PROCEEDINGS OF 116TH MEETING OF EASTERN REGIONAL COMMITTEE HELD ON 7th -9th MARCH, 2010

The 116th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher  Education (NCTE) was held on 7-9 March, 2011 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar.

 

In pursuance of the Gazette Notification No.22 dated 07.02.2011, ERC has been terminated under Section 21(2)(a) of NCTE Act, 1993 and the powers and duties on behalf of the Eastern Regional Committee are being exercised and performed under Section 21(2)(b) by Prof. Manmatha Kundu, former Director, ELTI and Academy of Tribal languages and Culture, Government of Orissa. Shri Hasib Ah mad former Member Secretary NCTE was appointed as the observer for this meeting vide NCTE Hqrs. letter No.F.47-7/2011/NCTE/CDN dated 7th March, 2011 issued wirh the concurrence of the Competent Authority.

    NCTE Hqrs. vide its letter F.No. 49-6/2011/NCTE/N&S dated 1st March, 2011 forwarded a copy of the report of the Review Committee that carried out the review of the ERC and analyzed  the details of 31 files and the status of the implementation of the appellate orders by the ERC.  These cases included 16 cases involving  review of the  decisions taken by the ERC, which were referred by the ERC office to the NCTE Hqrs. vide letters No.ERC/07/GEN/2010/5773 dated 23/11/2010 and ERC/07/GEN/2010/5085 dated 24-09-2010. 

 

Further, as mentioned in the aforesaid letter, the  report of the Review Committee was to  be placed before the ERC by the Regional Director to enable the ERC for taking an appropriate decision after considering the case wise report submitted by the Review Committee and records and documents on the  file of the  each case.

 

              Accordingly, the following cases referred to in the review report were considered and specific decision, as per details given below, was taken in each case.

Dhupguri College of Education, Vill- Rey Para, PO- Dhupguri, Dist- Jalpaiguri, West Bengal – 735210  (B.Ed.) (APE01148).

The Letter of Intent prior to recognition was issued in respect of the institution under Clause 7(9) of the NCTE Regulations on 8.7.2010.  The institution was required to make appointment of qualified faculty by a duly constituted selection committee and furnish requisite documents to ERC after obtaining approval of the concerned university to the appointment made by them.

2.         The ERC in its 113th meeting held on 19th – 20th November 2010 decided to refuse recognition to the institution under section 14(3)(b) of NCTE Act due to non-compliance of the conditions stipulated in Letter of Intent under clause 7(9) i.e. mainly the appointment of staff. 

3.         Meanwhile, the NCTE Hqrs. constituted a Review Committee to review the decision taken by the ERC.  At the instance of the report of the Review Committee, the case of this institution was reviewed by ERC and following observations were made:

(i)                 The institution claimed  that it advertised  the posts in daily newspaper, constituted the selection committee as per the university rules and prepared the panel of qualified faculty members.  It also claimed that despite repeated writings to the university authorities, university did not send any representative/ expert in the meeting of the selection committee and did not approve the appointed faculty, as per the requirement of the NCTE Regulations 2009.

(ii)               The institution enclosed the copies of the letter written to the Vice-Chancellor of the University of North Bengal, requesting for nomination of the expert/ representative.

In view of this, ERC felt that it was not within control of the institution to obtain approval of the university for nomination of the expert and for  the appointed faculty.  As such, refusal of recognition on this ground that they failed to submit the approval of the university was not justified.  The ERC, therefore, felt that some more time needs to be given to the institution to obtain the approval of the University for the appointment of the  faculty  and meanwhile they may submit the following documents within 60 days to the ERC:

(i)                  A copy of the advertisement issued for the recruitment of the Principal and faculty.

(ii)               Minutes of the selection committee giving full details of the members of the selection committee.

(iii)             Details of the candidates attended the interview for the post of Principal and Lecturers with a signed copy of those,who  attended the interview.

(iv)             Approval of the university / Affiliating body to the selected faculty.

Sarif B.Ed. College, Baigachhipara, Golam Rahaman Lane College Campus, Santipur, Dist- Nadia, West Bengal – 741404 (B.Ed.) (APE01156).

     The institution was given recognition for conducting a B.Ed. course on 31.08.2009.  Later on, on a complaint from the State Govt. of West Bengal and on the basis of an inspection conducted by an inspection team of the University of Kalyani, it was found that the institution was not functioning as per NCTE norms and did not have the required physical infrastructure as per the NCTE norms. It  had a total built up area of 885 sq. mtrs only.  The recognition of the institution was, therefore, withdrawn vide ERC’s order dated 1.11.2010 after following the due procedure as stipulated under section 17(1) of the NCTE Act.  Meanwhile, the institution applied for shifting of its premises to some other place about 11 kilometer away from the existing premises on the ground that it was unable to run the college in its old premises where the recognition was granted to it.  This request was apparently not considered by the ERC, which decided to withdraw the recognition after considering reply to the  show cause notice.  Since the institution submitted the processing fee of Rs.40,000/- for inspection of the new premises and ERC decided to return this amount to the institution, there appears to be no need for any review of this decision as it was established that the institution was not functioning as per NCTE norms.

Mahesh Singh B.Ed. College, Vill- Kendua, Manav Bharti School, Po- Kendui, Dist.- Gaya, Bihar- 823001 (B.Ed.) (ERCAPP161).

         The institution’s application submitted on 26th Oct 2009 was considered by ERC and deficiency letters were issued on two occasions. Whereas on the first occasion the deficiencies pointed out were about   shortage of space in the multipurpose hall, non clarity whether the five different plots were congruent to each other and the plinth area of the building was only 6260.77 sq.ft. 

 These deficiencies were considered by ERC, which decided to cause inspection of the institution. However, deficiencies were further  pointed out and they  related to  non availability of notarised CLU and building plan being in the name of individual and the certified copy of the land document being dated 27/10/2009.

 The ERC in its 111th meeting held on 16th-17th September 2010 again decided to conduct the inspection of the institution and accordingly, the readiness letter dated 25th Sept 2010 for inspection of the institution was issued.

 The case has been reviewed and it is found that the major deficiency in the document submitted by the institution related to its building plan being in the name of individual and not in the name of institution or society.  So far as other deficiencies are concerned, the plinth area of the building, as reflected in the building plan was 1758 sqm., (the area of 6260.77 sq ft) , as pointed out in the deficiency letter was the area of one floor only; of the three storeyed building. As such, the institution has the requisite built up area as per building plan submitted by the institution.  The certified copy of land documents was dated 27/10/09 but it was the date of certification and the land documents in the name of society was dated 18/11/08. As such, the observations was not relevant as the deficiency was removed by submitting a certified copy.  The institution also submitted a notarised copy of a Land Possession Certificate issued by the Circle Officer indicating the land being in the possession of Mahesh Singh B.Ed College and that it was an institutional land. As such, the ERC felt that a fresh Letter of Consent for Inspection be sent to the institution wherein they should be informed that the building plan in the name of the institution duly approved by the competent authority be submitted before the inspection is conducted as the building plan submitted by them is in the name of an individual.

Bihar College of Teacher Education, Vill- Samanpura, PO- B.V. College, Dist.- Patna, Bihar- 800014 (B.Ed.) (ERCAPP162).

The application of the institution for B.Ed. course was submitted on 26.10.2009.  The letter of deficiency was issued and after considering reply of the institution, the ERC decided to conduct an inspection of the institution.  The visiting team report dated 29.10.2010 was very positive and therefore, ERC decided in its 113th meeting held on 19-20 November, 2010 to issue the Letter of Intent prior to recognition under clause 7(9) of NCTE Regulations.  The inspection team was  specifically given the deficiencies pointed out by the office of RD, ERC and the visiting team verified and submitted its detailed report in respect of each of the deficiencies.

The major deficiencies pointed out by the office was size of the Multipurpose Hall being 900 sq.ft. as against the norms of 2000 sq.ft., the covered area being 529.53 sq.mts. only instead of 1500 sq.mts. as per norms,  the CLU which was in form of  a provisional certificate.  All the three deficiencies were not in order.  As the covered area of 529.53 sq.mts. mentioned by the office was only of one floor and the institution has the total of 1588.59 sq.mtrs in three floors.  Similarly, the smaller size of the Multipurpose Hall was only in the building plan and the subsequent amendment in the Regulations for a bigger Multipurpose Hall were carried out by the institution in its subsequent revised building plan.  Moreover, the size of the Multipurpose Hall was also verified by the visiting team.  Similarly, the initial CLU dated 11.2.2009 was subsequently notarized on 30.12.2010.  As such, no discrepancy in the earlier decision of the ERC has been found.  The institution be issued Letter of Intent prior to recognition under clause 7(9) of NCTE Regulations 2009 immediately.

Saheed Ravikant Memorial B.Ed. College, Plot No. – 945, Vill. – Dalsagar, Po./Town/Dist. – Buxar, Bihar – 802102 (B.Ed.) (ERCAPP262).

       The application of the institution for recognition to B.Ed. course was submitted on 28.10.2009.  After considering the reply of initial deficiency letter, the ERC in its 107th meeting held on 5-8 May 2010 decided to cause inspection of the institution.  The visiting team report was positive.  The visiting team also clarified the points raised by the office after issue of the deficiency letter.  The visiting team report and the CD of the institution taken at the time of inspection was perused by the Committee and it was decided that Letter of Intent prior to recognition under clause 7(9) of NCTE Regulations 2009 be issued in respect of the institution immediately.

Dr. Ambedkar PTTI, Vill- Gobindapur, PO – Juginda, Dist – Murshidabad, West Bengal – 742406 (D.Ed.) (ERCAPP331).  

        The application of the institution for recognition to D.Ed. course was received on 30.10.2009.  The ERC in its 107th meeting held on 5-8 May 2010 decided to cause the inspection of the institution after due consideration of the reply to the deficiency letter issued to the institution on 22.12.2009.  The visiting team for the institution has been constituted for early inspection of the institution.  The VT report be expedited.

Vinoba Bhave University, Vill- Hazaribagh, Po- Sindoor, Dist- Hazaribagh, Jharkhand – 825301 (M.Ed.) (APE01043).

           The institution was given recognition for M.Ed. course from the academic year 2009-2010 vide order dated 31.08.2009.  Subsequently, a complaint from the students of the university was received that only one person was taking  the classes  The university was asked for a reply which was furnished by the Registrar on 24.2.2010.  It was supported by a list of faculty appointed by university as per NCTE norms.  The NCTE has already increased the intake capacity of one unit of M.Ed. from existing 25 to 35, it will apply to the university as well.

Ramnath Radheshyam Dokania Mithila Teacher’s Training College, Vill- Chichari, Bujurg, Po- Rajnagar Town, Dist- Madhubani, Bihar (B.Ed.) (ERCAPP343).

          The application of the institution for recognition of B.Ed. course was submitted on 30.10.2009.  The ERC took a decision to sent visiting team in its 109th meeting held on 21-23 June 2010.  The decision was in order as the request of the institution not to  conduct the inspection and defer it for the next session is not as per NCTE Regulations.  As such, visiting team constituted for conduct of inspection of the institution.

Patel College of Education, St. Jehanabad, Vill-Patel Nagar, Dist-Jehanabad,             Bihar-808408 (B.Ed.) (APE00959).

        The application of the institution for recognition of B.Ed. course was received on 15.07.2008.  Consequent upon the inspection of the institution constituted on the direction of the Hon’ble High Court of Patna, a show cause notice was issued to the institution on 31.05.2010 asking them that required number of qualified faculty be appointed as per NCTE norms within a period of six months failing which the recognition shall be withdrawn.  The institution submitted a reply on 16.06.2010 giving a list of one Principal plus seven lecturers which was duly countersigned by the Registrar of Magadh University.  The institution submitted a copy of the advertisement issued in the newspaper ‘Patna Mahanagar’ dated 07.06.2010.  The teacher selected has been appointed in June 2010 barring two faculty members viz. Shri Vijay Kumar and Shri Saket Kumar who were appointed in November, 2009.  The institution has, however, not submitted the following documents:

(i)                 It is seen from the new list of the faculty that only two of the seven candidates selected earlier at the time of grant of recognition under clause 7(11) of the NCTE Regulations are included in the new list.  The circumstances under which majority of the selected candidates were not found in the institution may be explained. 

(ii)               The institution has indicated that Dr. Satish Kumar Singh appointed as Principal of the college has got 16 years of teaching experience out of which ten years of experience is in a teacher training college.  His experience certificate has not been submitted.

(iii)             Letter of the institution to the university asking for nomination of representative/ expert in the selection committee.

(iv)             The list of candidates who applied in response to the advertisement in the newspaper in June 2010.

(v)               The list of candidates who appeared in the interview for selection of Principal/ lecturers duly signed by each candidate.

(vi)             The  composition of the selection committee and the minutes of the selection committee which selected the faculty.

(vii)           Specific approval of the affiliating university to the appointments made by the institution as required under clause 7(9) of NCTE Regulations 2009.

      In case the above documents are not submitted by the institution, it will be presumed that the institution has not followed the due procedure of selection for appointment of Principal/ Lecturers in the institution and its recognition will be withdrawn. 

    The Committee decided that show cause notice under section 17(1) of the NCTE Act, 1993 be issued to the institution on the above grounds for a reply within 30 days.

ER-116.2.10

Jharkhand Teachers Training College, Rajgaria Road, Near Mahadeo Modi Mandir, Jhumri Talaiya, Koderma, Jharkhand (B.Ed.) (JH-S/N-8/2006) (ERCAPE00746).

       The institution applied for recognition of a B.Ed course on 18.11.06.  The application of the institution continued under consideration of ERC and despite complaints and reports from the State Govt that it lacked infrastructure recognition was given under clause 7 (11) of NCTE Regulations, and this was done without following the usual procedure of first issuing letter of intent prior to recognition under clause 7 (9) of the NCTE Regulations.  The ERC also decided simultaneously to initiate proceedings for withdrawal of recognition to be initiated after a year of issue of orders under clause 7 (11), in view of large number of complaints.

         Accordingly, another inspection of the institution was conducted on 4.6.10 and on finding serious deficiencies in the infrastructure, the ERC decided to withdraw the recognition of the institution under clause 17 of the NCTE Act after issue of Show Cause Notice.  The Show Cause Notice was issued on 29.6.10, which was replied by the institution vide their letter dated 19.7.2010.  However, the show cause notice could not be finally considered due to the circumstances under which the file of the institution was under scrutiny by a Review Committee.  The reply of the institution dated 19.7.10 has been considered and following observations are made :

1.       The recognition letter dated 31st Aug 2009 issued by NCTE under Clause 7 (11) of the NCTE Regulations 2007 clearly stipulated in para 3 (iii) that the institution shall admit students only after it obtained affiliation from the examining body in terms of clause 8 (12) of the NCTE(Recognition Norms & Procedure) Regulations 2007.  The institution in its reply has admitted that it applied to Vinobha Bhave University, after depositing the requisite fee but the affiliation has not yet been given by the University.  The institution admitted students, without awaiting for the affiliation from the University and therefore, violated one of the essential condition stipulated in the recognition order issued by ERC-NCTE.

2.       The institution admitted that it is running the institution in a leased building and that its own building with adequate land and built up space is still under construction.  The initial inspection on the basis of which recognition was given, was held in the building at Rajgarhiya Road, near Mahadeo Modi Mandir, Jhumri Talaiya, Koderma, Jharkhand.  This building was located at the land bearing No.s 11, 12, 13, 14 & 65.  The inspection under Section 17 conducted on 4.6.10 was however, held at Ward No. 14, old bus stand road, police station Telaiya, Distt. Koderma, Jharkhand.  However, the land documents submitted with the inspection were the same as submitted with its original inspection.  The institution also submitted a new lease deed on the new building at new address where inspection under section 17 was conducted.  This lease deed is not registered, and is therefore, not a valid document.  It is thus clear that the institution was inspected at one building whereas it got the second inspection done at some other building.  This again is a serious violation of the conditions on which recognition was granted to the institution and is apparent from the reply submitted by the institution.  The contention of the institution that it intimated the initial visiting team about the second building and the proof of this intimation given by way of a copy of the letter of the institution dated 11.12.2008 is not acceptable, as no such letter was available in the  ERC file and was produced by the institution only at the time of second inspection.

3. The institution recently intimated that it got the affiliation from the University for the academic session 2009-10 vide their letter dated 22 Dec 2010 and that the examination for the session 2009-10 has been complete.  It is thus evident that the institution got admitted the students without affiliation, which was in violation to the conditions of recognition and also it violated another important condition that it did not complete 180 days of teaching in a session.

4.  The reply of the institution that it did submit all the details about available infrastructure to the visiting team and that it has sufficient space in its library, has ET lab etc has not been found satisfactory in view of the specific observations in the VT report which has been further established by the Committee by observing the CD taken at the time of inspection.  Thus it is evident that the institution has been running the course from a place other than the place where it was originally sanctioned the course and even the new place was not having adequate space.

5.  It is evident from the perusal of the CD and photographs that the institution is functioning in a commercial area.  The ground floor of the building is occupied by shops in a busy commercial area.

6.  The institution has submitted its list of faculty.  The original list submitted on 4.7.09 to ERC, with the countersignatures of the Registrar, Vinoba Bhave University with signature dtd 2.7.09.  the second list submitted at the time of inspection on 4.6.10 contains a list of faculty.  This list has six staff as per old norms, whereas three new lecturers namely V. K. Pandey, Anand Moy and Silvakant Lakra has been added in the list.  The date of appointment of all these 3 lecturers has been indicated as 25.5.09.  The date of joining is 30.5.09. It is not understood as to why these three names were not included in the list which was countersigned by the Registrar on 2.7.09 and by Principal of the College on 25.6.09.  By this date the three new lecturers had already joined.  This clearly indicates that the institution recruited these three lecturers subsequently and submitted false documents to show their date of joining as 30.5.09.  This has been done due to the reason that these lecturers are not qualified as per NCTE Norms 2009 and their date of joining has been preceded to justify their selection.  These appointments are in complete violation of the NCTE norms. 

        The Committee therefore, came to the conclusion that the institution has been conducting the B.Ed course in serious violation of the NCTE norms and the condition of recognition stipulated in its recognition.  Hence, decided after careful consideration of the reply dated 19.7.2010 on the Show Cause Notice to withdraw the recognition of the institution under Section 17(1) of the NCTE Act, 1993.

Bhimpur Mohanananda College of Education, Vill/PO-Bhimpur, Dist-Nadia, West Bengal-741164 (B.Ed.) (ERCAPP140).

        The inspection of the institution was conducted on 10.01.2011.  The visiting team report is positive.  The Committee also perused the CD taken at the time of inspection and found that it was corroborating the observation of the visiting team. 

         The Committee, therefore, decided that Letter of Intent prior to recognition under Clause 7(9) of NCTE Regulations, 2009 be issued to the institution.

Ganauri Ramkali Teachers Training College Nawada, Bihar (B.Ed.) (ERCAPE1034)

           Consequent upon the report of the Committee constituted on the directions of the Hon’ble High Court of Patna, the institution was issued a show cause notice on 31.05.2010, for a reply within six months under section 17(1) of the NCTE Act.  The reply of the institution was to be received on the following points observed by the Committee:

1.      In the same building one portion is being used as hostel for girl students, another portion as hostel for boys and yet another portion for stay of the male faculty members of this institution.  This not only mars the academic ambience of a teacher education college, but also gives room for undesirable discipline-problems.

2.      Of the available faculty, three were found to be not qualified in terms of experience.

3.      The institution did not initiate some action to sign the new lease deed in the name of the institution by Bihar Industrial Area Development Authority.  However, no proof whatsoever has been given to substantiate their claim that the process of transfer of land in the name of the institution to continue.  They have not even indicated requisite fee required for transfer of the land/ signed any of the lease deed that has been deposited with BIADA.  The institution has also given no reply to the observations of the Committee on the non-availability of the qualified faculty in the institution and usage of the building of the institution for residential purposes in violation of the NCTE norms. 

It is thus clear that despite the show cause notice dated 31.05.2010, the institution has been continuing to run in violation of the NCTE norms and failed to give any satisfactory reply to the observations made by the Committee constituted by Hon’ble High Court of Patna.  As such, ERC decided to withdraw the recognition of the institution under section 17(1) of the NCTE Act, 1993 from the forthcoming academic session 2011-2012.

Bangiya Teachers Training College, Plot No. 1513/1946, 1514/1545, 1515, Vill – 16th Mile, PO – Gurutola, District – Malda – 732 127, West Bengal (B.Ed.) (ERCAPP56).

        After careful consideration of the visiting team report, perusal of the CD taken at the time of inspection, the Committee reiterated its earlier decision to issue Letter of Intent prior to recognition under Clause 7(9) of NCTE Regulations 2009 immediately.

Dr. Sarvepalli Radha Krishnan Teachers Training College, Vill- Doulatabad, PO – Doulatabad (Berhampore) Dist – Murshidabad, West Bengal-742302 (B.Ed.) (ERCAPP223).

       Since the Committee in its 113th meeting held on 19-20 Nov. 2010 decided to issue show cause notice under section 14(3)(b) of NCTE Act, the same may be issued to the institution immediately on the following grounds to submit a reply within 30 days:

1.      The size of the Multipurpose Hall is 1687 sq.ft. which is less than the prescribed 2000 sq.ft. as per NCTE norms.

2.      The number of computers in the institution is only six which is inadequate.  Moreover, proper computer chairs has not been provided to the existing computer table. 

3.      The institution has not developed its ICT lab as per recommendations of the NCTE as contained in its Manual ‘Organising Teaching Learning Resources in Teacher Education Institutions: A Manual for the Teacher Education Institutions and Teacher Educators’.

4.      The Multipurpose Hall has not been properly furnished.  The existing plastic chairs is not proper for the Multipurpose Hall.

5.      The institution has not developed its playground properly.

            The institution’s application for a B.Ed. course was submitted to ERC on 27.10.2008.  The institution was issued Letter of Intent prior to recognition under Clause 7(9) of NCTE Regulations 2009 on 5.7.2010.  The reply of the institution dated 23.07.2010 to the letter was considered and the ERC withdrew its letter dated 5.7.2010 issued under clause 7(9).  The entire matter has been considered again, the visiting team report and the CD taken at the time of inspection was perused again.  This was done in view of the procedure lapse of not issuing the show cause notice by ERC while withdrawing its letter issued under Clause 7(9).  The committee found that the  institution suffers from the following deficiencies:

1.      The institution has not developed the physical facilities necessary for conduct of a teacher training course.

2.      The classrooms have not been furnished properly.

3.      The labs have not been developed.

4.      The ICT lab has not been developed as per the recommendations of the NCTE as contained in its Manual ‘Organising Teaching Learning Resources in Teacher Education Institutions: A Manual for the Teacher Education Institutions and Teacher Educators’.

5.      The Science Lab has not been developed at all. The instruments were not well-arranged.  The number of instruments kept in the Science lab were inadequate and no experimental table with associated water and drainage facility was  available.

6.      The library of the institution although contains more than 3000 books but it does not possess requisite 1000 titles on Education.

    The Committee decided that show cause notice under section 14(3)(b) of the NCTE Act, 1993 be issued to the institution on the above grounds for a reply within 30 days.

Government ST School, Phulbani, Vill/Po- Phulbani, Dist- Kandhamal, Orissa – 762001

(D.El.Ed.) (ERCAPP352).

The application of the institution for recognition of D.El.Ed. course was submitted on 30.10.2009.  The deficiency letter was issued on 23.01.2010.  Subsequently, the Committee in its 109th meeting held on 21-23 June 2010 decided to refuse the recognition and in its 111th meeting held on 16-17 September, 2010 again decided to depute a visiting team.  However, since the decisions were contradictory to each other and were not as per NCTE Regulations, the matter has been considered afresh in the light of the reply of the Directorate of Teacher Education & SCERT, Orissa, Bhubaneswar dated 18.06.2010, in respect of this institution.  The following deficiencies has been noticed by ERC  on the basis of the documents submitted by the applicant.

1.       The existing building where D.El.Ed. is proposed to be conducted lacks physical infrastructure in terms of inadequate classrooms, Multipurpose Hall, absence of Science Lab, ICT lab, Library, Language lab, etc.

2.      The size of the classroom is only 31.78 sq.mts. which is less than the required dimension of 500 sq.ft.

3.      Similarly, the size of the Multipurpose Hall is only 50.6 sq.mts. as against the required dimension of 2000 sq.ft.

4.      The existing building has no library, psychology lab, ICT lab etc.

5.      The total built up area of the present completed building where the course is proposed to be started has a total space of 4440 sq.ft. as per site plan of the B.R.C. building and additional classrooms at Girls’ U.P. School, Phulbani submitted in the application.  This built up area is short of the requirement of 1500 sq.mts. as per NCTE norms.

Therefore, the Committee decided that show cause notice under section 14(3)(b) of the NCTE Act, 1993 be issued to the institution on the above grounds for a reply within 30 days.

Government ST School, Chikiti, VILL/Po- Chikiti, Dist- Ganjam, Orissa – 761010 (D.El.Ed.) (ERCAPP376).

The application of the institution for recognition of D.El.Ed. course was submitted on 31.10.2009.  Deficiency letter was issued to the institution on 22.12.2009. Subsequently, in its 109th ERC meeting held on 21-23 June 2010 decided to refuse the recognition to the institution without giving any opportunity to the institution for furnishing a reply.  Again in its 111th ERC meeting held on 16-17 September 2010, it was decided to send a visiting team in case of this institution. In the light of the observations of the Review Committee the entire case was considered again and the following observation was made:

1.      The Govt. Secondary Training School, Chikiti, Orissa already running a Teachers Certificate course of two years duration with an intake of 50 students from the session 2003-2004 vide ERC’s order No.ERC/7-35/(ER-35.5.1)/2003/1196 dated June 10, 2003.  Since this course is the same course and its nomenclature has been changed as D.El.Ed. course, the present application of  the institution was essential for increasing the intake capacity of the said course by an additional 50 seats.  As such, the application was not for new intake but is for additional intake.  It is a Govt. institution and it possesses the requisite land having a total area of 32173 sq.mts., total built up area 1840 sq.mts.  As per NCTE Regulations 2009 for an additional intake of 50 seats in a D.El.Ed. course, an additional built up area of 500 sq.mts. is required.  The institution should, therefore, have 2000 sq.mts. of the built up area as against the 1840 sq.mts. possessed by the institution at present.

 

Therefore, the Committee decided that show cause notice under section 15(3)(b) of the NCTE Act, 1993 be issued to the institution on the above ground for a reply within 30 days.

College of Teacher Education, Aizawal, Vill.- Republic Veng, Po.- Aizwal, Mizoram- 796001 (M.Ed.) (ERCAPP362).

 

The application for recognition of a M.Ed. course was received from the institution in the year 2009 and a deficiency letter was issued on 23.1.2010.  In its 109th meeting held on 21-23 June 2010, the ERC decided to refuse the recognition without issuing any show cause notice.  Subsequently, in its 111th meeting held on 16-17 September 2010, ERC again took a decision to implement the decision of 107th meeting to send the visiting team and to communicate the deficiencies to the visiting team members.

The entire matter has been considered again by the Regional Committee and following observations were made:

 

1.      The College of Teacher Education, Aizawl is already having a B.Ed. course from the year 2000 and has obtained certificate of accreditation from National Assessment and Accreditation Council which vide its certificate dated 15.6.2009 placed this institution in ‘B’ Grade.

2.      The built up area required as per NCTE norms for an institution having a combined course of B.Ed. and M.Ed. course is 2000 sq.mts. As per affidavit submitted by the institution, the total built up area earmarked for the institution is only 1266.22 sq.mts. which is less than the requirement  as  per

 

NCTE norms.

The Committee decided that show cause notice under section 15(3)(b) of the NCTE Act, 1993 be issued to the institution on the ground mentioned in para 2 above for a reply within 30 days.

Kumaresh International B.Ed. College,  Vill/Po- Rajwadih, Tehsil- Medininagar, Dist- Palamu, Jharkhand – 822101, (B.Ed.) (ERCAPP176).

The application for recognition of a B.Ed. course was submitted by the institutin on 26.10.2009. The deficiency letter was issued to the institution on 22.12.2009 to which the institution adequately replied.  However, subsequently, ERC office pointed out some  other deficiencies which inter alia included lack of built up area and submission of CLU subsequent to the date of application on the basis of which the ERC decided to refuse recognition.  It has been noted that the observations of the office on both the account were not correct. As per building plan submitted by the institution, it possesses the total built up area of 18852 sq.ft. on three different floors having 6284 sq.ft. built up area on each floor.  The office observation indicated the availability of plinth area only 6284 sq.ft. and termed it as short of NCTE norms which was not correct.  Similarly, the CLU submitted on 24.3.2010 subsequent to the issue of the deficiency letter which included the non-availability of CLU even though in the original application itself a   certificate from the Anchal Adhikari regarding  ownership of the land which was dated 9.4.2009.  This certificate issued by the Anchal Adhikari on 9.4.2009 clearly indicates the existence of the said institution on the designated land.  This certificate was sufficient to establish that the land is being used for non-agricultural purposes and it was further established by a subsequent certificate.   As such, the Committee decided to get the inspection of the institution conducted and constituted a visiting team for the purpose.

Ram Shrestha Singh College Teacher Training Wing, Vill- Chochahan, Po- Anirudha Belsar, Dist.- Muzaffarpur, Bihar- 844111  (B.Ed.) (ERCAPP358).

The application for recognition of a B.Ed. course was submitted by the institutin on 6.11.2009. The deficiency letter was issued on 22.12.2009.  ERC decided to depute the visiting team after considering the reply to the deficiency letter in its 107th meeting held on 5-8 May 2010. However, subsequently the decision was reviewed and recognition to the institution was refused without giving any opportunity to the institution to the new deficiencies pointed out by ERC office, as they were not communicated to the institution.  The new deficiencies mainly included that the land documents was not in the name of the institution and that the ERC office felt that a degree college is being run in the same premises and the institution did not submit a well-demarcated building plan to indicate the exact built up area available for the B.Ed. course.  There were few minor discrepancies pointed out in various documents. 

The entire case file was re-considered and it was noted that the land for the institution was transferred as a gift to the Governor of Bihar for the purpose of the said college and conditionality imposed was that in the event of non-functioning of the said college, the said land will revert to the original owner.  The Committee felt that this was a legal way of approving the land in the name of the institution and, therefore, can be accepted as a valid land document.  However, as a measure of abundant caution, a legal opinion may also be obtained to ascertain actual veracity of the land documents.  In the interim period, the inspection of the institution may be got conducted for a visiting team for which a VT has been constituted.

Shivam Teacher Training College, Charitravan / Dal Sagar, P.O.-Buxar, Buxar,          Bihar – 802101 (B.Ed.) (ERCAPP300).

The application for recognition of a B.Ed. course was submitted by the institutin on 29.10.2009. The deficiency letter to the institution was issued on 22.12.2009 and the Committee decided to constitute a visiting team in its 107th meeting held on 5-8 May 2010 and the Committee reversed its decision in its 109th meeting held on 21-23 June 2010 when the ERC office put up the case that the decision was not as per NCTE Regulations.  ERC again reversed the decision in 111th meeting and decided to depute the visiting team with the direction that the new deficiencies pointed out by the office may be communicated to the visiting team members for verification. 

The entire case has been re-examined in the light of the observation of the Review Committee and following observations were made:

1.      The land possessed by the institution is in two different villages i.e. Charitravan and Dalsagar.

2.      The institution has proposed the college at two khasras  i.e. 427 and 188/189.  The building plan submitted with the application proposes to construct only in Khata No. 427 and a total land available in its khata is 8783.38 sq.ft. which is much less than the required land area of 2500 sq.mtrs.

3.      The building plan map submitted by the institution is that of a residential building constructed on the plot area of 8783.38 sq.ft. which is proposed to be altered for the purpose of the starting a B.Ed. college and even in this new building plan, the third floor of the building is proposed to be used as official residence leaving the total built up area available for the proposed institution less than the required 1500 sq.mts.

Therefore, the Committee decided that show cause notice under section 14(3)(b) of the NCTE Act, 1993 be issued to the institution on the above grounds for a reply within 30 days.

Department of Education, Assam University, Durgakona, Assam (B.Sc. B.Ed. Integrate course) (APP353).

Since the application of the institution is for an integrated four year B.Sc. B.Ed. course, it comes  under the category of an innovative course.  As such, the recommendations of the Standing Committee of the NCTE Hqrs. may be obtained/awaited before a visiting team is constituted to inspect the actual availability of the infrastructure.  The Committee decided to wait for the recommendation from the NCTE Hqrs.

        The 111th meeting of the Committee held on 16th –17th September 2010 decided to issue the Letter of Intent prior to recognition under Clause 7(9) of NCTE Regulations 2009.  Later, the same was not issued.  The Committee endorsed the decision to issue the Letter of Intent prior to recognition under Clause 7(9) of NCTE Regulations 2009 immediately.

The Committee in its 111th meeting held on 16-17 September, 2010 decided to issue Letter of Intent prior to recognition under Clause 7(9) of NCTE Regulations 2009 after consideration of the visiting team report.  However, this was not in accordance with the NCTE Regulations as the total area of the Multipurpose Hall is 111.10 sq.mts. as against 2000 sq.ft. prescribed in the NCTE Regulations. As such, show cause notice under section 14(3)(b) of the NCTE Act, 1993 be issued to the institution on the above grounds for a reply within 30 days.

District Institute of Education and Training, Vill. Kurmail, Po. Kamarpara, Dist – Dakshin Dinajpur, West Bengal – 733153  (D.El.Ed.) (ERCAPP69).

The Committee in its 111th meeting held on 16-17 September, 2010 decided to issue Letter of Intent under Clause 7(9) of NCTE Regulations.  This was a conscious decision of the Committee in view of the huge building available to the institution.  However, the size of the Multipurpose Hall is 55.51 sq.mts. which is much below the NCTE Norms of 2000 sq.ft.

The institution be issued a show cause notice under section 14(3)(b) of NCTE Act to remove the deficiency regarding size of the Multipurpose Hall as mentioned above. The institution to submit a reply within 30 days.

District Institute of Education and Training, Baghmara, Bolsalgre, Po- Baghmara, South Garo Hills, Meghalaya – 794102 E.T.T.C.(D.Ed.) (APE00750).

Consequent upon the orders of the Appellate Authority dated 7.6.2010 granting three months time more to the institution for appointment of appropriate faculty as per NCTE norms, orders were issued by the ERC accordingly on 8.7.2010.  The State Govt. of Meghalaya deputed Dr.(Mrs.) E.B. Sutnga, Sr. Grade Lecturer in the said institution by way of transfer.  The institution also submitted a certificate from the North Eastern Hill University that Shri Junebirth A. Marak, Lecturer in English DIET completed the M.Ed. course from the university during session 2009-10 and was therefore eligible for appointment in the said institution as per NCTE norms.  This was found by the Committee as in order.

The institution has, however, not yet provided one lecturer each in the discipline of Fine Art/ Performing Art and Health & Physical Education as prescribed in the NCTE norms.  The institution be asked to clarify the position immediately within 30 days about appointment of the above said faculty.

Gouri Brahmanand Teachers Training College, Vill-Ballopur, Pargana-Pura,                 PO-Laheriasarai, Tehsil – Bahadurpur, Town/City-Darbhanga, Bihar – 846003 (B.Ed.) (ERCAPP53).

The application of the institution for recognition of B.Ed. course was submitted on 19.10.2009.  ERC in its 111th meeting held on 16-17 September, 2010 decided to issue Letter of Intent prior to recognition under Clause 7(9) of NCTE Regulations 2009 and further considered the matter in 113th meeting held on 19th – 20th November 2010 and reiterated its earlier decision to issue Letter of Intent under clause 7(9) with certain observation made by the ERC office.  The matter has been considered in detail again, visiting team report has been perused, the CD of the institution taken at the time of inspection has been perused and the following observations has been made:

1.      The furniture of the institution in its classroom is not appropriate and it comprises of long steel tables and benches without back support.

2.      The laboratories of the institution have not been developed at all.

(a)    In the Science Lab, the equipments/ instruments have been displayed on the removable table without any fixed structure and experimental table with associated water and drainage system. There is no storage capacity in the Science lab to keep the equipments.

(b)   Psychology Lab is also displayed tests/ instruments without having any storage capacity to store the equipments.

(c)    ICT Resource Centre has not been developed at all as per the recommendations of the NCTE as contained in its Manual ‘Organising Teaching Learning Resources in Teacher Education Institutions: A Manual for the Teacher Education Institutions and Teacher Educators’.

(d)   The Multipurpose Hall of the institution is not adequately furnished. The steel long benches and tables kept in the Hall were neither suitable for class rooms nor for the Multipurpose Hall.

(e)    The Computer lab has only six computers without appropriate furniture.  There is no computer table and the matching computer chairs.  The existing plastic chairs kept in computer room is not suitable.

Therefore, the Committee decided that show cause notice under section 14(3)(b) of the NCTE Act, 1993 be issued to the institution on the above grounds for a reply within 30 days.

        The application of the institution for recognition of B.Ed. course was submitted on 16.10.2009 and inspection of the institution was caused on 19.6.2010.  The ERC in its 111th meeting held on 16-17 September 2010 decided to issue Letter of Intent under Clause 7(9) of the NCTE Regulations 2009.  However, subsequently in its 113th meeting held on 19th – 20th November 2010, it reviewed its decision and decided to issue show cause notice on the ground that Multipurpose Hall of the institution was of a smaller size.  However, the show cause notice was yet to be issued by the office of the RD, ERC.  As such, the matter was reviewed again on the basis of the perusal of the visiting team report, CD taken at the time of inspection and the following deficiencies were observed:

1.       The size of the Multipurpose Hall of the institution is only 1500 sq.ft. which is less than the prescribed 2000 sq.ft.  Moreover, the furniture provided in the Multipurpose Hall is not adequate which comprise of long tables and plastic chairs.

2.      The institution has not adequately furnished its classroom.

3.      The laboratories of the institution have not been developed at all.

The reply of the institution dated 24.1.2011 w.r.to the show cause notice dated 3.1.2011 issued after perusal of the visiting team report and the CD taken at the time of inspection has been carefully considered and following observations made:

1)      The institution proposed to start D.Ed. course of 2 years duration in an old dilapidated building.  In their reply, the institution confirmed that they completed renovation of ground floor and the renovation of 1st floor is still going on.  The institution cannot be recognized for the course, while its building is still not fit.  At the present stage of the building, it would a isk to allow to run a course.  The institution’s present building completion certificate is also not issued by a Competent Govt. Authority and it itself says building is under renovation.

2)      The building is not as per NCTE Norms, its Labs have not been developed, there is no Multipurpose Hall of required dimension etc.

Therefore, the Committee decided to refuse recognition under section 14(3)(b) of NCTE Act,1993.

The reply of the institution dated 26.2.2011 w.r.to the letter of Intent dated 29.12.2010 issued under Clause 7(9) of the NCTE Regulations was perused and following observations made.

1)       The institution has recruited staff after giving advertisement in Newspaper.  However, it did not associate expert/ Representative of the Affiliating University in the selection process.  The list of faculty appointed has also not been approved by the university.  The institution also did not write to the  university for nominating their expert/ representative.

2)      The institution has not submitted the list of candidates, duly signed by the candidates, who appeared for the interview before the Selection Committee.

Therefore, the Committee decided that clarification be sought from the institution on the above grounds for a reply within 30 days.

The reply of the institution dated 21.12.2010 w.r.to the show cause notice dated 11.11.2010 issued after the visiting team report has been considered and following observations are made:

1.      The institution has a total built up area of 3205.19 sq. meter which includes, Academic building, Hostel Block and residential Blocks etc.  As such, the total area available for the D.El.Ed. course is only 568.58 sq. meter, which is not sufficient and is inadequate as per NCTE norms, which requires availability of 1500 sq. meter for the academic needs of the course itself.

2.      The building is not having the Multipurpose Hall of the required size i.e. 2000 sq.ft.  The reply of the institution that it cannot be provided by way of even alteration cannot be accepted.

3.      Procurement for various Laboratories and books for library have not yet been made.

      As such, the Committee decided that the institution be asked to explain its points and submit reply within 30 days.

        The office of the RD ERC raised certain issues regarding deficiencies to be pointed out     in the deficiency letter to be issued as per provisions in the NCTE Regulations.  The ERC  considered these matters and clarified the following in respect of each of the issue raised :-

(The ERC may decide about the observation/points to be made by the office, particularly when different types of CLU is being issued by the State Govts in the prescribed formats however, in many cases Certificate of general nature regarding land use instead of conversion of land are being submitted, which does not speak about change of category of land as well as provisions of the law under which the same has been issued)

The clarification in this regard has already been received from HQrs. Matter may be dealt accordingly by the RD .

Affidavit in the prescribed form on Rs. 100/- stamp paper duly attested by Oath Commissioner or Notary Public stating the precise location of the land (village, district, state etc), the total area in possession, the permission of the competent authority to use the land for educational purposes and mode of possession i.e. ownership or lease.

(The ERC may decide about the observation/points to be made by the office, particularly when the Affidavit format is not completely filled in.  The ERC may also decide as to whether the Enclosure as per para 5 of the Affidavit has to verified by the office or not.)

 

This document may be insisted upon,as per practice.

As per Clause 4 (4) of NCTE Regulations 2009, Self Financed Educational Institutions established and operated by “Not for Profit” Societies and Trusts Registered under the appropriate laws are eligible to apply for seeking recognition.  The institution is required to submit documentary proof from the competent authority certifying that it has been established as “Not for Profit”

Such certificate need not be insisted upon as this is  generally covered in the Objectives/purposes of the Society/Trust in the Memorandum of Association.

Building Completion Certificate issued by the competent Civil Authority, if submitted.

No clarification needs to be obtained in case the BCC submitted by the society is pre-dated from the date of registration of land.

Non availability of BCC need not be reflected in the letter of deficiency as the right stage for it is at the time of inspection.

The institution is required to submit a certificate from the concerned issuing/ approving authorities pertaining to competency of the authority having jurisdiction to sign the concerned land and building documents viz. CLU, Building Plan, Building Completion Certificate etc. under the law of the concerned State Government, clearly indicating the provisions / rule under which the same has been issued / approved.   

Not necessary as the situation in respect of each State is clear and has also been clarified by the NCTE HQrs.

You are advised to remove / make good of the above deficiencies within a period of 60 days, failing which your application will be treated as rejected and closed.  It may please be noted that the compliance to all the points mentioned in the deficiency letter should be submitted strictly as per NCTE norms.  Reply in piece meal will not be accepted.

It may be noted that causing inspection by visiting team for on the spot assessment of infrastructure, equipment, instructional facilities etc., shall be done only after removal of all the deficiencies2. In case any of the deficiencies stated above still remaining and not removed within 60 days time, no extension to time will be granted and any submissions received after 60 days will be treated as invalid and not entertained.

As per 7(1-B), furnishing any wrong information or concealment of facts in the application, which may have bearing on the decision making process or the decision pertaining to grant of recognition, shall result in withdrawal of recognition of the institution besides other legal action against its management; order of withdrawal of recognition shall be passed after affording reasonable opportunity of hearing through a show cause notice to the institution.

As per 7(1-B), furnishing any wrong information or concealment of facts in the application, which may have bearing on the decision making process or the decision pertaining to grant of recognition,  shall result in withdrawal of recognition granted besides other legal action that may be  initiated.
