PROCEEDINGS OF 111th MEETING OF EASTERN REGIONAL COMMITTEE HELD ON 16th - 17th Sepetmber 2010

The 111th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was held on 16th-17th September 2010 at Conference Hall, ERC, NCTE, Bhubaneswar.  The Regional Director, ERC Dr. H.S. Tripathi introduced and welcomed the Chairperson, ERC Prof. J.C. Soni and all the members of Committee present in the meeting. 

 

             With the permission of the Chairperson, ERC, Dr. H.S. Tripathi, Regional Director (Convener), ERC placed the agenda notes of 111th meeting before the Committee.  The Sub-Group of the Eastern Regional Committee perused & considered all the cases and taking into consideration the  recommendations made  by the Sub-Group, the Eastern Regional Committee considered & decided the following matters/cases as per the proceeding noted below:-

On careful perusal, observation and consideration of the proposal of the institution along with the original file, all documents submitted by the institution, related clarifications / guidelines received from the NCTE Hqrs., the NCTE Act, Rules, Regulations 2009 stipulated by the NCTE, norms and standards, directons of NCTE-HQ vide letter No. 48-2/ 2010/PT/NCTE(N&S) /A22811 dated 30th August 2010, the Committee noted the following existing / idenfied deficiencies :-

 

1.     The clarification given by the institution regarding point viii of the deficiency letter may see by the committee.

2.     As per the CLU dt.22.01.2010 the Khatian No.452 is not mentioned in the land document. Plot No.569 which is mentioned in the land document is not mentioned in the CLU.

3.     Certified copy of land documents has been issued after the date of application.

4.     Notarised copy of CLU has been issued after due date.

 

 

On the basis of the observations made by the ERC while reviewing /reconsidering the case, the ERC reiterated its earlier decision of sending VT to the institution as decided by the ERC in its 107th despite existing deficiencies as per the list of experts members decided in 110th meeting.  The ERC further decided that the deficiencies may be communicated to the VT members for specific comments on the same.   

 

 

In case of exigencies, the Regional Director is authorized to change the team members from among the approved panel.

1.     The institution has not submitted CLU from competent authority.

2.     Notarized copy of conversion/ change of land use certificate issued by the competent authority.

3.     The Building plan is not approved by competent Civil authority.

4.     The land documents submitted is certified on 12.01.2010 i.e. after the date of submission of application.

5.     The enclosure 5 of the Affidavit regarding permissionto use the land is dated 15.02.2010 i.e. after the date of application.

6.     A complaint has been received in the office regarding submission of false and forged land related documents.

 

On the basis of the observations made by the ERC while reviewing /reconsidering the case, the ERC reiterated its earlier decision of sending VT to the institution as decided by the ERC in its 107th despite existing deficiencies as per the list of experts members decided in 110th meeting.  The ERC further decided that the deficiencies may be communicated to the VT members for specific comments on the same.

1.     The Deed of conveyance of land is conditional mentioning if in future any dispute arises regarding the scheduled mentioned property in that case the vender shall be bound to return the consideration amount to the purchaser including all other expences. In the light of above statement the land documents submitted by the institution is not as per the regulation and cannot be considered for the recognition.

2.     The institution has submitted a CLU from Gram Panchayat. The institution is required to submit CLU from the competent authority. The letter from BL & LRO dt.26.10.2009 is not in the order form and appears forged.

1.     As per application and affidavit, the Built up area is less than as per requirement of NCTE rules and Regulations.

2.     Original Certified Copy of the registered land documents issued by the Competent Authority.

3.     Notarized Copy of Conversion of Land Use Certificate issued by the competent authority.

4.     The land documents submitted indicates that the land is not is a single plot.

5.     Non-encumbrance Certificate from Revenue Authority by the competent authority.

6.     Building completion certificate with the plot no., total area, built up area, plinth area etc. from Competent Civil Authority.

7.     Enclosure as per column 5 of the affidavit.

8.     Undertaking in prescribed format.

9.     As per the affidavit of Rs.100 stamp paper submitted by the institution the land is on ownership basis for 38 years. This statement shows that the land is on lease basis

 

On the basis of the observations made by the ERC while reviewing /reconsidering the case, the ERC reiterated its earlier decision of sending VT to the institution as decided by the ERC in its 107th despite existing deficiencies as per the list of experts members decided in 110th meeting.  The ERC further decided that the deficiencies may be communicated to the VT members for specific comments on the same.

3.     The affidavit of Rs.100 (Photo copy P.413-414) contains the Plot No.3657, 3880, 3641, 4811, 5625, 5647, 5898, 5899 and 5605 where as the translated version of the land document (Gift deed) describeds the plot of Nos 4811(Khatian No.284, 816, 2093), 5605, 5603, 6137 only.

4.     Notarized Copy of Permission for change in use, character of land dt. 19.03.2010, which is after submission of on-line application.

5.     Downloaded Copy of application in triplicate in Prescribed Format.

6.     Approved building plan with Plot No., Khata No., total area and built up area from competent civil authority.

7.     Building Completion certificate signed by Sub-Asst Engineer, Nawda Dev. Block & BDO, Nawda Dev. Block.

8.     Non-encumbrance certificate from Revenue Authority.

9.     Covered area/plinth area is not as per norms.

On careful perusal, observation and consideration of the proposal of the institution along with the original file, all documents submitted by the institution, related clarifications / guidelines received from the NCTE Hqrs., the NCTE Act, Rules, Regulations 2009 stipulated by the NCTE, norms and standards, directons of NCTE-HQ vide letter No. 48-2/ 2010/PT/NCTE(N&S) /A22811 dated 30th August 2010, the Committee noted the following existing / idenfied deficiencies :-

 

1.     The institution has submitted a certificate ‘conversion of land use certificate’ from the Govt. of West Bengal, BL & LRO certifying that class of land has been converted in to non agricultural as per appropriate law before the transfer of the said land in the name of Moulana Abdul Kalam AzadCollege of Education (B.Ed.) Hence the certificate appears to be a Certificate of ownership / possession and not a land use certificate.

2.     Further, this is significant to note that the sale deed is conditional as mentioned at pg. 105/c of the land document submitted by the institution stating if in future any obligation or problem will arrises in respect of title and possession of the schedule bellow land property then  the seller will refund entire sale value alongwith interest and cost thereon to the purchaser . The above facts appears to be objectionable and while taking decision in the matter this fact may please be considered by the committee.

3.     Covered/Plinth area mentioned in the building plan i.e. 1051.42 Sq. Mts. Which is less as per NCTE norms.

4.     Total area mentioned in the building plan do not tally with an affidavit.

5.     Total area and built up area mentioned in the application form do not tally with affidavit, building plan. Building plan appears to be tampered.

6.     Date of issuing authority not given in the non-encumbrance certificate.

7.     The institution has not submitted the MOU / Bye-laws of the Trust / Society.

1.     Notarized copy of change of land use certificate issued by the competent authority

2.     certificate/ letter from the Registering authority clearly indicating provisions of act/ law under which the trust has been registered

3.     The land document submitted by the institution as Gift Deed is conditional.

4.     The letter dt.29.10.2010 with stamp of B.L. and LRO is not a CLU and it appears forged.

5.     As per the information in the Affidavit sworn on 20th October 2009, the land documents registered on 29th Oct 09 are reflected.  It appears to be a forged document.

2.     The Change of Land Use Certificate issued is a provisional certificate. The provisional document is notarized in 2010, which is after the date of application.

3.     The size of multipurpose hall is 900 sq. ft whereas as per Regulations it should be 2000 sq. ft.

4.     With regard to land documents, the institution had submitted the Deed of Award in the name of Bihar College of Teacher Education.  Certified copy of registered land documents (Sale Deed/ Gift Deed) not submitted. 

5.     Moreover, the Deed of award that the land/ building is a residential

8.    As per the application, the institution is a minority institution but minority certificate from the concerned State Govt not submitted.

9.     The institution had submitted land use certificate which is provisional and notarized in 2010 after the date of submission of application.

10.  The institution had submitted a Deed of Award instead of Registered Land Documents.  The same is also conditional.

6.     The Institution has not submitted the  Enclosure as per column 5 of the affidavit.

7.     The address of the institution is Village, Kendua C/o Manav Bharti School, Magadh Medical College, Gaya.  From the above, it appears that the institution is running a school/medical college in the said premises, which has not been mentioned in the application form.

8.     The affidavit is not signed by the applicant / deponent, hence, not acceptable.

9.     Notarised CLU not submitted.

10.  The application submission date is 26.10.2009, Certified copy of land documents are issued on 27.10.2009 i.e. after the date of submission of application.

11.  Building plan is in the name of individual.  The same is signed by Mukhia but not countersigned by the Govt engineer.

4.     As per the certificate of Engineer attached, it is stated that the construction of boundary wall was started on 25th August 2009, whereas as per the column 6 (i) of the lease deed, the construction can be started only after approval from the BIADA.

5.     The Non-encumbrance certificate has been issued by an Advocate and not from the competent authority.

6.     As per the approved building plan submitted, the size of Multipurpose hall is 700 sq.ft (approx), which is less than the required 2000 sq. ft as per Regulations.

3.     As per the land documents, the land is allotted for establishing for an Educational Institutions by Bihar Industrial Area Development Authority on lease period for 90 years, whereas on the same land documents, it is observed that the land is allotted for the purpose of Industry. 

4.     As per the clause 6 (i) of the lease deed, That no building or any construction shall take place unless specification plan for elevation and details thereof have been submitted by the lessee in triplicate which is approved in writing by the lessor or his nominee.  If the same is not accorded or is not available within 180 days of the submission of the plan, it would be presumed that the lessor or his nominee has no objection to the commencement of building or erection as the case may be.   The Building plan has been approved by Consultant, Project Implementation, BIADS & Consultant Technical, BIADA on 21st October 2009.  No other supporting document has been given. 

5.     The Lease Deed has been executed on 23rd October 2009 but the building plan / site plan has been approved on 21st October 2009.  

6.     Out of 5 acres of land allotted for the purpose of Education by BIADA, the society has allotted Plot No. 169, 172, 174 measuring 4048.20 sqm for the purpose of Bed college.  No site plan demarcating the plot wise area is given by the institution.

7.     The Non–encumbrance certificate has been issued on 9th February 2010.

8.     Notarised CLU not submitted. The letter dated 17.2.2010 issued from the Distt Magistrate does not bear Govt stamp and moreover it is after date of applilcation.

3.     In support of Change of land use, the institution had submitted a copy of certificate issued by the Aanchal Adhikari on 19th February 2010 stating the office has no objection for construction of educational institution on the said land.

4.     The institution has submitted two land documents one registered dated 22.09.2008 in the name of the society i.e. PRSNM Charitable Trust received with the application on 26.10.2009 and another land document registered dated 31.10.2009 in the name of the institution.

5.     The institution has submitted affidavit of Rs. 100 in respect of the land document registered on 31.10.2009 and received by the office on 22.02.2010.  No affidavit on Rs. 100 stamp paper in respect of the land document registered dated 22.09.2009 has been submitted by the institution.  Hence, this land document cannot be considered.

6.     In case of land documents registered dated 31.10.2009 which was received by this office on 22.02.2010 it is noticed that the date of application is 26.10.2009 whereas the date of receipt of the registered land document dated 31.10.2009 is 22.02.1020 whereas the date of registration of the land on which the recognition is being sought for should be prior to the date of application and not beyond it.

7.     The CLU dated 19.02.2010 from the Aanchal Adhikari has been issued after due date. 

8.     As per the Essential Data sheet, the total built up area in the institution is 12450 sq. ft, which is less than requirement of 1500 sqm as per Regulations.

9.     The infrastructure mentioned in the Essential Data sheet by the VT Members and that mentioned in the Building plan does not tally.

10.  The infrastructure details mentioned in the Essential Data sheet at Column 8 (i) and 8 (v) by the VT Members of the VTR does not tally.

7.     The letter issued by the Aanchal Adhikari dated 12.02.2010 at pg 309 is not a CLU.  Such letter issued without Government seal cannot be treated appropriate letter for consideration. 

8.     The building plan is not approved by the competent authority as it is neither issued by the village panchayat nor Municipality as practiced by the other Regional Committee.

9.     The State govt has clearly mentioned for this college to be dropped as they have given negative reply on 21.05.2010.

10.  The name of the person in whose favour the land deed has been executed is not reflected in the Trust Deed.

9.     The VT Experts visited the institution and found that the building was under construction, no room has been given final shape. No office is functioning. The Secretary produced a letter RD for time extension.  The institution vide its letter dated 02.07.2010 received in this office on 08.07.2010 requested to extent time for inspection in any date within 31st August 2010. 

 

 

On the basis of the observations made by the ERC while considering the case, the ERC decided to issue Show Cause Notice u/s 14(3)(b) of NCTE Act to the institution before refusing recognition for B.Ed. course on account of reasons observed by the ERC. 1.     Certified copy of registered land documents not submitted.  Even in the photocopy of land documents submitted, the photocopy of back portion of the land documents with the seal and stamp of registering / revenue authorities not submitted.

2.     Notarised CLU not submitted.  In lieu of Change of Land Use, the institution had submitted a certificate dated 6th Oct 2009 issued by the Circle Officer stating that the building constructed is being used for educational purposes, which is not notarized.

3.     Non-encumbrance certificate issued on 16.06.2010 after the date of submission of application.

4.     The institution is already recognized for PTT course vide order dated 04.09.2010 as mentioned in the print out of the application.

5.     As per clause 8 (3) of the Regulations 2009, an institution can apply for one basic unit only of an additional course or for an additional unit of the existing recognized course after completion of three academic sessions of the respective course.  Hence, the institution is not eligible for applying for B.P.Ed course unless it completes three academic years.

1.     With regard to deficiency at Sr. No. (i), the institution had submitted a reply stating that the land is in a single plot, however, no documentary proof has been submitted as a proof.

2.     With regard to reply to point No. (ii), the institution had submitted a reply stating that the size of the classrooms is 500 sq.ft, whereas as per the Essential Data Sheet of the VT Report, the institution is having four classrooms of 35 sqm each.  Hence, the deficiency pointed out by ERC still persists.

3.     With regard to reply to point No. (iii) regarding Multipurpose hall, the institution had questioned the ERC as to from where the ERC has gathered the information which is beyond the expectation of the institution.  However, the institution itself has agreed that the size of hall is 1200 sw.ft.  This is against the requirement of 2000 sq. ft as per Regulations 2009.  Hence, the deficiency pointed out by ERC still persists.

4.     With regard to reply to point No. (iv), (v) & (vi), the institution had submitted a reply stating that all the assets have been transferred in the name of Nabiul Fatima Women Teacher Training College for which they have sworn the same before the 1st Class Magistrate.  However, no document viz  sale deed/ gift deed/ transfer deed duly registered has been submitted to show that the land has been transferred in the name of institution.  Hence, the deficiency pointed out by ERC still persists.

5.     With regard to deficiency at Sr. No. (v) that the land documents in the name of Nabiul Fatima Womens Primary Teacher Training College has been registered in 1998-1999 whereas the society applying for the B.Ed College has been formed on 8th Feb 2008, the institution has not submitted any reply.  Hence, the deficiency pointed out by ERC still persists.

6.     With regard to deficiency at Sr. No. (vi) wherein the ERC on the basis of deficiencies at Sr. No. (iv) & (v) had created a doubt that the institution might be running some other courses on the said land, the institution had stated that the presumption of ERC appears to be wrong and frivolous not supported by the report of the visiting team, bears no significance. 

7.     The institution had not submitted the reply to the deficiency pointed out at Sr. No. (vii).

8.     With regard to deficiency at Sr. No. (ix), the institution had stated that ERC never asked the principal of the proposed institution to purchase more computer and also stated that the computer is always available in the market and if the ERC grants recognition by asking the college to purchase such and such quantity of computer, it can be purchased in the day or two, but the ERC never asked to strength the quantity of computer.  Hence, the deficiency pointed out by ERC still persists.

9.     With regard to deficiency at Sr. No. (x) regarding playground, the institution had stated that the playground does not effect the academic environment of the college, it can be managed later on.  Hence, the deficiency pointed out by ERC still persists. 

On the basis of the observations made by the ERC while considering the case, the ERC decided that the institution stands no merit and refusal order u/s 14 (3) (b) be issued.

1.     As per the VT Report, the total covered area in the institution is 10069 sq.ft. i.e. 934 sqm, whereas the institution in its representation dated 25th July 2010 had stated that it is having total covered area of 1100 sqm.  As per NCTE Regulations 2007, 1000 sqm of built up area is required and as per 2009 Regulations, 1500 sqm of built up area is required.

2.     In response to deficiency pointed out at point (vi), the institution had stated that it is having the seating capacity of 50 students, whereas the VT members in its report had stated that the institution is having the seating capacity of 20 students.

3.     In response to deficiencies pointed out at Sr. No. (vii), viiii & ix, the institution had stated that the facilities for sports, language lab and ET lab are adequately provided and also stated that if the number of equipments are deemed to be less according to norms of NCTE, they will fulfill forth with, if asked. 

On the basis of the observations made by the ERC while considering the case, the ERC decided that considering the Visiting Team reports and existing Regulations, the institution stands no merii and refusal order u/s 14 (3) (b) be issued.

On careful perusal, observation and consideration of reply from the institution along with the original file, all documents of the institution, related clarifications/ guidelines received from the NCTE Hqrs., the NCTE Act., Rules, Regulations 2009 stipulated by the NCTE, norms and standards, the ERC noted that the following deficiencies still exists :-

 

1.     The institution had stated that at the time of inspection only outside plaster of two rooms was incomplete due to excessive heat outside which after rainfall now stands completed, however, no documentary proof has been submitted to this effect.  As per NCTE Regulations, the building has to be complete  in the form of permanent structure at the time of inspection, whereas the institution itself has agreed that the building was under construction at the time of inspection.

2.     The institution had stated that it had added more apparatus, instruments, equipments in the Science, Psychology and ET Lab,  

3.     The institution has stated that they are having 3750 books in the library, whereas as per the VT Report, the VT Members have stated that the institution is having 1504 books.

4.     In reply to deficiency at Sr. No. vi, the institution had stated that the size of multipurpose hall has been extended to 2040 sq.ft, but no certificate / documentary proof has been submitted to the said effect.

5.     With regard to approval of the building construction for B.Ed college in the leased building, the institution had submitted a certificate from AGM (L&E), SAIL, Bokaro stating that the request of the institution to start job oriented courses in addition to the school level course has been examined and it can be acceded to.

6.     The building plan submitted by the institution was approved for the purpose of school.  The institution had submitted a different building plan alongwith the reply dated 5th Aug 2010, which is not approved by the competent authority.

7.     As per the land documents submitted by the institution, the land is allotted on lease basis by the Steel Authority of India Ltd for running a High School.  As per the requirement of the Regulations 2007, the land must be in the name of the institution / society.

8.     As per the Appeal order, the institution must obtain NOC from SAIL, Bokaro (However, NOC is not sufficient as per Regulations, rather the land must be in the name of the institution)

9.     The institution has submitted a letter from SAIL, Bokaro which cannot be treated as NOC and it does not fulfill the requirement as directed by the Appellate Authority.

10.  The institution has not submitted CLU from the competent authority.

1. A Special Report about the institution has been submitted by one of the Experts.  But nowhere he has been asked to submit the special and moreover it is not signed by both experts.

2. Further, on perusal of file, it is seen that the FDRs towards EF & RF were returned to the institution, which has not since been submitted by the institution. 

On the basis of the observations made by the ERC while considering the case, the ERC decided  that the facts of the case was deeply observed in respect of lease land, the comments of Director of Education, Government of Jharkhand which are negative and other   deficiencies with regard to infrastructural and instructional facilities, the Refusal order u/s 14 (3) (b) may be issued.

1.     The institution submitted FDR of Rs. 5.00 lakh & Rs. 3.00 lakh towards Endowment & reserve fund in the name of Jamini Kant Mahato High School B.Ed. College but not for in the name of the Jamini Kant B.Ed. College. 

2.     The copy of land documents submitted to the VT Members by the institution is forged.  The institution had submitted the land documents registered in Nov 2005 to the VT Members wherein the name of Purchaser is “JAMINI KANT B.ED. COLLEGE” (Pg 196 of VT Folder) whereas in the Certified copy of land documents registered in Nov 05, the name of Purchaser is “JAMINI KANT MAHATO HIGH SCHOOL B.ED. COLLEGE” (Pg 64 of file).   The amendment deed in the name of “JAMINI KANT B.ED. COLLEGE” has been executed on 23rd June 2009.

3.     The institution had submitted the permission of the competent authority for use of land for educational purpose on 21st August 2008 whereas in the amendment deed executed on 23rd June 2009 it is clearly mentioned that the said sale deed is for the purpose of Agriculture.  Hence from the above, it is apparent that the institution has not obtained the Change of Land Use / permission of the competent authority to run the educational institution on the above land.

4.     The institution had submitted a site plan approved by Engineer, IIT, Kharagpur wherein the location of the plot / khasra nos   is not mentioned.

5.     The institution had submitted the details of infrastructural facilities available in the institution.  The details of the infrastructure facilities as shown to the VT Members does not match with the details mentioned by the institution in the reply. 

On the basis of the observations made by the ERC while considering the case, the ERC decided that the institution stands no merit and refusal order u/s 14 (3) (b) be issued.

1.     In its reply dated 12th July 2010, the institution itself had agreed that it has demarcated 1032.90 sqm of built up area for the B.Ed college .

2.     The building plan submitted by the institution purported to be for the proposed B.Ed college has been approved in 1999 for the Higher Training Institute wherein the details about land area / built up area / plot No / Khata No / Khasra Nos are not mentioned.  However, the institution itself in its reply had claimed that the total built up area approved in the said building plan is 881.14 sqm.

3.     Moreover, the infrastructure mentioned in the building plan purported to be for the proposed B.Ed College submitted by the institution alongwith its reply does not tally with the details mentioned by the VT Members.

4.     The building plan submitted by the institution for the Multipurpose Hall is not approved by the competent authority.  Moreover, the size of Multipurpose hall mentioned in the building plan and that mentioned by the VT Members do not tally.

5.     The Appellate authority vide order dated 6th Nov 09 had stated that the institution had submitted the copy of approved building plan indicating Khasra no, proposed built up area before the Appeal whereas on perusal of the documents submitted by the institution, it is seen that the building plan submitted by the institution purported to be for the B.Ed college does not mention any details about land area/built up area/plot No/Khata No/ Khasra Nos.

6.     The building plan submitted by the institution of Jamia Al. Bukhari Hostel is a two storeyed building plan having ground, first and second floor, whereas in the photograph of the hostel submitted alongwith the reply, it is having ground and first floor only.

7.     Moreover, the said building plan has been approved in the name of society in October 1993 for the purpose of Student hostel, whereas the land in the name of society has been registered in December 1994.

8.     The approval of the building plan for the hostel has been approved for holding No. 267, whereas in the land documents, affidavits submitted by the institution, application form etc, there is no mention of the said holding No.

9.     The institution had submitted the building plan for the proposed B.Ed college, which is not approved by the competent authority.  Moreover the built up area differs.  The building plan and building completion submitted for the B.Ed college shows the built up area as 2030 sqm whereas in the reply, the institution had stated the total built up area as 2741.4 sqm.

10.  The Appellate authority vide order dated 6th Nov 09 had stated that the institution had submitted the certified copy of land documents to ERC, whereas the institution had submitted the land documents certified on 12th July 2010 alongwith the reply to Show Cause notice on 19th July 2010.

1.     In response to deficiency pointed at Sr. No. (i), the institution had stated that the size of classroom is 750 sq.ft whereas as per the Essential data sheet of the VT Report submitted by the VT Members and duly signed by the Chairperson and Secretary of the said institution, the institution had six classrooms of 45 sqm (approx 485 sq.ft) each. 

2.     In response to deficiency pointed at Sr. No. (ii), the institution had stated that the size of M.P. hall is 2250 sq. ft, whereas as per the Essential data sheet of the VT Report submitted by the VT Members and duly signed by the Chairperson and Secretary of the said institution, the size of multipurpose hall is mentioned as 135 sqm (approx 1455 sq.ft).

3.     The building plan submitted by the institution vide its letter dated 21.07.2010 received by this office on 29.07.2010 does not appear to be approved by the competent authority. Stamps not available/visible. Further the lines written in Hindi in the fresh plan are not in the Building plan.

4.     Site plan is not legible. The site plan taken from bldg. plan has been submitted.  

5.     As per the land documents submitted by the institution containing three Khasra / Plot No’s the total land is 63.750 decimal and in the affidavit of Rs. 100 stamp paper and pg. 609, the total land area is 2580.39 sqm.

6.     The name of executants of the land documents on behalf of the trust does not reflect in the trust deed of the society.

7.     The building plan submitted by the institution vide its letter dated 21.07.2010 received by this office on 29.07.2010 does not appear to be approved by the competent authority.

8.     As per the land documents submitted by the institution containing three Khasra / Plot Nos the total land is 63.750 decimal and in the affidavit of Rs. 100 stamp paper, the total land area is 2580.39 sqm.

The institution has submitted the document related to transfer of the land as mentioned above, hence the land document is appropriate as per Regulation required.

5.           Letter cannot be treated as CLU rather it appears to be forged.

6.           The building plan submitted by the institution is not in the name of the institution so this cannot be treated appropriate for consideration

However, as per the VT remarks :

 

Ψ    The size of the Multipurpose hall is 1500 sq.ft.

Ψ    As per the VT the building work is in progress. And as per the affidavit available in VTR file, Actual Building is being completed very with white wash very soon. Therefore, I shall furnish the staff room, common room and Library within the month of June 2010. As work is in entire progress work is going day and night.

Ψ    As per the VT Report, the building work is in progress.  The report also says that construction is completed.  However, as per the Affidvit of Rs. 100 dated 9.6.2010 submitted to the VT Members, the actual building is being completed even with while wash very soon. This particular statement nullifies thte report of VT regarding completion of construction of building.

Ψ    The institution has been granted 7 (9) even after the non-compkliance of the building for the institution.

The institution has not submitted adequate documents for reply to 7 (9).

 

On the basis of the observations made by the ERC while considering the case, the ERC decided that the Show Cause Notice u/s 14 (3) (b) be issued on the institution to submit the list of the teaching staff Countersigned by the competent authority of the affiliating university.
