PROCEEDINGS OF 115th MEETING OF EASTERN REGIONAL COMMITTEE HELD ON 22nd - 24th February 2011

                    The 115th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was

       held on February 22-24, 2011 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar.

 

                    In pursuance of the Gazette Notification No.22 dated 07.02.2011, ERC has been terminated under Section 21(2)(a)

       of NCTE Act, 1993 and the powers and duties on behalf of the Eastern Regional Committee are being exercised and

       performed under Section 21(2)(b) by Prof. Manmatha Kundu, former Director, ELTI and Academy of Tribal languages and

       Culture, Government of Orissa.

            This institution applied for B.Ed course on 23rd October 2009.  The deficiency letter was issued on 23rd January 2010, while the letter to the State Govt giving its recommendation was sent on 23rd Jan 2010 followed by a reminder on 31st March 2010.  The reply dated 28.05.2010 from the State Govt was received.  Since the letter of deficiency was not received by the institution, and therefore, in this case, like many other institutions, the reply was received on the basis of the deficiency letter hosted on the website of ERC.  The reply dated 4th May 2010 was received in ERC office on 10th May 2010.  Meanwhile, the ERC in its 107th meeting held on 5th-8th May 2010 decided to constitute the VT for this institution.  The inspection of the institution was conducted on 7th July 2010.  The VT report was received on 14th July 2010.  A Show Cause Notice to the institution was issued on 25th Sept 2010 after considering the inspection report.  The ERC after considering the reply to Show Cause Notice decided to issue Letter of Intent under para 7 (9) of NCTE Regulations 2009 in its 114th meeting held on 19th-21st Dec 2010.  The decision was taken apparently on the ground that deficiencies pointed out by the VT have been met by the institution.  However, the ERC office pointed out a large number of discrepancies to point out that the requirement of NCTE norms have not been met in this case and therefore, issue of 7 (9) was not in order.  The matter was therefore, placed before the ERC again for consideration.  The entire case file has been reviewed.  The observations of the ERC office has been considered  and ERC decided as under -

  Since the decision to conduct the inspection of the institution was taken by the ERC before the receipt of the reply of the institution to the letter of deficiency dated 23rd Jan 2010, a visiting team be sent again to  verify the veracity of the reply to the Deficiency Letter.

Deo Nagina Welfare and Charitable Trust, Vill- Makundganj, Po- Babhanway, City- Hazaribagh, Dist- Hazaribagh, Jharkhand – 825301 (B.Ed.) Private) (Vinoba Bhave University) Code No. ERCAPP226

B.Ed.

The application of the institution for B.Ed. course was received on 30.10.2009.  The letter to the State Government seeking recommendation was issued on 22.12.2009.    The reply of the institution to the deficiency letter was received on 13.01.2010.  Thereafter, Letter of Consent for inspection was issued on 25.06.2010 and the inspection of the institution was conducted on 09.07.2010.  The State Govt. did not recommend opening of this institution in the district Hazaribagh on the consideration that the district had already four B.Ed. colleges whereas it needed only three B.Ed. colleges.  This reply is, however, not consistent with the findings of the Demand and Supply Study conducted by NCTE Hqrs. which continues to project shortage of trained Secondary School teachers in the State of Jharkhand.  The institution has requisite lab., built-up area and submitted building completion certificate. However, the show cause notice dated 14.10.2010 listed 14 deficiencies which were based on the report of the visiting team and inter alia included then following:- 

(i)        Lack of adequate built-up area and negative recommendation of the State Government.

(ii)      The main deficiency pointed out in the show cause notice was related to Language Learning Lab., ET Lab., size of the Class-room, size of the Multipurpose Hall, discrepancies in the size of various rooms, labs, etc in the building plan and as mentioned in the VT report.

2.      The representation on the show cause notice dated 14.10.2010 was considered by the Regional Committee in its 114th meeting which decided to issue Letter of Intent under Clause 7(9) of NCTE Regulations 2009.

3.          The office of the Regional Director, ERC found that the decision was not in order and was in contravention to NCTE Norms and Regulations primarily on the ground that the reply to the show cause notice was not comprehensive enough to cover all the points in the show cause notice and therefore, the matter was presented before the ERC for a review of the earlier decision taken by the ERC.

4.       The entire case file of the institution was scrutinized, the CD of the institution taken at the time of the inspection along with the reply of the institution to the show cause notice was considered and following observations were made:-

(i)      The show cause notice did not reply to the observations of the most of the crucial observations of the VT report that there was no Language Learning Lab in the institution, no internet facility in the ET lab.  The class-room size was 480 sq.ft. instead of 500 sq.ft. The size of the Multipurpose Hall was 720 sq.ft. whereas the requirement as per NCTE norms is 2000 sq.ft.

5.      Perusal of the CD clearly shows that the institution’s infrastructure has not at all been developed.  The furniture kept in the class-room comprised of long tables and benches without back support.  Moreover, the furniture was meant for children and not for a B.Ed. college.  The institution has not developed its Science Lab at all.  There was no experimental table with associated water arrangement and drainage.  The equipments was simply displayed on removable table at the time of inspection.  Also the equipments and apparatus were not relevant to the requirement of B.Ed. college, and were  brought from some Chemistry lab of an Intermediate college.

6.        It is thus apparent that ERC should not have decided to issue Letter of Intent under Clause 7(9) of NCTE Regulations 2009 and should have refused the recognition to the Institution.  As such, ERC now decided to refuse the recognition to the above institution u/s 14(3)(b) of NCTE Act, 1993.

Katihar Teachers Training College, Vill-Sirsa, PO-Dalan, Dist.- Katihar, Bihar – 854105, (B.Ed) (Private) (B.N. Mandal University) Code No.ERCAPP296

B.Ed.

The application of the institution for B.Ed. course was received on 30.10.2009.  A letter to the State Govt. was sent on 22.12.2009 of which no reply was received despite reminder dated 31.03.2010.  The deficiency letter was issued on 22.12.2009.  The reply of the institution dated 15.02.2010 was considered by ERC in its 107th meeting held on 5-8 May, 2010.  It was decided to issue refusal/ rejection order to the institution. 

2.      The application of the institution was rejected vide order dated 17.05.2010 for the reasons recorded in the letter of deficiency after considering its reply.  The institution went in appeal and the Appellate Authority  remanded back the case to the ERC for further processing on merit.  Consequently ERC in its 112th meeting decided to issue show cause notice to the institution.  The points of the show cause notice were the same as in the original letter of deficiency.  The written representation of the institution dated 18.11.2010 was considered by the ERC in its 114th meeting held on 19-21 December, 2010 wherein it was decided that the visiting team comprising of two experts may be sent.  Despite the decision of the ERC, the office of the Regional Director, ERC did not send the visiting team for inspection, and continued to insist that the reply to the show cause notice was not in order and the decision taken in 114th meeting of ERC was contrary to the NCTE Norms and Regulations. 

3.         The observations of the office are the same which were already considered by the appeal committee i.e. the CLU was available prior to the application, approved building plan was duly approved by the Mukhiya of the village, the land is in the name of the society and certified copy of the land documents is available.  As such, RD may immediately send visiting team to the institution.  The institution be informed to send back the original FDR for record.

ER-115.2.4  

Fatma Teacher’s Training College, Vill.-Dubaliya, Po.- Chandway, Dist- Ranchi, Jharkhand – 835217 (B.Ed) (Private) (Ranchi University) Code No. ERCAPP217

B.Ed.

The application of the institution for B.Ed. course was received on 30.10.2009.  Letter to the State Govt. was issued on 22.12.2009.  Letter of deficiency was issued on 22.12.2009 and after issue of letter of consent for inspection on 25.06.2010, the inspection of the institution was conducted on 08.07.2010.  The visiting team report was considered by ERC in its 111th meeting held on 16-17 September, 2010 and it was decided to issue a show cause notice on eight points.  The written representation of the institution on the show cause notice was considered by ERC in its 114th meeting held on 19-21 December, 2010, which decided to seek clarification from Secretary, Education, Govt. of Jharkhand before issue of Letter of Intent prior to recognition under Clause 7(9) of NCTE Regulations, 2009.  The office of the Regional Director, ERC, however, did not take further action and asserted that the decision of the ERC is not in accordance with the NCTE Norms and Regulations.

2.     The observations of the ERC office was carefully considered and the main observation of the office relates to land documents and its history of being on lease initially and construction of building thereon when the land was on lease basis.  However, since the land has been later registered in the name of the society/ trust and this was prior to the date of the submission of the application, the observation of the office are not valid. 

3.     The objection regarding CLU is also not valid as it is duly signed and stamped by the Anchal Adhikari, Kanke, Ranchi and was made available in file.

 4.      The observation of the office that the name of Secretary of the society is not available on the trust deed is also not relevant.

5.       Regarding negative recommendation of the State Govt., the ERC has taken a specific view that there is a  shortage of the teachers training institutions in the State of Jharkhand as revealed in the Demand and Supply Estimates of School Teachers and Teacher Educators (2007-08 – 2016-17) prepared by the NCTE Hqrs. with data from the State Govt. itself.  The general recommendation of the institution not to further grant recognition to teachers training institution in the State was therefore not acceptable at  present..  As such, the RD, ERC should  immediately issue the Letter of Intent prior to recognition under Clause 7(9) of NCTE Regulations, 2009.

ER-115.2.5  

Jasidih B.Ed. College, Vill/Town – Jasidih, Po- Jasidih, Dist- Deogarh, Jharkhand – 814142 (B.Ed) (Private) (Sidho Kanhu Murmur University) Code No. ERCAPP58

 

 

B.Ed.

The application of the institution was received on 22.10.2009. Letter to the State Govt. was sent on 24.11.2009 with reminder on 24.03.2010 and a negative recommendation from the State Govt. was received.  The letter of deficiencies was issued on 22.12.2009.  The reply of the institution on the deficiency letter was considered by ERC and inspection of the institution was conducted on 5.07.2010.  The visiting team report was considered by ERC in its 111th meeting held on 16-17 September, 2010, which decided to issue show cause notice on sixteen points.  The written representation of the institution dated 09.10.2010 was considered by ERC in its 114th meeting held on 19th-21st Dec 2010 which decided to issue Letter of Intent prior to recognition under Clause 7(9) of NCTE Regulations, 2009.

     The office of the Regional Director, ERC, however, felt that this decision was contrary to regulations of the NCTE and therefore, the Letter of Intent prior to recognition was yet to be issued, hence the review.

     The Committee considered the show cause notice and reply thereon afresh with the observations of the office. It was noted that the observations were placed before the ERC in its 114th meeting and were duly considered by the ERC.  The office has not pointed out any specific objection which could be taken as  contrary to the norms of NCTE.  Reply of the Institution to the points of show cause notice related to ET lab., computer lab., Language Learning lab., addition of books in the library,  and the new CD submitted by the institution to substantiate its claims  was, however, not considered satisfactory.  The Committee made the   following observations :-

(i)     The furniture of the institution in its ET lab, computer lab and Language Learning lab is not at all satisfactory as there were no proper computer table with matching chairs, present provisions in terms of wooden planks and plastic chairs is not conducive either to the classrooms or labs.

(ii)   None of the classrooms has proper classroom furniture.  The plastic chairs kept were not considered satisfactory.  The present arrangement of long table with benches having no back support is not proper for teachers training college and needed to be replaced by proper classroom chairs.  The present furniture is meant for school children and therefore cannot be accepted.

(iii) Science lab. has not at all been built up.  The equipments/ apparatus were displayed on the removable tables and no experimental table in the lab with water arrangement and associated drainage was provided.

(iv) The library still does not have proper sitting arrangements.  Some tables and the plastic chairs were kept in the new CD is not acceptable as proper sitting arrangements for library.

(v)   Psychology lab has not been properly developed.  The equipments and tests have been kept with removable table having no facility for storage of equipments/Tests.

 

The Committee decided that show cause notice under section 14(3)(b) of the NCTE Act, 1993 be issued to the institution on the above grounds to submit a reply within 30 days.

Bhagwan Prasad Sheonath Prasad B.Ed. College,                  Vill. – Kera, Po. – Bhakharuan More, Tehsil/Town – Daudnagar,  Dist. – Aurangabad, Bihar – 824113. (B.Ed) (Private) (Magadha University) Code No. ERCAPP213

B.Ed.

The application of the institution for B.Ed. course was received on 30.10.2009.  Letter to the State Govt. was issued on 22.12.2009 of which no reply was received despite reminder issued on 26.03.2010.  Letter of deficiency was issued on 22.12.2009. The inspection of the institution was conducted on 21.11.2010 after considering the reply of the deficiency letter. The visiting team report was considered by ERC in its 114th meeting held on 19th-21st Dec 2010 and it decided to issue Letter of Intent prior to recognition under Clause 7(9) of NCTE Regulations, 2009.  The office of the Regional Director, ERC, however, felt that the decision of the ERC was not in accordance with the NCTE Norms and Regulations, hence the review.

2.  The reply of the institution to show cause notice and the CD taken at the time of inspection was considered by the ERC afresh along with the observations made by the office of the RD, ERC. 

3.   The observations of the office that the society name not mentioned in the applications, is not correct.

4.   The CLU submitted with the signature of the Anchal Adhikari contains proper reference no. and is therefore, acceptable even if it does not have an official stamp thereon.  The institution later on submitted a notarized copy of CLU as well.

5.  The FDR by the bank is also in order; a mere mention in it is that of the word  “Term Deposit Advice” does not alter its nature and is acceptable.

6.   Other observations of the office were not relevant and there is no contravention of any of the Norms and Regulations of NCTE.  The ERC decided that Letter of Intent prior to recognition under Clause 7(9) of NCTE Regulations 2009 be issued.

Teachers Training College, Bhagalpur, Vill/Po- Barari, City- Bhagalpur, Dist.- Bhagalpur, Bihar- 812003 (B.Ed) (Private) (TMBU Bhagalpur) ERCAPP227

B.Ed.

The application of the institution for B.Ed. course was received on 30.10.2009.  Letter of deficiency was issued on 22.12.2009.  Inspection of the institution was conducted on 18.11.2010.  The visiting team report was considered by ERC in its 114th meeting held on 19th-21st Dec 2010 and it was decided to issue Letter of Intent prior to recognition under Clause 7(9) of NCTE Regulations, 2009.  However, the office of RD, ERC did not issue letter and observed that the decision taken by ERC in its 114th meeting was not in accordance with the NCTE Norms and Regulations and even the decision to send the visiting team as per 111th meeting held on 16-17 September, 2010 was also contrary to the provisions to the NCTE Regulations 2009.Hence the review.

 

2.     The visiting team report, the CD and the objections  raised by the office of the RD, ERC before sending of the inspection team and thereafter has been considered and following observations were made :-

 

(i)        The main observations of the office is about the land which in this case has been allotted by Bihar Industrial Area Development Authority (BIADA) and this can be taken as land allotted by the Govt. authority and is in accordance with the NCTE Norms and Regulations. 

 

(ii)      The Change in Land Use certificate issued by the BIADA can also be accepted in lieu of CLU by Bihar Govt.  The question of mutation made in the name of the institution does not arise as the land is on lease from BIADA.

 

   (iii)  The observation about non availability of approved building plan from BIADA is also not valid as approved building plan approved by the Consultant (Technical), BIADA on 22.10.2009 is available on file.   The observation of the office on usage of word “industry or establishment of factory” is not relevant in view of the specific allotment of the land by BIADA for the teachers training college.

 

3.    As such, after due consideration of all the records, inspection report and CD, the ERC decided that the institution be asked to submit the following documents:-

 

(i)        Building completion certificate from the competent authority BIADA indicating completion of the building as per approved building plan giving details and measurement of the land and built up area.  This would be necessary as the CD indicates that outer plaster of the building and that of the campus is yet to be completed.

 

(ii)      The classroom furniture provided is not appropriate as it comprised of long table and benches without back support which is not appropriate for a B.Ed. college. 

 

(iii)    The Science lab has not been properly developed with fixed structure, experimental table with associated sink and water drainage and storage to keep equipments / apparatus.

    

 

        The Committee decided that Letter of Intent  prior to recognition under Clause 7(9) of NCTE Regulations 2009 be issued only on receipt of reply to the above points and submission of documents.

Shahid Sheikh Bhikari College of Education, Vill- Sutiyambe, Po- Pithoria, Tehsil – Kanke, Dist- Ranchi, Jharkhand, (B.Ed.) (Private) (Ranchi University) Code No. ERCAPP73

B.Ed.

The application of the institution for B.Ed. course was received on 26.10.2009. Letter to the State Govt. was issued on 24.11.2009.  Negative recommendation of the State Govt. was received.  A letter of deficiency was issued on 23.1.2010 and after consideration of reply to the letter of deficiency, the inspection of the institution was conducted on 18.06.2010.  The visiting team report was considered in 111th meeting held on 16-17 September, 2010, which decided to issue show cause notice on twelve points to the institution.  The written representation of the institution on the show cause notice dated 08.10.2010 was considered by the ERC in its 114th meeting held on 19th-21st Dec 2010.  The Committee decided to issue Letter of Intent under clause 7(9) of NCTE Regulations 2009.  The office of Regional Director, ERC however, considered that the decision of the ERC was contrary to the NCTE Norms and Regulations, Hence the review. 

 

 2.     The main contention of the office about the land of the institution is not valid as the society had the requisite land on the date of application , a certified copy of which is available on the file.

 

3.    Regarding CLU, the same has been issued by the Anchal Adhikari on 19.02.2010 although after the due date but since vide NCTE Notification dated 25.11.2010, the deficiency relating to CLU has been made as a removable deficiency and the institution has submitted the requisite certificate by the competent authority, the same can be accepted , particularly when the ERC has got the inspection conducted.

 

4.     Regarding built-up area, the observation of the office based on the total dimensions of various rooms given in the visiting team report is not relevant in the context that the building plan prepared and approved on 08.10.2008 gives a total built up area as 15450 sq.mts.  The institution submitted the reply to the letter of deficiency also as mentioned in its affidavit supported by the building completion certificate that the total built up area is 1545 sq. mts.  This building completion certificate has not been taken into cognizance by the office.  Even though this certificate is un-dated, but since it is enclosed with the affidavit it should have been taken into consideration by the office. 

 

As such, after due consideration of the visiting team report, CD taken at the time of inspection and reply to the show cause notice given by the institution, the ERC observed that the decision of ERC in 114th meeting for issue of Letter of Intent prior to recognition under Clause 7(9) of NCTE Regulations 2009 was in order and orders be issued immediately.

Trident B.Ed. College, Vill/PO-Gidha, Tehsil – Bhojpur, Town/City-ARRA, Bhojpur, Bihar-802314 (B.Ed) (Private) (Veer Kunwar Singh University, Arra, Bihar) CodeNo. ERCAPP195

B.Ed.

The application of the institution for B.Ed. course was received on 29.10.2009.  Letter to the State Govt. was issued on 29.03.2010 with reminder on 19.11.2010. Letter of deficiency was issued on 22.12.2009.  Reply of the deficiency was considered by ERC in its 111th meeting held on 16-17 September, 2010 wherein it was decided to constitute visiting team to conduct inspection of the institution.  Inspection of the institution was conducted on 03.11.2010. The ERC in its 113th meeting held on 19th – 20th November 2010 after consideration of the visiting team report, CD etc. recommended to issue Letter of Intent under clause 7(9) of NCTE Regulations 2009.  The office of RD, ERC, however,   felt that the constitution of visiting team despite continuance of deficiencies was not in order and the subsequent decision of issue of Letter of Intent under clause 7(9) was also in violation of the NCTE Norms and Regulations and hence, this review. 

 

2. The remarks of the ERC office on verification of documents submitted to the ERC in its 111th meeting held on 16-17 September, 2010 related to building plan, plinth area as per certificate issued by District Engineer, Bhojpur being 833.98 sq. mts. as against the requirement of minimum 1500 sq. mts.  These  observations were  not correct as they conveniently ignored the fact that the same certificate mentioned the total built-up area of the building as 1666.96 sq.mts and plinth area of 833.98 sq mt was for the ground floor only.. 

 

3.             Similarly, the observation of the office that the land has been allotted by BIADA  for the purpose of industry is again contrary to the fact as a categorical office order dated 20.07.2009 gives details of the land and its purpose as educational institution was available on the file and was ignored by the office. 

 

4.             The observation regarding non-approval of the building plan by the competent authority is not relevant as the building plan duly approved by the Consultant (Project Implementation), BIADA and Consultant (Technical), BIADA was already available on file.

 

5.             The observation of the office that lease deed has been executed only on 23.10.2009 and the building plan was approved on 21.10.2009 is again not relevant as the land allotment office order is dated 20.07.2009 and the institution could have got its building plan approved on the basis of the allotment office order letter.

 

6.             The observation of the office that notarized CLU not submitted and that the letter dated 17.02.2010 issued by the District Magistrate does not bear Govt. stamp is also not  relevant as the land has been allotted by BIADA for educational purposes and, therefore, CLU will not be needed.  A certificate of the D.M. is an additionality which gives full details of the land and the  likely completion of the building. 

 

7.             As such, the decision of the ERC to get the inspection of the institution done was perfectly in order,  so is the decision taken by ERC after considering visiting team report and perusing the CD taken at the time of inspection.  No observation has been made by the office of the RD, ERC from the visiting team report. 

 

       The Committee, therefore, decided that Letter of Intent prior to recognition under clause 7(9) of NCTE Regulations, 2009 be issued.

The application of the institution for B.Ed. course was received on 30.10.2009.  Letter to the State Govt. was issued on 22.12.2009 with reminder on 26.03.2010. No reply has been received so far.  Letter of  deficiency was issued on 22.12.2009.  Reply dated 18.02.2010 was considered by ERC in its 111th meeting held on 16-17 September, 2010.  The inspection of the institution was conducted on 29.11.2010. The ERC in its 114th meeting held on 19th-21st Dec 2010 decided to issue Letter of Intent prior to recognition under clause 7(9) of NCTE Regulations 2009.

 

2. The office of the RD, ERC held the view that its observations prior to the 111th ERC and prior to deciding inspection of the institution has not been properly taken into account. Despite continuance of the deficiencies, the visiting team was sent, which was not in accordance with the NCTE Norms and Regulations. Hence the review.

 

3.               ERC considered the observations of the ERC office on the deficiencies prior to  the inspection. The observations were mainly with regard to land, approval of the building plan and non- mention of the built-up area thereon and non-completion of the building  etc.  These observations were  not valid as the land is in the name of the institution, the building plan was  approved by the competent authority i.e. Junior Engineer of the Block Biharsharif ,which indicates that the total built up area 1563.34 sq.mts.  The observation of the office about non-availability of the CLU and smaller Multipurpose hall were valid, but then the institution did submit the notarized copy of CLU signed by the Circle Officer, Biharsharif which was dated 22.10.2009 meeting the deficiency.  As such, the decision of the ERC to get the inspection done was in order. 

 

4.                The office of the ERC also made its observation on the agenda which was placed before the 114th meeting of ERC after inspection.  They relate less number of titles in the library (420 instead of 1000), less number of journals (only four), non-classification of reference books, shortage of library books, non-computerization of the library, discrepancies in the size of the Multipurpose hall, less sitting capacity in the library (40 instead of 50) and conducting of L.L.B. course in the said college.  The observation about titles in the library is relevant whereas other observations are not very relevant at this stage.  Regarding size of the Multipurpose hall,the inspection team did mentioned its size as  196.894 sq.mts. which is above 2000 sq.ft.  As such, the dimension mentioned in the building plan is no more relevant.  Although the institution in its initial application mentioned that it is running L.L.B. Course; the visiting team categorically reported that the institution is not running L.L.B. course, but mentioned that it was the  ‘report of the Secretary’.

 

5.             The visiting team report also addressed, the deficiencies identified by the office and gave specific reply to each of the deficiency in its report.

 

6.              After careful consideration of the visiting team report, the ERC decided to issue show cause notice u/s 14(3)(b) of NCTE Act, 1993 to the institution on the following grounds:-

 

(i)          The library of the institution is only having 420 titles which is not as per NCTE norms.

(ii)       The size of the Multipurpose hall needs to be extended as per the undertaking given by the Secretary at the time of inspection so as to make it as per NCTE norms. 

(iii)     The institution denies that it is not running  LLB course in its premises, despite it’s mention in the original application.  A certificate from the affiliating university that it is not conducting any other course including LLB course needs to be submitted. 

 

     The Committee decided that show cause notice under section 14(3)(b) of the NCTE Act, 1993 be issued to the institution on the above grounds for a reply within 30 days.

The application of the institution for B.Ed. course was received on 30.10.2009.  Letter to the State Govt. was issued on 22.12.2009 followed by reminder on 24.03.2010. Letter of deficiency was issued on 22.12.2009.  After consideration of the reply on letter of deficiencies, ERC decided to conduct inspection in its 111th meeting held on 16-17 September, 2010.  The inspection was conducted on 20.11.2010.  The matter was subsequently considered in 114th meeting held on 19-21 Dec, 2010 wherein ERC decided to issue Letter of Intent under clause 7(9) of NCTE Regulations 2009.  The office of the RD, ERC, however, felt that the decision of the ERC in its 111th meeting to constitute visiting team was not in order as certain deficiencies pointed out in respect of this institution is continuing. Hence the review.

 

2.    The observations of the office prior to 111th meeting of the ERC related to certified copy of the land documents having been issued on 28.01.2010. This observation was made despite the fact that a certified copy of the land documents was also initially submitted along with the original application.  Why the office only ignored this certified copy and mentioned the date of the subsequent copy is not understood. 

 

3.               The ‘confirmation of deposit’ issued by the bank was not treated as original FDR by the office. However, the Sr. Manager Punjab National Bank, Gaya confirmed that these were the original FDRs. 

 

4.             On the observation regarding CLU, the institution submitted a certificate dated 16.02.2010 issued by the Sarpanch.  Generally in case of Bihar State, Change in Land Use is certified by the Anchal Adhikari, but here in this case CLU by the Sarpanch/ Mukhiya of the Gram Panchayat was accepted as proper CLU.  However, the institution subsequently submitted a certificate dated 21.07.2010 by office of the Anchal Adhikari.  This certificate mentioned that said land has been in use by Gyan Prakash College of Education and issued a mutation receipt and land possession certificate claiming that it be treated as good as a Land Use Certificate from the date of mutation i.e. 22.09.2009.The copy of this certificate was , however, not notarized.

 

5.             The observation related to non-availability of consent from schools of Practice Teaching, discrepancy in the date of the Registration of the Society at two places, non-indication of reference number on the building completion certificate issued by the Civil Engineer, PWD Gaya were not significant and only needed clarification.

 

 6.   The observation of the office that its observation prior to 111th meeting were specifically given to the visiting team members for verification and comments.  The visiting team scrutinized each of the observations of the office given to them and gave their specific reply to each of the points raised by the office and the reply was found to be in order.

 

7.             In view of the above, it was clear that the decision taken by the ERC in its 111th meeting for inspection of the institution was in order. Similarly its subsequent decision taken in 114th meeting regarding issue of Letter of Intent prior to recognition under clause 7(9) of NCTE Regulations 2009 was also in order.  The said order be issued immediately.

The institution was given recognition of 100 seats for B.Ed. course vide ERC order dated 30.08.2008 in the name of Doying Gumin College, P.O. Pasighat, East Siang District, Arunachal Pradesh from the academic session 2008-2009.

2. The institution was initially given permission in a rented building.  The said college constructed its own building in September 2008 and shifted to the new campus with the name Daying Ering College of Teacher Education. 

3.  The institution applied for changing its name and for its functioning from the new premises/ campus.  The inspection of the new campus of the institution was got conducted on 09.12.2010 and based on the report of the visiting team and after seeing the CD and other documents, the ERC in its 114th meeting held on 19-21 Dec, 2010 decided to change the premises and the name of the college as per request of the institution.  The office of the RD, ERC, however, felt that the decision is not as per NCTE Norms and Regulations and hence, the review.

4.    It is noted that the observations of the office were about non-availability of certified copy of registered land deed, notarized copy of the Change of Land Use certificate and non-availability of copy of approved building plan, building completion certificate.  These observations are conventional with reference to NCTE Regulations.  However, in view of the specific situation of the Arunachal Pradesh in regard to non-availability of land records and the procedure for allotment of the land and the ownership of land as elaborately illustrated by Shri Anima Mize, Advocate, Itanagar submitted to the visiting team ,the non-availability of certified land documents as prescribed in the NCTE Regulations should not be taken as applicable in  this case.   The adequate land having area 15210 sq.mts. is owned by the institution on which they have built up building having total built up area of 1720 sq. mts. in two storey in a plinth area of 860 sq.mts.  Similarly, the other documents like approved building plan and building completion certificate have also been submitted.  However, the institution has a Multipurpose hall with a dimension of 1292 sq. ft. instead of prescribed 2000 sq.ft.  in the NCTE norms.

     The ERC, therefore, decided to allows the change of the name of the institution shifting of the institution to its new building with the direction that the institution needs to expand the  Multipurpose hall as per NCTE Norms (2000 sq.ft.) and send a compliance certificate to this  effect.

2.   The visiting team report along with the CD has been carefully considered.  The visiting team could not complete report properly as the unruly mob intervened in the process of inspection, shouting slogan that the land does not belong to the college.  In view of the observations of visiting team that the Land Use Certificate were issued twice, the office of the RD, ERC may confirm the veracity of the Land Use Certificate dated 29.10.2009 from the issuing authority.  Moreover, this would also be necessary in view of the complaint by Sri Piyer Ali Mondal, Retd. Teacher alleging that the conversion certificate of the institute land is ‘home made’.  Moreover, the CD was taken at the time of visiting team report revealed the following deficiencies:-

 

(i)     The institution classroom are not properly furnished. The long tables and the matching benches without back support are not proper for a B.Ed. college.

(ii)   The furniture seems to be for school of smaller children.

(iii) The science lab. has not been developed as there is no attached sink to the experimental table which itself is removable.  The science lab should have fixed structure.

(iv) The institution has not developed its ICT Resource Centre including Language lab as per recommendation of the NCTE as  contained in it’s Manual ‘Organising Teaching Learning Resources in Teacher Education Institutions: A Manual for the Teacher Education Institutions and Teacher Educators’.

 

 The Committee decided that show cause notice under section 14(3)(b) of the NCTE Act, 1993 be issued to the institution on the above grounds and asked to submit a reply within 30 days. 2.   The observations of the office prior to the inspection and thereafter has been considered.  The observation regarding building plan having being approved on 06.04.2010 has been considered in the context that the institution submitted a building plan initially with the application, but changed it subsequently and submitted a revised building plan on 06.04.2010 which was in order.

 

3.                   Similarly, the land documents not being in the name of the institution is not correct as the land documents clearly mentioned the purchaser as A.Y.T. Teachers Training College, Manager, Sandip Tiwari. Regarding the CLU, the Anchal Adhikari letter dated 22.10.2009 is a clear CLU and therefore, the observation as to whether the land has been converted from residential to educational is not understood. 

 

4.                    The visiting team report along with the CD has been carefully considered and the following observations made:-

 

(i)     The furniture provided in the classroom comprises long table, benches which are meant for school children being of smaller in size and is therefore not suited for B.Ed. course.

(ii)   The furniture provided in the computer room is not appropriate as the matching chairs to the computer table has not been provided.  The present arrangement of the small size plastic stool makes the computer room totally non functional.

(iii) The lab particularly the science lab has not been properly developed with fixed structure and associated water and drainage system.

(v)   The Language lab. has not been properly developed as a part of ICT Resource Centre and as pre recommendation of the NCTE contained in it’s Manual ‘Organising Teaching Learning Resources in Teacher Education Institutions: A Manual for the Teacher Education Institutions and Teacher Educators’.

 

The Committee decided that show cause notice under section 14(3)(b) of the NCTE Act, 1993 be issued to the institution on the above grounds and asked to submit a reply within 30 days.

It is not understood  whether the girls hostel is in existence and whether the built up area of the institution includes the built up space occupied by  the hostel.  The position needs clarification.

(ii)      The classroom furniture is the school furniture and is not appropriate for a B.Ed. college.

(iii)    The institution has separate Physics, Chemistry, Biology lab, which is not as per requirement of NCTE, which recommends only  a composite  science lab. The lab. Inspected is  apparently meant for a senior secondary school which may be in the vicinity or is being run in the same premises.  A clarification in this regard would be needed with a certification from the District Education Authority that no senior secondary school is being run in the premises.

(iv)    The Psychology lab and the Language lab has not been developed as per the recommendation of the NCTE as contained in it’s Manual ‘Organising Teaching Learning Resources in Teacher Education Institutions: A Manual for the Teacher Education Institutions and Teacher Educators’.

 

    The Committee decided that show cause notice under section 14(3)(b) of the NCTE Act, 1993 be issued to the institution on the above grounds for a reply within 30 days.

2.    Prior to the decision of the ERC in its 113th meeting held on 19th – 20th November 2010, which took decision to constitute a visiting team, certain observations were made by the office and the office of RD, ERC with the assertion that these deficiencies were continuing and therefore decision to constitute the visiting team was not in order. 

 

3.                  The visiting team report along with the CD was carefully considered and the following observations made:-

 

(i)        The classroom furniture is the school furniture with long bench and is not suitable for a B.Ed. college.

(ii)      The CD taken at the time of inspection has not been properly submitted.  It has been thoroughly edited, whereas NCTE Regulations clearly provides that an unedited CD needs to be provided.  Therefore, the CD is not acceptable.

(iii)    The computer lab has not been properly developed. The computer table with the matching chair has not been provided.

(iv)    The science lab has not been developed as per NCTE recommendation as contained in its Manual ‘Organising Teaching Learning Resources in Teacher Education Institutions: A Manual for the Teacher Education Institutions and Teacher Educators’.

(v)      The science lab of the institution is the combination of Physics, Chemistry & Biology of the senior secondary school, which is not proper science lab for teachers training college

(vi)    The library is not having proper seating  capacity.

(vii)  The Language lab has not been developed as part of the ICT Resource Centre as per recommendation of the NCTE contained in its Manual mentioned in para (iv) above.

3. Letter to the State Govt. was issued on 2.06.2010 with reminder on 27.07.2010. Letter of deficiency was issued on 2.06.2009.  Inspection of the institution was conducted on 12.01.2011.

4. The observation of the office prior to the 113th meeting of the ERC are about certified copy of the land documents and notarized copy of the CLU.  Since these documents have now been submitted and the matter of these deficiencies were of removable nature, the documents were found in order. 

 

5. The visiting team report along with the CD was carefully considered and the following observations made:-

 

(i)     The building of the institution is not complete; even the building completion certificate given at the time of inspection mentioned it. The ‘building completion certificate could not be submitted at the time of inspection’.

(ii)   The certificate submitted mentioned that the construction work is going on rapidly.

2.The visiting team report along with the CD was carefully considered and the following observations made:-

(i)           The classroom furniture are not appropriate for teachers training college.

(ii)         None of the labs have been properly developed.

(iii)       The science lab has not been properly developed with fixed structure of experimental table with attached sink associated water and drainage  system

(iv)       The psychology lab has not been developed. Proper tests equipments apparatus has not been purchased.

(v)         ET lab is not properly organized.

(vi)       There is no storage space.

(vii)     The Multipurpose hall has not been properly developed, with a dais ,raised platform and public address system.

(viii)   The plastic lawn chairs are not suited for teacher training college.

(ix)       CD has not been properly prepared. Unedited CD should have been  submitted.

(x)         There are only 294 titles in the library whereas the Regulations demands 1000 books of different relevant subjects.

(xi)       Number of computers is only four which is not adequate as per NCTE norms.

 

     The Committee decided that show cause notice under section 14(3)(b) of the NCTE Act, 1993 be issued to the institution on the above grounds for a reply within 30 days.

(ii)         The institution has not appointed the lecturer in fine art/performing art on full-time basis.  The present appointment of the lecturer on music is only on part-time basis which is not as per NCTE norms.

(iii)       The lecturer and health and physical education instructor is on part-time basis which is not as per NCTE norms.

(iv)       The institution has not conveyed the approval of the affiliating university to the appointments of Principal/ Faculty .

The matter was considered by ERC in its 95th meeting held on 27-29 April, 2009  and letter to State Govt. was issued on 18.05.2009.  Letter for submission of certain documents was issued to the institution on 18.05.2009.  Recommendation from State Govt. received on 04.06.2009.  Reply of the institution was considered by ERC in its 98th meeting held on 15-16 July, 2009 and show cause notice issued to the institution on 18.07.2009. No reply to SCN submitted by the institution and the ERC in its 99th meeting held on 26-28 July, 2009 decided to refuse recognition for B.Ed. course. Refusal order was issued on 06.08.2009. The institution preferred to appeal and the Appeal Authority remanded the case to ERC vide order dated 06.11.2009 for further processing of the case for getting the institution inspected.  Letter of consent for inspection was issued to the institution on 20.11.2009.  The ERC in its 103rd meeting held on 29-31 December 2009 considered the reply of the institution and decided to send visiting team. The inspection of the institution was conducted on 04.06.2010.  The ERC in its 109th meeting held on 21-23 June 2010 considered the visiting team report and decided to issue show cause notice.  SCN under Section 14(3)(b) was issued to the institution on 06.07.2010.  Again the matter was considered by ERC in its 111th meeting held on 16-17 September, 2010, which decided clarification letter be issued to NCTE Hqrs. on certain points.  Clarification letter was issued to NCTE Hqrs. on 05.10.2010, reply of which is awaited.

 

Hence, the ERC decides to wait till the reply is received from NCTE Hqrs. RD ERC to pursue the matter with NCTE HQ for an early reply.

The Committee had no objection to the  admission of 13th candidate to the M.P.Ed.  course in Govt. College of Physical Education, Bhubaneswar,in view of the orders of the Hon’ble High Court.

 

The approval for the intake of 12 students was given by NCTE in June 15, 2001.  Since then the new Regulations of NCTE 2009 provides for an intake capacity of 40 students for one basic unit of M.P.Ed. course.  As such, Govt. College of Physical Education, Bhubaneswar is entitled to apply for one basic unit of 40 students provided it has all the essential infrastructure and faculty as prescribed in NCTE Regulations 2009 (Appendix-8).  In the absence of teaching physical education, infrastructure for one basic unit, the institution cannot be allowed to continue even for 12 seats.  As such, it is incumbent on the Govt. to provide for all the requirements, as per NCTE Norms for  one basic unit, in order to avail continuance of the M.P.Ed. course in the college. A show cause Notice be issued to the institution about its available Physical and teaching Infrastructure, for a reply within 30 days .

W.P.No.10229(W) of 2008 filed by Sachindranath Mishra-Vs-Union of India & Ors in the Hon’ble High Court at Calcutta. (F.No.ERC/05-379/2008)

The letter dated 29.12.2010 from Sachindranath Mishra, Secretary, Dr. B.R. Ambedkar College (B.Ed. Section) submitted a copy of the Court order dated 20.09.2010 passed by Hon’ble High Court of Kolkata in the Writ Petition No. 10229 (W) of 2008.  The Hon’ble Court in this order has directed NCTE to consider the proposal of the institution to shift its premises in accordance with law.  The Court further orders that the decision is required to be taken within two months of submission of the application by the institution and after taking into consideration and after taking into consideration of the facts and circumstances and also by giving an opportunity of hearing, the representations of the Petitioners, Respondents no. 10 to 15 and the Respondent University.

 

The application of Shri Mishra has been carefully considered.  He has not made the application for shifting in accordance with the provisions contained in clause 8(11) of the NCTE Regulations ,which stipulates that the application in the specified format with relevant documents is required to be submitted before the permission is  accorded for shifting ,after due inspection of the institution at the new site.  Shri Mishra may, therefore, be asked to submit all the details in the prescribed form to be sent to him by the office of the RD, ERC.  However, in view of the Court order, it has been felt necessary that pending receipt of the relevant documents and a draft of Rs.40,000/-, a visiting team be constituted to conduct the inspection of the institution at an early date.  These documents if not received before the date of the inspection, may be submitted by the institution to the inspecting team.

The institution preferred an appeal and the Appellate Authority vide order dated 24.09.2010 reversed the order of ERC with the direction to ERC to issue the letter of deficiency afresh to the institution and take further decision thereafter.  The ERC in its 113th meeting held on 19th – 20th November 2010 considered the case and as per decision of ERC fresh letter of deficiency was issued to the institution on 29.11.2010.  The reply of the institution dated 27.12.2010 was considered afresh. 

 

The ERC decided that visiting team be constituted for conduct of inspection of the institution.

The application of the institution for B.Ed. course was received on 29.10.2009.  Letter to state govt. was issued on 23.01.2010 with reminder on 31.03.2010. Letter of deficiency was issued on 29.01.2010.  The recognition to B.Ed. course was refused/rejected by ERC vide order dated 18.05.2010. The institution preferred an appeal and the Appellate authority vide order dated 17.09.2010 reversed the order of ERC with the direction to ERC for re-issuance of the deficiency letter on the applicant’s address.  The ERC in its 113th meeting held on 19th – 20th November 2010 considered the case and as per decision of ERC fresh letter of deficiency was issued to the institution on 13.12.2010.  The reply of the institution dated 06.01.2011 was considered afresh. 

 

The ERC decided and constituted a  visiting team  for conduct of inspection of the institution.
