.     Requisite number of teaching staff not qualified as per NCTE norms.

2.     Regarding Point No. 01, the institution had submitted a reply.  No supporting document has been submitted. 

3.     Regarding point No. 02, the institution has stated that the building completion certificate duly signed by Govt engineer has already been submitted.  No such document is available in the file.  The building completion certificate is from a private engineer.

4.     The institution has not submitted the certified copy of land documents.

5.     The khasra No. mentioned in the affidavit, building plan and land document does not tally.

6.     Principal and all the staff has been appointed in December 2009 when the Regulations 2009 were in force.  None of the staff is qualified as per NCTE Regulations 2009.

7.     The inspection of the institution was conducted on 12th December 2009, whereas the land documents are registered in the name of institution in December 2009 & January 2010.

8.     The Appellate Authority in its order dated 11th Sept 2009 had stated that the society is having 10 acres of land on ownership basis in the name of society, whereas the institution had got the land registered in the name of institution on 18th-Dec-2009 i.e. after the order of the appellate authority.  There is no document in the file to show that the society is having 10 acres of land on ownership basis in the name of society nor any document has been forwarded by the Appellate Authority / submitted by the institution.

9.     Moreover, as per the building completion certificate, the building was complete as on 6th September 2008, whereas in the land documents registered on 18-Dec-2009, there is no mention of the constructed building.

10.  As per the sale deed executed on 18th Dec 2009, the land is Agricultural and the institution had not submitted any document issued after this date to show that it has obtained the necessary permission from the competent authority for conversion of land from Agricultural to Educational.

11.  The Appellate authority in its order dated 11th Sept 2009 had stated that the institution had created requisite FDRs towards Endowment and Reserve Fund, whereas in the reply to the letter issued by the office, the institution had submitted the FDRs issued on 12th Dec 2009 i.e. after the order of the Appellate Authority & on the date of inspection.  No document has been submitted by the institution / Appellate Authority to show that the FDRs were created by the institution at the time of submission of Appeal.

12.  As per the Building completion certificate and Building Plan, the building has been constructed at Khasra No. 235, 236, whereas in the Sale Deed registered on 18/12/2009, the institution has executed the deed for Plot Nos. 219,235, 220,221,321 but plot No. 236 has not been registered in the name of institution, where the building has been constructed.   No document has been submitted by the institution to show that Plot No. 236 has been registered in the name of institution / society.

13.  The affidavit on Rs. 100 stamp paper  are not properly filled in (Registering authority and date of registration is not mentioned)

ER-109.4.2

The Committee considered the reply dt.29.05.2010 received on 02.06.2010 in response to ERC reminder letter, along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that recognition to B.Ed. course of the institution be refused u/s 14 (3) (b) for the following reasons :

1.     Principal is not appointed as per norms.

2.     The institution has appointed only six lecturers as against the requirement of seven lecturers.

3.     None of the appointed staff is qualified as per NCTE Regulations 2009.

4.     All the staff are appointed on contractual basis for a period of 11 months.

5.     The appointment of staff is not approved by the Registrar of the affiliating body.

The Committee considered the reply 10.06.2010 received in this office on 15.06.2020  in response to ERC Notice dt.29.04.2010 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Order under Clause 7(11) of Regulations, 2007 for annual intake of 100 for the B.Ed. Course from the session 2009-2010 may be issued as per the NCTE Regulations 2007.

The Committee considered the reply 23.05.2010 received in this office on 24.05.2010 in response to ERC notice dt.29.04.2010 along with relevant documents, NCTE Act, Regulations  and guidelines of NCTE published from time to time and decided that Order under Clause 7(11) of Regulations, 2007 for annual intake of 100 for the B.Ed. Course from the session 2009-2010 may be issued as per the NCTE Regulations 2007.

Tarkeshwar Narayan Agrawal Teacher’s Training College, Vill – Harigaon, Po – Sanya Barhatta, Jagdishpur, City – Ara, Dist – Bhaipur, Bihar – 802301. (Private) (B.Ed) (Veer Kunawer Singh University) Code No. APE01012

The Committee considered the reply dtd. 19.05.2010 received in this office on 20.05.2010 in response to ERC clarification letter dt. 29.04.2010 along with relevant documents, NCTE Act, Regulations  and guidelines of NCTE published from time to time and decided that recognition to B.Ed. course of the institution be refused u/s 14 (3) (b) for the following reason:

1.     Principal not qualified as per NCTE norms.

2.     The land documents have been registered in the name of institution on 8th April 2009 wherein the mention of building on the land is not there.  Even in the Gift deed it is clearly mentioned that the said land is a Residential Parti.

 

3.     The Certificate of Approved building issued on 25th Dec 2008, Completion Certificate issued by Sarpanch on 15th October 2008, Building completion certificate issued on 9th April 2009 clearly shows that the building was constructed on the date the land was gifted to the institution.  In the Gift Deed executed on 9th April 2009, there is no mention of the building already constructed on the said plot, whereas as per the Building Completion Certificate the building was constructed prior to the execution of the Gift Deed.

4.     The Gift Deed clearly states that the land which is being gifted is a Residential Parti and the institution had not submitted the Change of Land Use Certificate issued by the competent authority.

 

5.     The institution has not submitted the Non-Encumbrance Certificate issued by the competent authority.

 

6.     With regard to Notice pointed out by ERC, the institution had appointed another Principal by a duly constituted Committee.

 

7.    The institution has appointed the staff as per Regulations 2007 whereas the same has to be appointed after issue of 7 (9) and the same shall be as per Regulations 2009.

Rashidiya Rani Sagari Teacher’s Education College, At – Chand Bajitpur, PO/PS – Belaganj, Dist – Gaya, Bihar – 804403 (Private) (PTT) (Bihar School Examination Board)  CodeNo.APE00781

The Committee considered the reply dtd. 24.05.2010 received in this office on 26.05.2010 in response to ERC notice                       dt. 29.04.2010 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that recognition to B.Ed. course of the institution be refused u/s 14 (3) (b) for the following reason:

 I.    The institution shall launch its website covering, inter alia, the details of the institution, its location, name of the course applied for with intake, availability of physical infrastructure (land, building, office, classrooms, and other facilities/amenities), instructional facilities (laboratory, library etc.) and the particulars of their proposed teaching and non-teaching staff etc. with photographs. The downloaded copies of the website is required to be submitted.

II.    Principal of the institution not qualified as per NCTE norms.

III.    Requisite no. of teachers not qualified as per NCTE norms.

 

Further, on perusal of file, the following has been observed :-

 

     I.        The institution has proposed the Teacher education college at Khasra No. 4534 & 4535, measuring 0.31 decimals, whereas the Non-Encumbrance Certificate has been submitted for Khasra No. 462.

    II.        The application was received as per 2005 Regulations wherein the lease deed for a period of 30 years was permitted, but the institution has submitted the Rent Deed. 

  III.        The Rent Deed for Khasra No. 4534 & 4535 was executed on 12th Jan 2008 in the name of individual and another rent deed is executed in the name of institution on 25th April 2009 for the same plot.  The two rent deeds have been executed for the same plot Nos.  The institution has not submitted the cancellation document for the rent deed executed on 12th Jan 2008.

   IV.        In the rent deed executed on 12th Jan 2008, the institution has mentioned the land area as 0.31 decimal / 1500 sqm . whereas in the rent deed executed on 25th April 2009 the land area is mentioned as 0.31 decimal / 2500 sqm.

     V.        In the rent deed, it is clearly mentioned that the deed is for a Pucca House i.e. Residential plot.

   VI.        The FDRs submitted by the institution towards Endowment and Reserve Fund are in the name of Md. Rafiqui Alam Secretary Rashidiya Rani Sagri Teachers Education College i.e individual whereas it should be in the name of institution / Society.

M.F. International Minority B.Ed. College, Vill – Patna, Po – Patliputra, City – Patna, Taluka – Phulwari Sarif,  Dist. – Patna, Bihar – 800013 (Private) (Magadh University.) Code No. APE00938

The Committee considered the reply received in this office on 16.06.2010 in response to ERC clarification letter dt. 29.04.2010  & 18.05.2010 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that recognition to B.Ed. course of the institution be refused u/s 14 (3) (b) for the following reason:

 

1.     With regard to deficiency at Sr. No. 01, the institution has agreed that the map is sanctioned in the name of International School, which is not acceptable as per Regulations.

2.     With regard to deficiency at Sr. No. 02, the institution had got the Rectification Deed executed on 9th June 2010 i.e. after the date of submission of application & also after the order of the appellate authority, which is not acceptable as per Regulations.  Certified copy of the Rectification deed not submitted.

3.     Further, on perusal of the file, the following has been observed :-

4.     The land documents have been registered on 29th April 2009 & 9th June 2010 i.e. after the last date of submission of application.

The Committee considered the reply dtd. 10.05.2010 in response to ERC letter dt. 29.04.2010 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that recognition to B.Ed. course of the institution be refused u/s 14 (3) (b) for the following reason:

 

1.     Affidavit on Rs. 100/- stamp paper regarding selection committee.

2.     Individual affidavit on Rs. 10/- stamp paper by the teaching staff.

3.     List of teaching staff in prescribed format.

4.     The institution is required to update the website displaying an affidavit in the prescribed form  duly attested by Oath Commissioner/Notary Public as per clause 8 (8) and 8(9) of the NCTE Rules & Regulations alongwith the copy of an affidavits  on Rs.100/- Non-Judicial stamp paper from  the institution to the effect that it has appointed staff on the recommendations of the Selection Committee duly constituted as per the policy of the State Govt/Central Govt./University/UGC or the concerned affiliating body and separate staff statement on an affidavit on Rs.10/- Non-Judicial stamp paper  as per the prescribed format  with the details etc. as per  7(9) of the NCTE  rules & regulations.

5.     The institution shall launch its website covering, inter alia, the details of the institution, its location, name of the course applied for with intake, availability of physical infrastructure (land, building, office, classrooms, and other facilities/amenities), instructional facilities (laboratory, library etc.) and the particulars of their proposed teaching and non-teaching staff etc. with photographs. The downloaded copies of the website is required to be submitted along with the mandatory disclosure format.

6.     The Mandatory Disclosure Format (MDF) to uploaded on the website and downloaded copy of the same be submitted to the office.

ER-109.4.9

Kharagpur Tribal B.Ed. Training College, PO.- Matkatpur, Paschim Medinipur, West Bengal- 721 305 (Private) (B.Ed) (Vidyasagar University) Code No.APE01033

The Committee considered the reply dt.20.05.2010 received in this office on 24.05.2010 in response to ERC notice dt. 30.04.2010 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that recognition to B.Ed. course of the institution be refused u/s 14 (3) (b) for the following reason:

1.     Experience Certificate of the Principal is not accepteable.

2.     Building completion certificate not signed by the competent authority.

3.     The land documents for plot No. 2 has been submitted after VT.

4.     The size of the library is 1000 sq. ft., hall size is less.

5.     The institution issuing experience certificate from 09.07.2004 to 24.04.2007 is recognized for 2008-2009.

The Committee considered the reply 22.05.2010 received on 24.05.2010 & dt. 28.05.2010 received on 31.05.2010 in response to ERC notice dt. 17.05.2010 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that recognition to P.T.T. course of the institution be refused u/s 14 (3) (b) for the following reason:

1.     As per the list of teaching staff all the teachers are appointed on 09.04.2010. The teaching staff appointed is not as per new norms.

2.     As per the Experience certificate of Principal submitted the Principal has experience from Indian Montessori Centre which is a sister institute of Educational Support Centre

Sanjay Kr. Singh, Advocate, Civil Court, Gaya, dtd 02.06.2010 & Arun Kumar Advocate & others dtd 13.02.2010 and decided that comments on complaints be asked from the institution with documentary proof.

           Considering the orders of the C.W.J.C. No.13927 of 2009 and CWJC No.9732 of 2010 a show cause notice was issued to 21 teacher training institutions to reply within 21 days and rest 17 colleges for compliance of deficiencies within 6 months time. In the mean time two orders were passed by the Hon’ble High Court of Patna in the bench of Justice Mridula Mishra & Justice Navin Sinha mentioning thereon for interim relief.

 

           As the date of hearing is fixed for 8th July 2010 where the Member Secretary, NCTE has to appear to apprise the Hon’ble Court on action taken and two orders recently passed by the single bench, it was felt to have legal opinion from the Standing Counsel after observing the orders in the different Courts. The Regional Director is requested to take up this issue with the NCTE, New Delhi and Standing Counsel of the Hon’ble High Court before placing the matter before the ERC.

 

           The matter needs legal opinion as well as to wait till the final order of the Hon’ble Court on 8th July 2010.

(i)            The type and number of reference books in the library are not encouraging.

(ii)           The Building plan has been approved for Higher Training Institute by the Office of the Commissioner, Kishanganj Municipality on 15.10.99 wherein the built up area and instructional facilities are not as per NCTE norms.

(iii)          The institution had submitted the building plan for the proposed B.Ed training college, which is not approved by the competent authority.

(iv)          As per the certificate issued by the Block Development Officer dated 23.05.2008, the said society is running Madarsa, ITI, School etc and proposed B.Ed college.  The demarcated site plan duly mentioning the Plot / Khasra No on which the different courses are being run / will be run is not submitted.

(v)           The State Govt vide letter dated 8th July 08 had stated that the institution is having the built up area of 881.14 sqm only, as against the required 1500 sqm as per Regulations, whereas the institution had submitted the completion certificate on 26th May 08.

(vi)         Certified copy of registered land documents not submitted by the institution.

The Committee considered the visiting team report, original file along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that recognition to B.Ed. course of the institution be refused u/s 14 (3) (b) for the following reason:

(i)            As per the VT Report, the land as per the land documents and Affidavit is not in a single plot.

(ii)           The size of classrooms is less than 500 sq. ft.

(iii)          The size of multipurpose hall is 1200 sq. ft, as against the required 2000 sq.ft

(iv)          The reply with regard to land registered in the name of Nabiul Fatima Womens Primary Teacher Training College whereas the proposed college is Nabiul Fatima Womens Teacher Training College, the institution had submitted a reply.

(v)           The land documents in the name of Nabiul Fatima Womens Primary Teacher Training College has been registered in 1998-1999 whereas the society applying for the B.Ed college has been formed on 8th Feb 2008. 

(vi)          The above at Sr. No. (vi) creates a doubt that the institution might be running some other courses on the said land.

(vii)         With regard to Certified copy of land documents, the institution has submitted the Certified copy of land documents issued in July / August 1988. 

(viii)        NOC of Practice teaching school not given.

(ix)          No. of computers only 8.

(x)           Playground insufficient.

(ii)         The instructional facilities i.e. the size of rooms, hall etc as mentioned by the Visiting Team are not as mentioned in the building plan & application submitted by the institution.

(iii)        As per the VT Report, the size of multipurpose hall is less than 2000 sq. ft.

(iv)         In para 10.1 (a) & 10.4, the VT members have stated that the institution has not appointed the teaching staff but have selected for appointment.

(v)         The VT members have stated that the facilities in the Science lab and E.T lab are not adequately provided.

(vi)        The VT members have stated that the reference books and journals in education are not sufficient.

(vii)      Regarding practice teaching schools, the secretary of the institution had only written a letter to the nearby schools for permission for practice teaching. No undertaking/ consent letter from the schools have been submitted.

The Committee considered the original file of the institution, Visiting Team Report u/s 17 along with relevant documents, NCTE Act, Regulations  and guidelines of NCTE published from time to time and decided that recognition/ permission granted to the institution be withdrawn for all the courses i.e. B.Ed, D.El.Ed and M.Ed courses after issue of Notice u/s 17 of the NCTE Act on the following grounds :-

(i)            Land and building are not in the name of the college.

(ii)           The institution is running a Sr. Sec and Secondary School in the same complex / building, but there is no clear demarcation of the various educational institutions running in the same campus.

 

(iii)          Teachers are not upto the mark. 

(iv)          On perusal of the file, it has been observed that the institution has proposed the building at Plot No. 125, 126 & 129 and Khata No. 15, 04, 94.  The building plan was approved for the above three plot / Khasra Nos and even the completion certificate has been issued for the above three plot Nos, whereas during the inspection u/s 17 of the NCTE Act of the institution on 05.06.2010, the institution had stated that the building is at Plot No. 226 and the building plan is also submitted for Plot No. 226, which is also not approved by the competent authority.

(v)           Even the building plan submitted seems to be tampered with “with regard to built up area mentioned in the Building plan”

(vi)          The institution had submitted a fresh lease deed executed on 11th April 2007 by the Society to the College for Plot No. 126, wherein it has been mentioned that the lease deed is for plain land, whereas as per the records available in the file, the building has already been constructed on plot No. 226.

(vii)          The staff list for all the courses during countersigned by the affiliating body not submitted.

(viii)        Language learning lab not available.

1.     As per the VT Report, the VT members were not shown the original land documents to ascertain the date of registration of land documents.

2.     The original building plan was not submitted before the VT Members for verification to ascertain the date of approval of the building plan and the approving authority.

3.     As per the VT Report, the Registration Certificate / Bye laws of the society was not submitted before the VT members for verification.

7.     The VT members have stated that the institution has earmarked approx 8000 sq ft of built up area for the B.Ed course, which is less than the required 1500 sqm as per Regulations.

8.     The VT members have stated that they were not shown the library of the institution.

9.     The VT members have stated that the building for the B.Ed course is under construction.

10.  The equipments in the Psychology lab and ET lab are not adequate.

11.  The VT members have stated that the management of the institution is non co-operative and inspite of the insistence of the VT members no videography of the inspection was carried out.

12.  The staff list for all the courses duly countersigned by the affiliating body not submitted.

13.  Facilities for Language Learning Lab are not mentioned in the VT report.

14.  Only one computer with printer in the ET lab.

15.  No list was provided by the institution for Science Lab & Psychology lab.

16.  No physical Education equipment was shown.

17.  The building appears to be good but on the spot verification it was found that the original land and building earmarked for B.Ed. course are being used by others.

18.  The Teachers are less in number as per norms.

19.  The I.C.T. and education technology lab is in very poor condition.

1.     As per the VT Report, the college is being run in a leased house.

2.     The Website of the institution is not launched as per VT.

3.     Documentary proof of details of infrastructural facilities not submitted to VT.

4.     The accommodation provided in the library is less than required as per Regulations.

5.     The institution is functioning from a rented building.

6.     As per VT Remarks in Overall Assessment “The institution is being run in a leased house at Old Bus Stand Road, Ward NO. 14, P. S. Telaiya, Koderma.  As per the records available in ERC, the institution had not submitted any land and building document for the above plot, whereas the recognition to the said institution was granted at Rajgaria Road, Near Mahadeo Modi Mandir, Jhumri Teliya, Distt. Koderma, Jharkhand.

7.     As per the self disclosure proforma submitted by the institution in NCTE-HQrs website, the address of the institution is Rajgharia Road, Near Mahadev Mandir and as per the VT Report, the college does not exists at that place.

8.     The lease deed submitted to the VT members is tampered.  As per VTR, the institution has stated the total land area as 1200 sqm whereas per VTR , which is less than the required as per NCTE Regulations.  Moreover, the lease deed has been executed in the name of Hon’ble Governor, Govt of Jharkhand State / province through the Secretary Dr. Dharma Nand Mishra s/o Sri Lalan Narayan Mishra at and PO Kochgawan, PS Warshali Ganj, Dist Nawada, Jharkhand Teachers Training College, Rajgariya Road, Jhumri Telaiya, Koderma.

9.     The building plan is for Plot No. 2764 & 2763 whereas the Affidavit, BCC & Land documents (which are tampered) are for different plot Nos. 

10.  The institution has not submitted the approved building plan for the land registered on 29.02.2008 nor for the land where the college exists at present.

11.  Further from the perusal of the file, it is found that the institution has submitted the photocopy of building completion certificate for plot Nos 11, 12 ,13, 14 & 15 and at pg 563 for plot Nos. 11, 12, 13, 14 & 65.  Both the certificates have been issued by the same Engineer on the same date.  Hence, the same seems to be tampered with.

 

12.  As per VTR, the institution had submitted a building completion certificate dated 17.09.2008 for Ward No. 14, Khata No. 1/10, Plot No. 11/46/97 and 11/49, whereas the institution has not submitted the building plan and also the land documents for the said land.

The Committee considered the original file of the institution, Visiting Team Report u/s 17 along with relevant documents, NCTE Act, Regulations  and guidelines of NCTE published from time to time and decided that recognition granted to the institution be withdrawn after issue of Notice u/s 17 of the NCTE Act on the following grounds :-

 

 

1.     The land is in the name of Sarifuddin Mandal not in the name of the college.

2.     The size of Hall is 1425 sqft.

3.     As per verification of the VT member, the institution is functioning in three storied building completely of only 885 sqmt of built up area.

4.     The institution is in possession of another land which is 10kms away from institution.

5.     Total area of land and built up area are where the institution is situtated is less than required.

6.     The faculty not approved by the affliating university.

7.     The books in the library are 2135.

8.     The Size of Multipurpose Hall was 95.15 Sq. ft.

9.     The Size of Library Room was 42.25 Sq.ft.

10.  The institution not mentioned the information regarding “the institution campus, buildings, furniture etc. should be barrier free.”

11.  The NOC regarding Practice teaching not attached in the VT Report.

12.  Affidavit of Rs. 100/- and Rs. 10/- regarding selection committee not submitted

13.  The Consolidated list of teaching staff  is not in a prescribed format.

14.  The experience certificate of the teaching staff not submitted.

ACTION UNDER SECTION 17 OF THE NCTE ACT IN RESPECT OF TEACHER TRAINING INSTITUTIONS IN WEST BENGAL:-

 

A letter no. F.No.1-14/2010/VCP/NCTE/A16964 dated 26.05.2010 has been received from the NCTE Hqrs.

 

The NCTE Hqrs. has forwarded the inspection report of the following institution and has requested ERC to issue show cause notice to these institution under section 17 of the NCTE Act on the points raised in the report.

The Committee considered the original file of the institution, Inspection report of the University, directions received from NCTE-HQrs vide letter dated 26th May 2010 along with relevant documents, NCTE Act, Regulations  and guidelines of NCTE published from time to time and decided that Show Cause notice prior to withdrawal of recognition u/s 17 of the NCTE Act be issued on the institution asking for specific point wise comments on the inspection report of the University.

(Complaint received against the institution)

 

The Committee considered the original file of the institution, complaint received against the institution from Sh. R. D. Pandey & S. N.Singh, Advocate, Adhina Nagar, Baba Chowk, Patna against Shivam Teacher Training College, Buxar, Bihar (ERCAPP300), along with relevant documents, NCTE Act, Regulations  and guidelines of NCTE published from time to time and decided that application of the institution for B.Ed. course be refused / Rejected as per NCTE Regulations 2009 for the following reason:

 

1.     Building completion certificate with the Plot No. Khata No. total area, built up area / plinth area issued by the competent authority not submitted – As the building is in progress.

2.     Covered/plinth area not given in the building plan.

3.     The Non-encumbrance certificate is in the name of individual.

4.     In support of Change of Land Use Certificate, the institution has submitted a Certificate from the Anchal Adhikari, Buxar, Bihar dated 7th Jan 2010 No other supporting document has been submitted. 

5.     With regard to Building plan, the institution had submitted a Original Certificate from the Assistant Engineer, PWD, Buxar  issued on 29th October 2009 wherein the Asst Engineer had stated the information about the house to be constructed on Holding No. 235, Khata No. 427, Plot No. 291.  The institution had further submitted a photocopy of Certificate issued by Sarpanch, Village Dalsagar, Town Buxar on 29th October 2009 and also from the Aanchal Adhikari, Buxar  stating that the land has been registered in the name of institution on 15th October 2009 and the proposed land is for the purpose of teacher education.  Both the certificates i.e. the Certificate issued by the Assistant Engineer and also the Certificate issued by the Sarpanch / Aanchal Adhikar are contradictory.

6.     From the Affidavits & also the application form, it is observed that the land is in two different villages i.e. Charitravan & Dalsagar Distt. Buxar.

7.     The Building completion certificate issued by the Assistant Engineer on 8th Jan 2010 states that the third floor of the building of the college is proposed for official residence. 

8.     The Building plan submitted is approved in the name of individual

9.     The Gift Deed is conditional

10.  The State Govt in its recommendation dtd 4th March 2010 had stated that the college got the building gifted from Smt. Lalita Devi vide deed dated 28.10.2009 whereas in the Gift Deed dated 28.10.2009, there is no mention of constructed building

11.  The institution had proposed the college at two Khasras i.e. 427 & 188/189.  From the certificate issued by the Aaanchal Adhikari, it is seen that both the pieces of land are neither in a single plot nor a well demarcated as per NCTE norms.

12.  As per the State Govt letter the building of the institution is constructed at plot No. 427, the total area of land of which is only 8783.83 sq.ft

During the course of discussion for the said institution, the concerned member was absent.

D.M. College of Education, Imphal, Manipur – 795 001

The Committee considered the original file of the institution,, along with relevant documents, NCTE Act, Regulations  and guidelines of NCTE published from time to time and decided that Show Cause Notice u/s 17 of the NCTE Act be issued on the institution to submit the information with regard to teaching staff for all the courses and also details of instructional and infrastructural facilities available in the institution.
