PROCEEDINGS OF 112th MEETING OF EASTERN REGIONAL COMMITTEE HELD ON 30th - 01st October 2010

The 112th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was held on 30thSeptember – 1October 2010 at Conference Hall, ERC, NCTE, Bhubaneswar.  The Regional Director, ERC Dr. H.S. Tripathi welcomed the Chairperson, ERC Prof. J.C. Soni and all the members of Committee present in the meeting.

 

With the permission of the Chairperson, ERC, Dr. H.S. Tripathi, Regional Director (Convener), ERC placed the agenda notes of 112th meeting before the Committee. The Members of the Eastern Regional Committee perused & considered all the cases and taking into consideration the  recommendations made  by the Members, the Eastern Regional Committee considered & decided the following matters/cases as per the proceedings noted below:-

The Proceedings of the 111th ERC Meeting held on 16-17 September, 2010 were received and seen by the ERC members.  The minutes will be confirmed in the next general ERC meeting.

On the basis of the record, institution file & VT report, the following deficiencies were observed by ERC office:

 

1.     The institution has submitted a certificate from Gram Pradhan in support in support column 5 of the affidavit.

2.     Possession / mutation certificate in support of land document is required to be submitted.

3.     Multipurpose hall mentioned in the VT Report i.e. 141.43 Sq. Mts. which is less as per NCTE norms.

4.     The land should be in the name of the institution but as per VT Report, the land is in the name of the trust i.e. Prasanta Kumar Baidya Seva Trust.

5.     The institution has proposed the building/ college in three different plots i.e. 280, 279 & plot no. 639 measuring 2684.94 Sq. Mts. is located at a distance of 0.5. K.M. from the above two plots having building construction as per VT Remarks.                

6.     The institution has not submitted the original Affidavit on Rs.100/- stamp paper regarding selection committee for recruitment of the teaching staff.

7.     The institution has not submitted the original Affidavit on Rs.10/- stamp paper regarding individual teaching staff.

8.     Eight Nos. of computers are available as per VT Report.

9.     Laboratory equipments are not sufficient as per VT Report.

10.  The institution does not have more references and textbooks on education and subscribe for more number of journals and periodicals as per VT remarks.

On careful perusal, observation and consideration of the proposal of the institution along with the original file, Original VT Report, Video CD, all documents submitted by the institution, office observation & remarks, related clarifications/ guidelines received from the NCTE Hqrs., the NCTE Act., Rules, Regulations 2009 stipulated by the NCTE, norms and standards, the ERC decided as follows:-

 

(i)    The multipurpose Hall is 141 sqmts., less than the NCTE norms and as per office note page 4, the land is not in one Plot nor it is adjacent and as such, it has been decided to notice under section 14(3)(b)

 

Hence, Show Cause Notice u/s 14(3)(b) of NCTE Act be issued to the institution before refusing recognition for B.Ed. course on account of deficiencies, observations & remarks of ERC office.  The institution is to submit written representation within 30 days of issue of the notice.

Observations of the ERC Office

On the basis of the record, institution file & VT report, the following deficiencies were observed by ERC office:

 

1.     As per VT Report Science Lab, Psychology Lab, Language Learning Lab are not working properly.

2.     As per VT Report, there are Computer-3, UPS-3, TV-1 in ET Lab and Terminal –Student Ratio is 1.33.

3.     As per VT Report, Equipments /consumables are yet to be procured.

4.     The change of land use certificate by SDL & LRO is not notarized and is also after the date of submission of application i.e. 15.01.2010

5.     The land is certified after the date of submission of application i.e. 08.02.2010.

6.     The building plan and the building completion certificate submitted is not approved by the competent civil authority.

7.     Built up area not mentioned in the building plan

8.     The date of Registration of land is not mentioned in the affidavit.

9.     Non encumbrance Certificate from SDL &LRO issued on 17.01.2010 after the submission of application.

10.  The institution has not submitted the certificate of the registration of the society only a paper showing bye-laws has been submitted.

11.  As per the paper of the society are not submitted, it is not clear as to whether the person filing an application is authorized representative of the society or not.

12.  As per the VTR, the lands possess by the institution is 4160 sqft.

13.  The VT is not clear about the construction of the building whether it is as per bye-laws or not.

14.  The library is to accommodate 30 student. The library has 2029 books of which 2000 are related to education.

15.  The CLU dt. 15.01.2010 is not duly stamped with Govt. Seal and has been issued after due date.

 

On careful perusal, observation and consideration of the proposal of the institution along with the original file, Original VT Report, Video CD, all documents submitted by the institution, office observation & remarks, related clarifications/ guidelines received from the NCTE Hqrs., the NCTE Act., Rules, Regulations 2009 stipulated by the NCTE, norms and standards, the ERC decided as follows:-

 

(i)    Page 79-80, observation of the VT members categorically speaks that the building is under construction. Issue notice under 14(3)(b)

 

Hence, Show Cause Notice u/s 14(3)(b) of NCTE Act be issued to the institution before refusing recognition for B.Ed. course on account of deficiencies, observations & remarks of ERC office.  The institution is to submit written representation within 30 days of issue of the notice.

On the basis of the record, institution file & VT report, the following deficiencies were observed by ERC office:

 

1.     Built up area mentioned in Affidavit and application is less than as per NCTE norms.  As per VTR, Built up area is less than as per NCTE norms i.e. 832 Sq.ft.

2.     As per VTR, Size of the Multipurpose hall is less than as per NCTE norms i.e. 247 Sq.ft.

3.     As per VTR, Size of the Library cum reading Room is less than as per NCTE norms i.e. 226 Sq.ft. and Library seat is not sufficient as per norms

4.     As per VT Report, Hall is under Construction.

5.     As per VT Report, Language Learning Lab is not available.

6.     As per VT Report, Practice of teaching school is 06 and NOC from the schools are not submitted.

On the basis of the record, institution file & VT report, the following deficiencies were observed by ERC office:

 

1.     As per VTR Pg. 100, infrastructure is not as per NCTE norms. Multipurpose hall, ET lab. is not available. Furniture is not available.

2.     As per VTR, Size of the Library cum reading Room is 608.4 Sq.ft.

3.     As per VTR, No separate Science lab is available. Science Lab. is combined with Psycho-Geography.

4.     As per VTR, No. of Books of the Library is 1251., Details of title of the books is not mentioned in the VTR as indicated “separately counted”.

5.     Certified copy of the registered land documents issued by the competent authority.

6.     Notarized copy of change of land use certificate issued by the competent authority.

7.     Approved building plan with Plot No., Khata No., Khesra No., total area, built up area from competent civil authority.

On careful perusal, observation and consideration of the proposal of the institution along with the original file, Original VT Report, Video CD, all documents submitted by the institution, office observation & remarks, related clarifications/ guidelines received from the NCTE Hqrs., the NCTE Act., Rules, Regulations 2009 stipulated by the NCTE, norms and standards, the ERC decided as follows:-

 

The VT reports and the records by the institution, it is apparent that the built-up area and land as per the NCTE norms in  view of the affidavit given by the Principal Govt. PTTI, but as there is no provision of Multi Purpose Hall, issue notice under Section 14(3) (b)

 

Hence, Show Cause Notice u/s 14(3)(b) of NCTE Act be issued to the institution before refusing recognition for D.Ed. course on account of deficiencies, observations & remarks of ERC office.  The institution is to submit written representation within 30 days of issue of the notice.

Observations of the ERC Office

Decision of the Committee

 

On the basis of the record, institution file & VT report, the following deficiencies were observed by ERC office:

 

1.     The institution has not identified the rooms for the instructional facilities i.e. classrooms, laboratories, halls etc. and the instructional space available in the institution is not as per NCTE norms.

2.     Sports facilities have not been provided in the institution

3.     Equipments / tests in Science lab, Psychology lab, ET Lab Language lab not provided at all by the institution.

4.     Books and journals not provided at all in the library

5.     The institution has not made arrangements for practice teaching.

6.     The institution has not created its website.

7.     The size of library is only 400 sq.ft as against requirement of accommodation for 50 students as per Regulations.

8.     As per the VT Members, the institution has not provided furniture, teaching aids etc in the institution.

9.     As regards books and journals in the library, the number falls short of requirement of 3000 books and 1000 titles as per Regulations.

10.  As per the VT Report, the institution has provided only six computers in the ET lab.

11.  The VT Members have further stated : The proposed B.Ed college is a three storeyed building.  Two floors completed.  2nd floor rooms are lacking plaster.  The college building area is not demarcated.  The Electricity is not yet reached to the proposed B.Ed College.  Drinking water facility is not found.

12.  As per the sale deed dated 12th October 2010, the sale deed is for a residential land.  In support of CLU, the institution had submitted a certificate issued by the Circle Officer, Baliapur, Dhanbad on 19th Jan 2010 i.e. after the last date of submission of application stating that the land is useful to the college, which is not acceptable.

13.  The Non-Encumbrance certificate has been issued on 19th Jan 2010 i.e. after the last date of submission of application.

14.  The certified copy of land documents have been issued on 18th Jan 2010 i.e. after the last date of submission of application.

15.  In the application form, the website address and PAN No. of the institution is not mentioned.

16.  Dates of registration in the affidavit do not tally with the land documents.

17.  Mode of possession of land not clearly mentioned in the affidavit and Enclosure as per column 5 not submitted.

18.  Total area mentioned in the affidavit do not tally with an application along with building plan.

19.  Plinth area mentioned in the building plan along with completion certificate which is less than as per required.

20.  Total area not mentioned in the building completion certificate.

(i)    Page 208, the report of the VT members, clearly indicate that the building is under construction not fully in operational stage, the proposed college is still not demarcated its land and building, notice under Section 14(3)(b)

2.     Teachers for Physical & Health Education, Work Experience & IT Literacy not available.

3.     No. Journals not as per NCTE Norms.

4.     Science, Psychology and ET lab not available.

5.     As per VT Remarks 3 No. of computers and one laptop available.

7.     NOC of Practice teaching school not given.

On the basis of the record, institution file & VT report, the following deficiencies were observed by ERC office:

 

1.     List of teaching staff not submitted by the institution. As per VT Remarks human resources are regrettably poor.

2.     NOC from competent authority not obtained.

3.     No indoor and out door games & sports materials.

4.     Size of the multipurpose hall is 95.92 Sq. Mtr. which is less than required.

5.     Size of classroom 40.51 Sq. Mtr. Which is less than the required.

6.     Teachers for Physical & Health Education not available.

7.     No. Books on education, no encyclopedia alongwith no subscribed journal available.

8.     Science Lab, Psychology Lab, ET Lab and Language Learning Lab. not available.

Observations of the ERC Office

Decision of the Committee

 

On the basis of the record, institution file & VT report, the following deficiencies were observed by ERC office:

 

1.     As per the VT Report, the size of Multipurpose hall is 1800 sq. ft as against requirement of 2000 sq ft as per Regulations. 

2.     The infrastructure facilities viz. size of multipurpose hall, classroom, principal room, library etc.  as mentioned in the Building plan does not tally with the details of infrastructure details mentioned by the VT Members, whereas the VT Members have stated that the infrastructure mentioned is the same as in the building plan.

3.     As per VT Report, the institution is having only one computer in the ET lab.

4.     In support of resolution of the approving authority approving the building plan, the institution had submitted a resolution of the society stating that 4000 sqm of land is allotted for B.Ed course.

5.     Alongwith the application form and reply to DLI, the institution had submitted the building plan signed by local engineer on 7th March 07 and approved by Gram Pradhan, whereas alongwith the VTR, the institution had submitted the same building plan, which has been signed by the Executive Engineer, Housing, Biharsharif, Nalanda in March 2007.

6.     In the application form, the website address of the institution/society is not mentioned.

7.     In the application form, the institution has mentioned the PAN No. as CA13, which seems to be incorrect.

8.     The society applying for the B.Ed college has been registered in 12th Aug 2004 whereas the land documents have been registered on 11th April 1978.

9.     As per the Land Possession Certificate issued on 7th Sept 09, the land on which the college is being proposed is Agricultural.  In support of Change of Land use, the institution had submitted an Affidavit stating that it has demarcated Khata No. 449 for B.Ed facility. 

10.  The Non-encumbrance certificate has been issued on 25th Jan 2010 i.e. after the last date of submission of application.

11.  In the affidavit dated 26.10.09 and also the application form, the institution has demarcated Khata No. 449 for the B.Ed college, whereas in the Affidavit, Non-Encumbrance Certificate., Building Completion Certificate, Building plan it has mentioned seven different Khasra Nos.

12.  In the affidavit, the institution has mentioned the land area as 11.67 acres, whereas in the Building plan, it has mentioned the land area as 5.73 acres.

13.  As per the building plan and Building completion Certificate, the building has been constructed at Khata No. 449, 584, 61,125, 218, 405 & 349, Plot No.s 5279, 5155, 5617, 5333, 5334, 5342, 5337 & 5142, Thana No. 402, whereas as per the application form, VTR, Affidavit, the institution has demarcated only Khata No. 449, Plot No. 5279 for the B.Ed College.

14.  The institution is running Degree courses in the name of Mahabodhi College in the same premises since 1983.  The institution has not submitted site plan demarcating the area for the degree college & proposed B.Ed college.

15.  The size of multipurpose hall is 750 sq.ft (approx) as against the requirement of 2000 sq ft as per Regulations.

 

On careful perusal, observation and consideration of the proposal of the institution along with the original file, Original VT Report, Video CD, all documents submitted by the institution, office observation & remarks, related clarifications/ guidelines received from the NCTE Hqrs., the NCTE Act., Rules, Regulations 2009 stipulated by the NCTE, norms and standards, the ERC decided as follows:-

 

(i)      On physical assessment of CD and relevant file and VT report, the proposed College is to function under the umbrella of existing multi-faculty college without any demarcation of the proposed institution, it is clear from the VT report that the Multipurpose Hall is not as per NCTE norms, issue notice under section 14(3)(b).

 

Hence, Show Cause Notice u/s 14(3)(b) of NCTE Act be issued to the institution before refusing recognition for B.Ed. course on account of deficiencies, observations & remarks of ERC office.  The institution is to submit written representation within 30 days of issue of the notice.

Observations of the ERC Office

Decision of the Committee

 

On the basis of the record, institution file & VT report, the following deficiencies were observed by ERC office:

 

1.     As per VTR, total building area is not as per NCTE norms as per VT Remarks.

2.     The VT Members have stated that the total built up area actually verified does not match with the Building plan submitted

3.     Further, the VT Members have stated that the infrastructure facilities are not fit as per NCTE norms.

4.     The Website of the institution is not yet launched.

5.     As per VT Report, the institution has not made provision for safety measures during exigency and also the instructional space is not as per NCTE norms.

6.     Playground is not provided in the institution.

7.     The institution has provided only 1500 books and 500 titles in the library as against the requirement of 3000 books and 1000 titles.

8.     The total seating capacity in the library is only 10 as against 50 required as per Regulations.

9.     The institution has not made arrangements for practice teaching.

10.  As per VT Report, the institution has not obtained the permission of the competent authority to use the land exclusively for teacher education course.

11.  Furniture is very poorly provided in the institution.

12.  As per the details of infrastructure facilities submitted by the institution, the size of classrooms is less than 500 sq. ft, multipurpose hall size is 700 Sq. ft. which is less as per NCTE norms.)

13.  The VT Members have also stated the that the building is old which is not as per NCTE norms.  All the rooms are very small and poor equipped. There is no laboratory, ICT lab, Seminar Lab, Multipurpose hall, staff room with poor electrification.  Temporary electrification items are found in the building.  Insufficient space for movement in the building.  Bank statement not submitted.  There is no stock register.

14.  In the application form, PAN No of the society, Website address of the society/ institution is not mentioned.

15.  The Certified copy of land documents issued on 24th Nov 2009 submitted, whereas as per Regulations, the same are to be issued prior to the date of application.

16.  The institution has given four different registered land documents with regard to land, which shows that the land is not in a single plot.

17.  The institution had submitted the Non-Encumbrance Certificate from the Panchayat, whereas it should have been from the Revenue Authorities.

18.  The Change of Land Use Certificate has been issued by the Panchayat, which is not clear. Notarized Change of land use certificate not submitted. Only the stamp of the notary has been affixed. 

19.  The institution had submitted different statements with regard to Land and Built up area on two different affidavits.  On the Affidavit submitted alongwith the application form, the institution had submitted the Land Area as 2704.78 sqm and Built up area as 1551.43 sqm, whereas on the Affidavit submitted alongwith the reply to Deficiency letter, the institution had submitted the Land Area as 2637 sqm and Built up Area as 1705 sqm.  Both the Affidavits have been attested on the same date, by same person and even by the same Notary.  

20.  The institution had submitted the Building plan with the covered area of 18360.72 sq.ft on three floors.  The floor wise built up area is not mentioned.   The plinth area / ground floor of the building is approx 6120 sq.ft (18360 /3), whereas as per Regulations, the institution should have 1500 sqm of built up area on the Ground floor only.

21.  The State Govt recommendation is negative vide Govt letter dated 21.05.2010.

22.  The information relating to land area / built up area appears contradictory and misleading.

 

On careful perusal, observation and consideration of the proposal of the institution along with the original file, Original VT Report, Video CD, all documents submitted by the institution, office observation & remarks, related clarifications/ guidelines received from the NCTE Hqrs., the NCTE Act., Rules, Regulations 2009 stipulated by the NCTE, norms and standards, the ERC decided as follows:-

 

(i)    The VT report at Page 380 speaks that the building is not at all fit for (B.Ed) the proposed institution. In page 72, the VT member clearly mention that in the existing building, there is no specification of norms size nor at all fit for the course, notice for refusal after having 14(3)(b).

 

 

Hence, Show Cause Notice u/s 14(3)(b) of NCTE Act be issued to the institution before refusing recognition for B.Ed. course on account of deficiencies, observations & remarks of ERC office.  The institution is to submit written representation within 30 days of issue of the notice.

On the basis of the record, institution file & VT report, the following deficiencies were observed by ERC office:

 

1.     As per the building plan submitted, the institution has stated the Ground Floor Area as 654.35 sq m, whereas the VT Report states the Carpet area as 480 sqm.

2.     The size of Multipurpose hall mentioned in the VT Report i.e. 1925 Sq. ft. is less than required 2000 sq ft as per Regulations.  Moreover, the size of Multipurpose hall mentioned in the VTR does not tally with the size of Multipurpose hall mentioned in the Building Plan.  In the Building plan, the size of Multipurpose hall is mentioned as 201.87 sqm and 77.77 sqm respectively.

3.     In support of resolution of the approving authority approving the Building plan, the VT Members have enclosed a copy of the resolution passed by the society of the institution for starting the B.Ed college.

4.     The VT Members have stated that the institution has not yet obtained the willingness for practice teaching from the schools.

5.     As per the VT Report, the furniture in the library is not yet purchased.

6.     As per VTR, the institution is having only 825 books on teacher education.

7.     As per the VT Report, the playground is not adequate to conduct football like games.

8.     The VT Members have mentioned that they have verified the original land document dated 24.09.2009, whereas no such document is available in the file.

9.     The details of Non Encumbrance Certificate and Mutation / Land Possession Certificate not given by the VT Members.

10.  The Building completion certificate submitted by the institution is issued by a private Registered engineer, it is countersigned by Asst Engineer, PWD.  

11.  The information regarding seating capacity / accommodating capacity in the library is contradictory.

12.  As per the application form, the date of completion of construction of the building is 30th April 2009), whereas the land documents registered on 30th Sept 2009 submitted does not speak of the constructed building.

13.  As per the sale deed, the sale is for homestead land (Farmhouse).  The institution has not submitted Notarized copy of change of land use certificate issued by the competent authority.  In support of CLU, the institution had submitted a certificate issued by the Aanchal Adhikari, which is not notarized.

14.  The affidavit has been sworn by Kalawati Singh terming as Secretary, land documents have been registered through Smt Kalawati Singh terming as trustee whereas as per the online application, Dr. Rakesh Singh, Member is the authorized applicant for the application form. 

15.  The non-encumbrance certificate is issued in the name of individual.

16.  Approved building plan by the competent civil authority mentioning the Plot No., Total area and Built up area.  The signature of the approving authority does not seem to be original in light of documents.  Further, the building plan submitted does not contain the date of approval of the competent authority. 

17.  Enclosure as per column 5 not submitted.  In support of Enclosure 5, the institution had submitted a certificate issued by the Aanchal Adhikari on the basis of Affidavit sworn by Smt Kalawati Singh, terming as Secretary of the Society.

18.  Building completion certificate with the plot No., Khata No., total area & built up area from competent civil authority not submitted.

19.  Approved building plan is not signed by the competent authority and covered Area is less than as per NCTE norms.

On the basis of the record, institution file & VT report, the following deficiencies were observed by ERC office:

 

1.     Language Learning Lab is not available as per VT report.

2.     Internet facility is not provided in the ET lab.

3.     As per VT Report, the size of classrooms are 480 sq. ft as against the requirement of 500 sq. ft as per Regulations.

4.     As per VT Report, the size of multipurpose hall is 720 Sq. ft. as against requirement of 2000 sq ft as per Regulations

5.     As per the VT Report, the institution has provided only 700 books related to Education.

6.     The VT members have submitted two contradictory statements with regard to books.  At pg 272 of VT Folder, they have stated that the institution is having 3137 books, whereas at pg 257 of VT Folder, they have stated that the institution is having 3050 books.

7.     The infrastructure facilities viz size of multipurpose hall, classroom, principal room, library etc.  as mentioned in the Building plan  does not tally with the details of infrastructure details mentioned by the VT Members, whereas the VT Members have stated that the infrastructure mentioned is the same as in the building plan.

8.     The total area of the Affidavit and land document not tally with the Building Plan submitted by the institution.

9.     Notarised CLU not submitted.  In support of Conversion of Land Use Certificate, the institution had submitted had submitted a photocopy of Land Use Certificate issued by Aanchal Adhikari, Hazaribag stating that the said land is in use of DEO College of Education, Hazaribagh, Jharkhand.

10.  As per the application form and also the building completion certificate issued by Aanchal Adhikari, the building has been completed in June 2009, whereas the building plan has been approved by Aanchal Adhikari on 24.10.2009.  Further, in the land documents registered on 14.10.2009, there is no mention of the constructed building. 

11.  The covered area of the Building plan not as per NCTE Regulations.

12.  There is no provision for multipurpose hall in the Building plan submitted by the institution / society.  The institution had submitted a fresh building plan approved on 3rd May 2010 by the Aanchal Adhikari wherein the infrastructure details is different from the infrastructure details of the earlier building plan.  However, the building plan approved on 3rd May 2010 is not acceptable as the same has been approved after the last date of submission of application.

13.  The State Govt recommendation is Negative.

14.  The letter issued by CO dated 16.10.2009 titled Land Use Certificate is actually not a Land Use Certificate.

The ERC office made the following observations that six months have already lapsed and the institution has still not complied the following deficiencies as per the permission order dated 28.07.2010 and the institution is still deficient with the following:

 

1.     One Set of application in prescribed format not submitted.

2.     D.D. of Rs. 40,000/- towards Processing Fee not submitted.

3.     An Affidavit not submitted (in original) duly attested by the Notary Public/ Oath Commissioner in prescribed format. As per clause 8(8) of the NCTE Regulations, an affidavit on Rs. 100 stamp paper attested by Notary Public/Oath Commissioner in the prescribed format is to be submitted indicating location of the land, total area in possession, permission of competent authority to use for educational purpose, mode of possession etc

4.     Fixed Deposit Receipt of Rs. 5.00 lakhs (in original) not submitted as Endowment Fund. As per clause 10(1) of the NCTE Regulations, in case of self-financed institutions/courses, Fixed Deposit Receipt of Rs. five lakhs towards Endowment Fund (in original), from a Nationalized Bank of a duration of & above 5 years is required.  OR Certificate/ Supporting documents from the Government that the course is not self financed and that it is fully funded by the Government.

5.     Fixed Deposit Receipt of Rs. 3.00 lakhs (in original) not submitted as Reserve Fund. As per clause 10(1) of the NCTE Regulations, in case of self-financed institutions/courses, Fixed Deposit Receipt of Rs. three lakhs towards Reserve Fund (in original), from a Nationalized Bank of a duration of & above 5 years is required. OR Certificate/ supporting documents from the Government that the course is not self financed and that it is fully funded by the Government.

6.     Approved Building Plan from competent authority with plot no. Khata No. Built up area, Total area, Khesra no. etc to be submitted for the proposed B.Ed. course. As stipulated in the instructions enclosed with the application proforma prescribed under clause 5(1) of the NCTE (Recognition Norms & Procedure) Regulations, 2007 approved building plan along with completion certificate (if the building has already been constructed) from the concerned competent authority is required to be submitted.

7.     Certified copy of Registered land lease /ownership documents has not been submitted as per Regulation 8(8) & 8(7).   ( Duly notarized English version of land documents also  to be submitted)

8.     Building completion certificate from the competent authority mentioning the plot no. Khata No. Built up area, Total area, Khesra no. etc to be submitted for the proposed D.Ed. course (if the building has already been constructed) from the concerned competent authority is required to be submitted. As per NCTE Hqrs. , New Delhi  vide letter dt. 28.06.2009 (Pg. 35), received in this office on 07.07.2009 the application is processed for the academic session 2009-2010.  

On careful perusal, observation of office & remarks along with the original file, related clarifications/ guidelines received from the NCTE Hqrs., the NCTE Act, Rules, Regulations 2009 stipulated by the NCTE, norms and standards, the ERC decided that the Registrar of the Rajiv Gandhi University be informed to submit the compliance within 30 days.

This institution was refused recognition by ERC in its 107th meeting held on 5th –8th May 2010 on the following grounds: -

i.              Notarized CLU not submitted.

ii.             Undertaking in prescribed format not submitted.

iii.            Building plan submitted is not approved by the Competent Civil authority.

iv.            The Built up area mentioned in the building plan and building completion certificate do not tally.

v.             A certificate from the registering authority clearly indicating the provisions of act/ law under which the trust has been registered.

vi.           FDR not in the name of the institution.

 

The institution preferred an Appeal and the Appellate Authority vide order No. 89-579/2010-Appeal/A23455 dated 27.08.2010 has been remanded back to ERC. Accordingly, the appeal was accepted and ERC’s order dated 15.05.2010 set-aside with direction to the ERC for further processing of the case on merit.

Further, on scrutiny of application, the following observations are submitted:

(i)            As per appeal order “ the committee noted that the institution submitted notarized copy of CLU dt.16.07.2009”. However, as per record available in the file Pg.175, the certificate dt.16.07.2009 has been issued by the Pradhan stating that” schedule of land is exclusively meant for running the David Hare Teachers Training College”. Moreover it is not notarized.

(ii)           Undertaking in the prescribed format is also on record.

(iii)          The institution has not submitted CLU from the competent authority.

(iv)          As per the building plan, the multipurpose hall is less than the required norms.

(v)           As per the appeal order dated 27.08.2010, the institution has a copy of CLU (not notarized) along with a notarized affidavit on judicial stamp paper of Rs.20/- regarding conversion of land.

(vi)          As per the records available in the file, CLU is not available.

Further, on scrutiny of application, the following observations are submitted:

 

(i)            The ERC may take note of its refusal order and the order of the Appellate Authority.  Affidavit is incomplete in respect of Col-5.

(ii)           The notarized CLU issued by the Gram Panchayat without bearing Mmo etc. is dtd.11.02.2010 and notarized on 08.02.2010 is not only contradictory but also after the date of submission of application which is not acceptable.

(iii)          The building plan signed by the Pradhan has been accepted but it is not signed by the Engineer.

(v)      As per the document, the land is not exclusive for B.Ed College.  It is also being used for MBA, MCA, Hotel Management etc.

(vi)     As per affidavit the plot no. is A-201 however in the building completion certificate it is mentioned that building is constructed on plot no. 215(P) and as per building plan the plan is for A-201 & 215(P). in the application the plot no. is A-201.

 

The institution preferred an Appeal and the Appellate Authority vide order No. 89-559/2010-Appeal/A23387 dated 27.08.2010 has been remanded back the case to ERC for conducting a inspection of the institution and further action thereafter as per regulations.

This institution was refused recognition by ERC in its 107th meeting held on 5th –8th May 2010 on the following grounds: -

 

1.     Notarized copy of Change of Land Use Certificate issue by the competent authority (Not submitted).

2.     The institution has mentioned two different information in the affidavit dated 26th Oct 09 and the Affidavit dated 16th Feb 2010 with regard to Enclosure as per column 5 of the Affidavit.  The enclosure 5 of the Affidavit dated 26th Oct 09 has not been submitted whereas in support of Enclosure 5 of the Affidavit dated 16th Feb 10, the institution had submitted a declaration of the society for exclusive use of land by the society issued on 11th Nov 2008. 

3.     The land documents are in the name of individual.  The land documents are in the name of Uday Memorial B.Ed college, Kedal, Thana Sadar, Distt Ranchi Director Sh. Santhosh Mahto whereas it should be Uday Memorial B.Ed College, Kedal, Thana Sadar, Distt Ranchi through Director, Sh. Santhosh Mahto.  As per the sale deed dated 20th October 2008, the land is agricultural .  The institution has not submitted any document to show that it has got the land converted from agricultural to educational / institutional.

4.     The Plinth area in the building is 800 sqm whereas as per Regulations 1500 sqm is required on the Ground floor only.  The NCTE-HQrs vide letter No. F.No. 48-34/2010/NCTE/N&S/A13303 dated 9th April 2010 had clarified that required built-up-area as prescribed in the concerned norms in the Regulations 2009 refers to the total  built up area available in a single storey or multi-storey building constructed upon the prescribed land area.

 

The institution preferred an Appeal and the Appellate Authority vide order No. 89-556/2010-Appeal/A23741 dated 31.08.2010 has been remanded back the case to ERC for further processing of the case on merit.

 

On Scrutiny of the application submitted by the institution, the following observations are noted :-

1.     The CLU has not been submitted to the office of ERC till date. However, on perusal of the appeal filed by the institution and copy received from NCTE-HQrs, it is observed that the institution had submitted a copy of Certificate issued by the Aanchal Adhikari stating that the office has no objection for using the land for educational purposes.  Moreover, the same is not notarized.  Annexure 3 of Appeal file. 

2.     In support of the Enclosure 5 of the Affidavit i.e. the permission of the authority to use the institution had submitted the copy of resolution of the society (Pg 106).

3.     As per the sale deed dated 20th Oct 2008, the land is agricultural.  As per the Appeal file, the institution had submitted a certificate issued by the Aanchal Adhikari stating that the office has no objection for using the land for educational purposes but no document has been submitted to show that the land has been converted from Agricultural to Educational.

This institution was refused recognition by ERC in its 107th meeting held on 5th –8th May 2010 on the following grounds: -

 

1.     FDR not in the name of the institution.

2.     In the application form, the website address and PAN No of the Society is not mentioned.

3.     As per the Gift Deed registered on 26th October 2009, the gifted land is a residential vacant land. 

4.      Notarized copy of Conversion / Change of Land Use Certificate from the competent authority not submitted.  In support of Change of Land Use & Enclosure 5 of the Affidavit, the institution had submitted a Memo dated 29th October 2009 issued by the Circle officer stating that the land can be used for educational purposes and notarized on 19th Jan 2010 which is after the date of application.

5.     The building plan has been approved by the Sarpanch of the village on 20th Jan 2010 i.e. after the last date of submission of application..

6.     Non encumbrance Certificate issued on 14.01.2010 after the date of submission of application.

7.     The duly filled in Affidavit complete in all respects has been sworn on 4th Feb 2010 i.e. after the last date of submission of application.

 

The institution preferred an Appeal and the Appellate Authority vide order No. 89-566/2010-Appeal/ A23745 dated 31.08.2010 has been remanded back the case to ERC for further processing on merit.

 

On Scrutiny of the application submitted by the institution, the following observations are noted :-

 

1.     The document purported to be CLU submitted by the institution and accepted by the Appellate Authority has been notarized on 19th Jan 2010, which is not acceptable as per NCTE Regulations and also clarification issued by NCTE-HQrs vide letter dated 2nd December 2009.

2.     The duly approved building plan has been submitted by the institution on 20th Jan 2010.  In the appeal, the institution has stated that it has got the drawing approved by the Sarpanch on 26th Oct 09 and also submitted the drawing alongwith the Appeal (Pg 34 of Appeal file).  The same is a tampered with reference to another document at pg 35 in the appeal file.

3.     In the Affidavit dated 29th Oct 2009 the institution has not mentioned the details about enclosure 5 of the Affidavit, whereas in the another affidavit sworn on 4th Feb 2010 the details have been filled in.  Hence, the affidavit sworn on 29th Oct 09 is incomplete and not acceptable and the another complete affidavit has been sworn on 4th Feb 2010 i.e. after the last date of submission of application, hence not acceptable.

4.     The non-encumbrance certificate has been issued in the name of Individual.  No mutation/land possession certificate has been submitted.

5.     The document in support of CLU at pg 189 of file & 32 of Memorandum of Appeal is notarized on 19th Jan 2010.  Hence, notarized CLU as per 7 (1-A) was not ready at the time of submission of application.

6.     Building plan submitted in Memorandum of Appeal is tampered (Pg 34 & 35).

This institution was refused recognition by ERC in its 107th meeting held on 5th –8th May 2010 on the following grounds: -

 

1.     FDR not in the name of the institution.

2.     The institution had sworn the Affidavit on 26th October 2009 wherein the date of permission of the competent authority for running education institution as per Encl 5 of the affidavit has been mentioned as 27.10.2009; hence, the said Affidavit is not acceptable.

3.     As per the Land Title Certificate, application form building completion certificate, the institution has earmarked only 797.42 sqm of built up area for the proposed teacher education course, which is less than required as per NCTE norms.

4.     Notarized CLU not submitted.  In support of Land Use Certificate, the institution had submitted a Land Use Certificate issued by the Aanchal Adhikari on 9th Feb 2010 stating that the land was agricultural but now the land will be fully used for the teacher training college, which is not notarized.

 

The institution preferred an Appeal and the Appellate Authority vide order No. 89-602/2010-Appeal/ A23531 dated 27.08.2010 has been remanded back the case to ERC for further processing on merit.

 

On Scrutiny of the application submitted by the institution, the following observations are noted :-

 

1.      The Affidavit sworn by the institution on 26th Oct 09 makes a mention of the permission of the competent authority as per Encl 5 of affidavit as 27th Oct 09.  The said affidavit is not acceptable as to how can the deponent sworn the affidavit prior to the issue of approval letter and also state that the said document is enclosed with the Affidavit.  The Appellate authority has remanded the case back to ERC on the ground that the said ground was not reflected in the Deficiency Letter.  As per NCTE-HQrs letter dated 2nd Dec 09, the deficiency letter was to be issued only for the missing documents.  The Committee may please see.

2.      The document purported to be CLU submitted by the institution has been notarized on 19th Feb 2010 i.e. after the date of submission of application.  The same cannot be accepted as the Appellate Authority vide its various orders had not accepted any document which has been issued / notarized after the last date of submission of application.   The same can also be verified by the Order No. F.No.89-636/2010-Appeal dated 15th Seb 2010 & F.No. 89-607/2010-Appeal dated 27th Aug 2010 placed in the file.

As per the appeal order the reply of the institution submitted on 19.04.2010 and the application submitted by the institution is examined and observed that the institution is still deficient with the following documents as per the para 7(1) of the regulation 2009:

 

1.             Certified copy of the registered land documents by the competent authority not submitted.

2.             Notarized copy of Change of Land Use Certificate not issued by the competent authority.

 

In addition to the above the following deficiency is observed:

3.             Building completion certificate does not show the plot no., khata no., total area & built up area from competent civil authority

4.             Certificate of Registration of Society/ trust (or a certificate from the Registering Authority clearly indicating provisions of act/ law under which the trust has been registered) not submitted.

5.             As per the building plan submitted by the institution the total area is 28338.29 sq.mtr where as in the affidavit the total area is mentioned as 5600 sq.mtr which do not tally.

6.             As per the site plan  submitted by the institution at pg.66 the land is handed over possession to the Durgapur Social & Education Trust for setting up a Law & F.D. college the same thing is also mentioned in the possession certificate submitted by the institution which is at pg.67

7.             The FDRs of Rs.5.00 lacs and Rs.3.00 lacs submitted by the institution was returned to the institution along with the rejection order.

On careful perusal, observation and consideration of the proposal of the institution along with the original file, all documents submitted by the institution, office observation & remarks, related clarifications/ guidelines received from the NCTE Hqrs., the NCTE Act., Rules, Regulations 2009 stipulated by the NCTE, norms and standards, the ERC decided as follows :-

 

Status of the land from the proposed college as it clear from the maps having many plots. A certificate to be obtained from the competent authority of the area regarding land and other identified deficiencies to be sought before placing to ERC.

 

Hence, Clarification be issued to the institution before refusing recognition for B.Ed. course on account of deficiencies, observations & remarks of ERC office.  The institution is to submit written representation within 30 days of issue of the notice.

No reply received in response to ERC deficiency letter dtd. 22.12.2009. The same deficiency exists as per the refusal letter dtd. 15.05.2010.

 

1.      The trust of the institution is already recognized for D.Ed. course for the institute namely Gopsai Avindanan Sangha PTTI. Now the institution is again applied for granted of recognition for D.Ed. course in the name of College of Teacher Education, Durabila. However, it is pertinent to mention here that the address of both the institution is same but the difference is in name.

2.      Notarized copy of conversion/change of Land use certificate from the competent authority not submitted.

3.      Date of registration is not given in the affidavit. The institution also not submitted enclosure as per column 5 of the affidavit.

4.      Total area not mentioned in the approved building plan.

5.      Built up area mentioned in the building plan do not tally with the affidavit.

6.      Total area and built up area not mentioned in the building completion certificate.

7.      Building completion certificate mentioning the total area, and built up area not from the competent civil authority.

 

8.      Original FDR of Rs.5.00 lacs and Rs.3.00 lacs towards endowment fund and reserve fund as the FDRs were returned to the institution after refusal of application.

1.             The Appellate authority vide order dated 15th Sept 10 had stated that the land documents are in the name of of Abul Kalam Minority Teacher Training College B.Ed, Kathari West, Distt  Champaran, Bihar through Secretary Mr. Md. Hafizur Rahman, whereas as per the certified copy of land documents available in file (Pg 59), the land documents are in the name of Abul Kalam Minority Teacher Training College B.Ed, Kathari West, Distt  Champaran, Bihar Secretary Hafizur Rahman.  As per the decision of Appellate Authority in various orders and the precedence being followed by ERC, these type of land documents are considered in the name of individual.  One such order No. F.No. 89-705/2010-Appeal dated 15th Sept 2010 is placed in the file for perusal of ERC.  Moreover, from the legal opinion given by Sh. Anwar Alam, Advocate submitted by the institution (Pg 49), the Advocate had also clearly stated that Sh. Hafizur Rahman is the actual owner of the landed property.

2.             Further, the Non-Encumbrance certificate is also issued in the name of Individual.

3.             The Appellate Authority itself in its order (para 3) had stated that the construction of ground floor was completed on 25.10.09.   Moreover, as per the application form (Pg 74), Building completion Certificate (Pg 45), the building was complete as on 25th October 2009, whereas the land documents registered on 27th Oct 09 has no mention of the constructed building, not even the ground floor, as has been observed by the Appellate Authority.

4.             The Appellate Authority in its order dated 15th Sept 2010 had observed that the institution had got the building plan approved by the competent authority after the completion of building.  The Building plan for the proposed college submitted by the institution has been approved on 9th Feb 2010 ie. after the date of submission of application, which is not acceptable as per NCTE Regulations 2009.  Moreover, the Appellate Authority also in various orders had reiterated the same.  One such order No. F.No. 89-620/2010-Appeal dated 15th Sept 2010 is placed in the file for perusal of ERC.

5.             The institution had not submitted the Change of Land Use issued by the competent authority.  In support of the same, the institution had submitted a certificate issued by the Junior Engineer, Gramin Vikas Vibhag issued on 13th Feb 2010 and notarized on 18th Feb 2010 (Pg 91).  The same is not acceptable as per NCTE Regulations 2009 as the same has been issued and notarized after date of application.

The institution still deficient for the following points:

 

1.           Certified copy of registered land documents not submitted.  Even in the photocopy of land documents submitted, the photocopy of back portion of the land documents with the seal and stamp of registering / revenue authorities not submitted.

2.           Notarised CLU not submitted.  In lieu of Change of Land Use, the institution had submitted a certificate dated 6th Oct 2009 issued by the Circle Officer stating that the building constructed is being used for educational purposes, which is not notarized (Pg 159/c).

3.           The Building plan has been approved by Junior Engineer (Civil), B.C.D. Ramgarh Block, Jharkhand.  (Pg 18).  The Committee may please see.

4.           Non-encumbrance certificate has been issued on 16.06.2010 i.e. after the date of submission of application.

5.           Further, in response to the reference sent to the Commissioner cum Secretary, Primary, Secondary and Higher Education, Govt of Jharkhand, the Director, Primary Education vide its letter dated 29th July 2010 received in this office on 21st Sept 10 had asked NCTE that the proposal for B.P.Ed course is not being dealt by their department.  In view of the above, the matter is submitted for further directions / guidance in the matter by ERC.

Observations of the ERC Office

 

Decision of the Committee

 

The institution was issued Refusal Order by ERC office vide letter No. ERC/7-111.4.4/2010/5090 dated 24th September 2010 as per the decision of ERC in 111th meeting held on 16th-17th September 2010 on the following grounds :-

 

1.     The institution had stated that at the time of inspection only outside plaster of two rooms was incomplete due to excessive heat outside which after rainfall now stands completed, however, no documentary proof has been submitted to this effect.  As per NCTE Regulations, the building has to be complete in the form of permanent structure at the time of inspection, whereas the institution itself has agreed that the building was under construction at the time of inspection.

2.     The institution had stated that it had added more apparatus, instruments, equipments in the Science, Psychology and ET Lab, 

3.     The institution has stated that they are having 3750 books in the library, whereas as per the VT Report, the VT Members have stated that the institution is having 1504 books.

4.     In reply to deficiency at Sr. No. vi, the institution had stated that the size of multipurpose hall has been extended to 2040 sq.ft, but no certificate / documentary proof has been submitted to the said effect.

5.     With regard to approval of the building construction for B.Ed college in the leased building, the institution had submitted a certificate from AGM (L&E), SAIL, Bokaro stating that the request of the institution to start job oriented courses in addition to the school level course has been examined and it can be acceded to.

6.     The building plan submitted by the institution was approved for the purpose of school.  The institution had submitted a different building plan alongwith the reply dated 5th Aug 2010, which is not approved by the competent authority.

7.     As per the land documents submitted by the institution, the land is allotted on lease basis by the Steel Authority of India Ltd for running a High School.  As per the requirement of the Regulations 2007, the land must be in the name of the institution / society.

8.     As per the Appeal order, the institution must obtain NOC from SAIL, Bokaro (However, NOC is not sufficient as per Regulations, rather the land must be in the name of the institution)

9.     The institution has submitted a letter from SAIL, Bokaro which cannot be treated as NOC and it does not fulfill the requirement as directed by the Appellate Authority.

10.  The institution has not submitted CLU from the competent authority.

11.  Further, on perusal of file, it is seen that the FDRs towards EF & RF were returned to the institution, which has not since been submitted by the institution.

12.  Hence, the Committee decided that the facts of the case was deeply observed in respect of lease land, the comments of Director of Education, Government of Jharkhand which are negative and other   deficiencies with regard to infrastructural and instructional facilities, the Refusal order u/s 14 (3) (b) may be issued on the institution for B.Ed course.

 

The institution vide letter dated 24th Sept 2010 received in this office on 28th Sept 2010 i.e. after the issue of Refusal Order had submitted a representation and requested for grant of recognition of B.Ed course.  The institution had submitted the following documents :-

 

1.     Letter from SAIL, Bokaro

2.     Photographs of the building

3.     Certificate from chartered engineer

4.     Copy of accession register

5.     List of instructional facilities in the laboratory

6.     FDRs towards Endowment and Reserve Fund

 

On careful perusal, observation and consideration of the proposal of the institution along with the original file, all documents submitted by the institution, office observation & remarks, related clarifications/ guidelines received from the NCTE Hqrs., the NCTE Act., Rules, Regulations 2009 stipulated by the NCTE, norms and standards, the ERC noted that the ERC in its 111th meeting decided to issue orders of Refusal and subsequently a letter was sent on 24th Sept 10 u/s 14 (3) (b).  The reply is still awaited, the matter be placed in the next meeting on having careful examination for review.

On careful perusal, observation and consideration of the proposal of the Government along with the original file, office observation & remarks, related clarifications/ guidelines received from the NCTE Hqrs., the NCTE Act., Rules, Regulations 2009 stipulated by the NCTE, norms and standards, the ERC noted that in the letter No. F.ERC/06-2/WB/2010/3878 dated 08th May 2010 of the ERC on page 2, para (a) may be read as :-

 

“The Bridge Course is restricted to the PTTI trainees who have already completed one year PTTI course and possess 10+2 with a minimum of 50% marks”.

General Decision of the Committee

Letter No.  49-6/2010/NCTE(N&S)/ A24458 dated 15th September 2010 received from NCTE-HQrs.

 

The NCTE Hqrs. vide letter No. 49-6/ 2010/ NCTE(N&S)/ A24458 dated 15th September 2010 had forwarded the report of the Review Committee of the Ministry on the working of NRC (report not received along with the letter at ERC) and directed Regional Directors to take necessary measures to improve the functioning of the Regional Committees in the light of the following:

 

i.     The Regional Director should verify the correctness of the facts before signing any note and letter particularly the letter of deficiency issued to the applicant institutions.

ii.    The Regional Directors have to ensure that no step in the recognition process is overlooked or dealt with unsatisfactorily.

iii.   Necessary action should be taken to ensure proper numbering of files and note sheets and to maintain up-to-date and complete record of all applications and other documents in the Regional Office systematically.

iv.   As per the Regulations, the Visiting Team Report should be placed on the website of the Regional Committee after its consideration by the Regional Committee.

v.    The deficiency letter should clearly specify the exact nature of the deficiency.

vi.   The refusal/ withdrawal order should indicate in very specific terms the deficiencies that have resulted in refusal/ withdrawal of recognition.

vii.  In all those cases where application has to be refused by the Regional Committees, before passing any order of Refusal of application, the Regional Committee will essentially issue a Show Cause Notice to the institution and giving it an opportunity to explain its position.

The NCTE Hqrs. had also directed that the compliance report in respect of the above points be sent to NCTE Hqrs.

 

On careful perusal, observation and consideration of the proposal of the institution along with the original file, all documents submitted by the institution, related clarifications / guidelines received from the NCTE Hqrs., the NCTE Act, Rules, Regulations 2009 stipulated by the NCTE, norms and standards, the Committee decided the following :-

 

General decision

 

The ERC while considering the cases of different institutions for the process of recognition / refusal it was observed.

 

i)              There are institutions which made efforts to fulfill the required norms of land and other infrastructure but having a marginal short in the size of M.P. Hall less than 2000 sq.ft. even if the built up area is more than the required size i.e. 1500 sq mtrs.

ii)             The ERC also observed that the DIETs and Govt. institutions supported under centrally sponsored scheme of Teacher Education though the institutions are very old with having adequate land much more than the required norms having a shortage of built-up area without the provision of Multi Purpose Hall in the existing infrastructure. The Committee is of the view that such Govt.-Institutions where sufficient scope for such expansion feasible be given relaxation and this should also be approved to N.E.R institutions where natural calamities and earthquakes are the casual phenomena.

 

iii)            The ERC while considering few a Govt. institutions where process of filling up the vacant posts of teachers are going on, be given opportunity for early compliance instead of inspection u/s 17.

 

The ERC recommends relaxation by the Chairperson NCTE   (I) and (II) above under the clause 12 of the Regulation 2009 and directions on (iii) if any.

 

Decision on para (1)

 

i)             The Regional Director, ERC, please ensure efforts for the availability of the Report of the Review Committee of NRC to all members.

ii)            Regional Director can not see the correctness of ERC decision. Above direction are not within the provisions of the regulation 1996.

iii)           No comment on Para(II).

iv)           No comment on the direction to R.D. on Para(iii) but to ensure the availability of all applications received, accepted, rejected to the Members for 2011-12 and strictly adhere to the rules and in case of confusion, clarification be sought from the NCTE, HQ

v)            The compliance of ERC decision to be ensured and if any contravention is noticed to be placed before the ERC in next meeting.

vi)           Decision on Refusal / Recognition to be issued in the right spirit in speaking order form.

vii)          The NCTE HQ. may look to the above and issue directions for follow up action with regard to the submission of application for 2011-12, keeping 7(1A) Clause in mind.

viii)         The R.D. is also advised to ensure the directions given and strictly adhere to the rules for 2011-12 and incase of any confusion, clear directions from the HQ be sought.

                           

 

The next date of meeting may be decided by the Regional Director in consultation with the Chairperson-ERC.
