PROCEEDINGS OF 118TH MEETING OF THE ERC-NCTE HELD ON 8TH-10TH JUNE 2011

The 118th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was reconvened on 8th to 10th June, 2011 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar.

In pursuance of the Gazette Notification No. 121 dated June 2, 2011 in exercise of powers conferred under Section 21(2)(b) of the NCTE Act, 1993 read with Clause 4 of Regulation No.F.28-14/95, dated 22nd January, 1996, Prof.(Dr.) P.C. Mahapatra has been nominated as Chairperson of the Eastern Regional Committee, Bhubaneswar. The Chairperson and Convener were present.

         The following Chairperson and Convener were present.

     The Regional Director apprised the Chairperson, ERC about the provisions of the NCTE Act, Rules & Regulations and instructions issued from time to time. With the permission of Prof.(Dr.) P.C. Mahapatra, Chairperson, Dr. Ram Kishor (Convener) presented the Agenda for perusal and suitable decision as per provisions of the NCTE Act, Rules & Regulations before the Committee

     The Eastern Regional Committee after going through the original file of institutions, reply received from the NCTE Hqrs. viz-a-viz provisions of the NCTE Act, Rules & Regulations considered all the agenda items placed before the ERC in its 118th reconvened meeting. I ER-118.1 Confirmation of Proceedings of 117th ERC meeting held on 12th-14th April 2011 at Bhubaneswar The minutes of 117th ERC meeting are confirmed with the following changes:

The ERC in respect of the following item nos. of cases placed before the 117th ERC meeting decided that the applications be summarily rejected. However keeping in view the NCTE Hqr. letter No.F.48-2/2011/NCTE/N & S (PT) A37157 dated 1st June, 2011, the ERC decides that a show cause notice be issued under clause 7(1) of NCTE Regulations, 2009 as to why their application be not summarily rejected giving the institution 30 days time.

The reply of the University was considered by ERC in its 118th meeting in light of provisions of the NCTE Act, Rules & Regulations as well as the deficiencies as pointed out by the Committee of the Experts and directions of the Hon’ble High Court, Patna in the matters.

The Committee after going through the original of file University and reply received from the University in response to Show Cause Notice viz-a-viz provisions of the NCTE Act, Rules & Regulations deliberated and considered the case in detail. The Committee decides that before taking final decision following documents are required to be submitted by the University:-

(i) As regards land & building of the University, the following documents are required:-


(a) A duly notarized copy of the demarcated building plan showing land no./plot no./khasra no., total land & built up area prepared by the approved Engineer/Architect certified by the competent govt. authority/local body authority and also the land & built up area exclusively earmarked to B.Ed. Department.

(b) A duly notarized copy of the Building Completion Certificate duly issued by the approved Engineer/Architect certified by the competent govt. authority/local body authority ( copy of the format is enclosed).

(ii) As regards appointment of the faculty by University, the following documents are required:-

(a) A list of qualified faculty duly appointed as per the provisions of the NCTE Regulations alongwith attested copies of professional qualification and experience certificate (as per the format enclosed).

(b) Details of salary components and salary paid to teachers as per clause 4 (V)(d) of NCTE Norms for B.Ed course with supporting documents i.e. statement towards payment of salary through bank alongwith a copy of a Acquittance roll of teachers showing payment of salary as per the NCTE norms.

The University shall submit the above details/clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points as per provisions of the NCTE Act, Rules & Regulations.

Hence the ERC decides to seek above details/clarification & issue Show Cause Notice to the University on the above points and direct the institution to submit the reply accompanied with an affidavit as per provisions of the NCTE Act, Rules & Regulations within 21 days.

The ERC also decides that a copy of Show Cause Notice be also endorsed to the Registrar of the University for information and necessary action.

Mithila Teacher’s Training College, Vill/PO. – Basuara, Dist – Madhubani, Bihar – 847212 (B.Ed) (Code No. APE01000)

The reply of the institution was considered by ERC in its 118th meeting in light of provisions of the NCTE Act, Rules & Regulations as well as the deficiencies as pointed out by the Committee of the Experts and directions of the Hon’ble High Court , Patna in the matters.

The Committee after going through the original file of the institution and reply received from the institution in response to Show Cause Notice viz-a-viz provisions of the NCTE Act, Rules & Regulations deliberated and considered the case in detail. The Committee decides that before taking final decision following documents are required to be submitted by the institution:-

(a) Certified copy of the land documents.

(a) A list of qualified faculty duly appointed as per the provisions of the NCTE Regulations indicating qualification, percentage of marks, teaching experience etc. countersigned by the Registrar of affiliating university alongwith an attested copy of professional qualification & experience certificate (as per the format enclosed).

(b) A letter of Permanent affiliation from the Registrar of the affiliating University.

(c) Details of salary components and salary paid to teachers as per clause 4 (V)(d) of NCTE Norms for B.Ed course with supporting documents i.e. statement towards payment of salary through bank alongwith a copy of a Acquittance roll of teachers showing payment of salary as per the NCTE norms.

The institution shall submit the above details/clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

(a) Though the University has adequate infrastructure, it has allotted inadequate space for its B.Ed. programme. The University authority is required to provide suitable earmarked accommodation for B.Ed. course as per NCTE norms.

(b) The University has engaged faculty on temporary basis through re-deployment of teachers. The institution is required to submit the latest status of permanent qualified teachers as per the NCTE norms alongwith their salary structure.

(c) The B.Ed Department does not adhere to proper academic calendar with the result that the session 2009-2010 has commenced only on 5.4.2010.

(d) It does not have academic ambience and adequate facilities in terms of ET lab, Psychology lab and Language lab and library. The University has not allotted separate multi-purpose/seminar hall for the B.Ed. programme. The University is requested to indicate the present status in the matter.

(e) It has been informed by the University vide letter dt. 16.6.2010 that the institution is running the B.Ed. programme on two shifts. The same is not permissible as per the NCTE norms. The University is to clarify the same.

Court Case: WP(C) No.2777/2010 Surendra B.Ed. Teacher Training College vs. NCTE & Others

The matter was placed before the Committee in connection with WP(C) No. 2777/ 2010 Surendra B.Ed. Teacher Training College vs. NCTE & Others keeping in view the orders dated 5.7.2010 of the Hon’ble High Court of Delhi.

As per the order of the Hon’ble High Court para 6(i), the petitioner be informed that “the petitioner to, within one week of today, inform the respondents whether the petitioner desires a fresh inspection of its Institute and records to be carried out. The counsel for the petitioner states that he has instructions to state that such an inspection may be carried out and the petitioner will bear the charges for the same.”

In view of the above the institution be asked through Registered Post (with AD) to send a Bank Draft of Rs.40,000/- towards inspection fee in favour of Member Secretary, NCTE payable at Bhubaneswar. The institution to submit reply within 21 days.

After receipt of the same, necessary appropriate steps for inspection shall be taken by the ERC, NCTE as per the directions of the Hon’ble High Court.

Court Case: WP(C) No.2777/2010 Surendra B.Ed. Teacher Training College vs. NCTE & Others Court Case: CWJC No. 10607 of 2006 Sayed Sadik Akhter & Others vs. L.N. Mithila University & Others.

The matter was placed before the Committee in connection with CWJC No. 10607 of 2006 Sayed Sadik Akhter & Others vs. L.N. Mithila University & Others. The Committee had gone through the Judgement dated 27.4.2011 given by Hon’ble High Court of Patna. As this is related to seven students (Sayed Sadik Akhter and others) of S.M. Zaheer Alam Teachers Training College, Bahera, Darbhanga(Bihar) and the L.N. Mithila University, Kameshwaranagar, Darbhanga(Bihar) regarding dispute on publication of results of those students by L.N. Mithila University, it was decided that the following visiting team experts associated with NCTE be constituted for making enquiry on the above said matter as directed by Hon’ble High Court:

(1) Prof. K.M. Lahiri, West Bengal

(2) Shri S.N. Kumar, Officer of Bihar Education Service in Govt. of Bihar

“The above team shall find out the correctness or otherwise of the allegation relating to alleged malpractice committed by the college in question S.M. Zaheer Alam Teacher’s Training College, Bahera, Darbhanga.”

All relevant records shall be sent to the aforesaid expert members for their reference. The date and time of the enquiry will be fixed by the expert members after mutual consent and information to this effect shall be intimated to the University as well instiution. However the report of the same shall be submitted to the ERC, NCTE at an early date so as to place the same before the Hon’ble High Court immediately. In the meantime, NCTE shall move Hon’ble High Court for extension of time of minimum two months.

The concerned institution and the affiliating university be informed to facilitate the Enquiry Committee in the enquiry process.

A complaint received from Dr. Kamal Prasad Bauddha, Secretary, Bihar Teacher Educators Association, CITEC Campur, 2nd Floor, ABC Building, Exhibition Road, Near Apsara Cinema, Patna-1 vide fax dt. 02.02.2011 addressed to Minister of HRD and copy marked to NCTE-HQ regarding negligence being shown to Institution of Bihar State by National Council for Teachers Education, ERC, Bhubaneswar.

Deferred for next meeting.

Allowing the trained teacher educators to seat in teacher eligibility test in Bihar State

A representation dated 6th Jan 2011 has been received through fax dt. 06.01.2011 from Raju Kumar, Buxar Jilla Prashikshit Berojgara Sangha, Bihar regarding eligibility for TET.

The matter may be referred to the Secretary, Education Department, Govt. of Bihar for suitable action.

The complaint received on 14th July 2010 from Sh. Manoj Kumar Aasthana in ERC and also forwarded by CP-NCTE-HQrs and another received on 5th Aug 2010 from Sh. Anil Kumar, Devchantidi, Dumaria, Gaya against Sh. S. N. Pathak, Advocate for ERC in Patna High Court was considered by ERC in its 112th meeting held on 30th Sept – 1st Oct 2010 wherein the ERC decided that copies of complaints be sent to Mr. Pathak endorsing a copy to NCTE-HQrs. Accordingly, as per the decision of ERC a letter dated 3rd November 2010 followed by a reminder dated 18th Jan 2011 has been sent to Sh. Pathak. No reply has been received from the Advocate till date.

Another reminder may be sent to Shri S.N. Pathak in this regard.
