PROCEEDINGS OF 125th MEETING OF THE ERC-NCTE HELD ON 12th-15th September 2011

The 125th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 12th-15th September, 2011 at Conference Hall, ERC, NCTE, 15, Nilakantha Nagar, Nayapalli, Bhubaneswar.

In pursuance of the Gazette Notification No. 121 dated June 2, 2011 in exercise of powers conferred under Section 21(2)(b) of the NCTE Act, 1993 read with Clause 4 of Regulations No.F.28-14/95, dated 22nd January, 1996, Prof.(Dr.) P. C. Mahapatra has been nominated as Chairperson of the Eastern Regional Committee, Bhubaneswar. The Chairperson and Convener were present.

           The Regional Director apprised the Chairperson, ERC about the provisions of the NCTE Act, Rules & Regulations and instructions issued from time to time. With the permission of Prof.(Dr.) P. C. Mahapatra, Chairperson, Dr. Ram Kishor (Convener) presented the Agenda for perusal and suitable decision as per provisions of the NCTE Act, Rules & Regulations before the Committee

The Eastern Regional Committee after going through the original file of institutions, reply received from the NCTE Hqrs. viz-a-viz provisions of the NCTE Act, Rules & Regulations considered all the agenda items placed before the ERC in its 125th meeting. Item-wise decisions taken are as follows:

  The Committee   deliberated and considered the case in detail. The Committee decides that before taking final decision following documents/clarifications are required to be submitted by the institution :-

  ·         As per the request of the institution, the institution be asked to submit the list of teaching staff in prescribed format alongwith all necessary documents duly countersigned by the Registrar of the Affiliating University within 21 days.

In addition to the above the institution is also required to submit the document establishing that the FDR of Endowment Fund and Reserve Fund have been converted into a joint account.

The institution shall submit the above details/ clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

  Hence the ERC decides to seek above clarification and appropriate action in compliance to Letter of Intent prior to recognition issued under Clause 7(9) of NCTE Regulations 2009 under section 14(3) (b) of the NCTE Act on the above points and direct the institution to submit the reply as per provisions of the NCTE Act, Rules & Regulations within 21 days.

The Committee   deliberated and considered the case in detail. The Committee decides that before taking final decision following documents/clarifications are required to be submitted by the institution :-

 

·         Teaching Experience of Principal in relation to Secondary Teacher Education institution is not as per NCTE norms.  The institution may also clarify with necessary documents that G. H. Raisoni National College, Raipur (Chattisgarh) is running Secondary Teacher Education course duly recognized by NCTE.

·         The institution is required to submit downloaded copy of the institution’s website with the hyper link of the same as per provisions of 7(10) of the NCTE Regulations, 2009.

In addition to the above the institution is also required to submit the document establishing that the FDR of Endowment Fund and Reserve Fund have been converted into a joint account.

The institution shall submit the above details/ clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

Hence, the Committee decides that letter of formal recognition under clause 7(11) of NCTE Regulations 2009 be issued to the institution from the academic session 2012-2013 as per the directions of the NCTE Hqr. vide letter  No. 49-6/2011/NCTE/N&S A41240 dated 11th August 2011.

The Committee   deliberated and considered the case in detail. The Committee decides that before taking final decision following documents/clarifications are required to be submitted by the institution :-

 

·         The principal is not qualified as she has no teaching experience in primary or elementary teacher education institution on regular basis. Also the institution has submitted affidavit of the Principal in the name of Ruma Ganguly whereas in her M.Ed marksheet it was written Ruma Gangopadhya and in Board of Secondary Education marksheet as Ruma Mukhopodhyay.  The institution may clarify.

·         The institution is required to submit website details as per the NCTE Regulations 2009.

·         By following the due procedure for appointment of staff as mentioned above, the institution  is required to submit  a fresh list of newly appointed qualified faculty duly appointed as per the provisions of the NCTE Regulations    indicating qualification, percentage of marks, teaching experience etc. countersigned by the  Registrar/Competent Authority of affiliating university/body alongwith  attested  copy of professional qualification & experience certificate  (as per the format enclosed)

The original file of the institution, Original VT Report, Video CD, reply submitted by the institution viz-a-viz provisions of the NCTE Act, Rules, Regulations and guidelines issued by NCTE-HQrs from time to time were considered by ERC.

 

The Committee deliberated and considered the case in detail.   The Committee found the   institution fulfils all the conditions prescribed for grant of Letter of Intent prior to recognition as prescribed by the NCTE under the NCTE Act, Rules or Regulations, including the norms and standards.  Therefore, the Committee  decides that Letter of Intent prior to recognition under Clause 7(9) of NCTE Regulations 2009 be issued asking the institution    to submit the following documents :-

 

a.       Advertisement in leading newspapers.

b.      Letter of University / Affiliating Body, nominating experts / representative for the Selection Committee.

c.       Minutes of the Selection Committee duly constituted as per the norms of the affiliating body.

d.      Approval of the University / Affiliating body to the selected faculty in prescribed format. (copy enclosed)

e.       An Affidavit on Rs.100/- stamp paper to the effect that the institution has selected staff as per NCTE/ State/ University norms. (format enclosed)

f.       An affidavit on Rs.10/- non judicial stamp paper by the individual faculty member selected by the institution. Details should be filled in by every faculty member selected (format enclosed)

g.      Educational & Professional qualification certificates of all teaching staff showing their eligibility for appointment as per the NCTE norms and experience certificate of the Principal/HOD.

h.      Account opening form duly filled in for conversion of FDRs into joint account or document establishing that the FDR of Endowment Fund and Reserve Fund have been converted into a joint account.

i.        An undertaking from the Management of the institution  as per the format enclosed.

j.        Down loaded copies of the website of the institution  with the  hyperlink of the same as per provisions of 7(10) of the NCTE Regulations, 2009.

  The institution after appointing the requisite faculty or staff as per the provisions  of sub-regulations 7 (9) and after fulfilling the conditions under sub-regulation 7 (10) shall submit its compliance  alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points within 30 days of issue of Letter of Intent prior to recognition.

  The Committee   deliberated and considered the case in detail. The Committee decides that before taking final decision following documents/clarifications are required to be submitted by the institution :-

  

·         As per the approved list submitted by the institution duly countersigned by the Secretary, West Bengal Board of Primary Education Dr. Anju Biswas, Principal had secured 54.44% marks in B.Ed and 59% marks in MA (Education).  As per NCTE Regulations 2009 and norms there under, candidate with MA (Education) with B.Ed is not qualified for the post of Principal for D.El.Ed course as Dr. Biswas is not having Degree / Diploma in Primary / Elementary Education with 55% marks. 

·         The institution is also required to clarify about the two different percentage of marks secured by Dr. Anju Biswas in different statement of particulars of teaching staff submitted by the institution viz. (i) in the statement of teaching staff submitted vide  letter dt.17.12.2010 and affidavit submitted by Shri Bimal Chandra Ghosh dt.20.10.10 the secured percentage in B.Ed. course  shows 57%  (ii) in the latest statement of teaching staff dt.17.5.11 countersigned by the Secretary, West Bengal Board of Primary Education the secured percentage in B.Ed. course was shows as 54.44%.  The institution is required to clarify the cause of difference in percentage of marks.

·         As per the statement of teaching staff   submitted by the institution, the date of birth of Dr. Anju Biswas was shown as 9.4.1949,  so taking into account the said date of birth, she is also over aged and not eligible for appointment for the post of the Principal.

·         One lecturer i.e. Mr. Pranab Kumar Roy is not qualified as per NCTE norms as he has secured less than 55% in Masters Degree in school subject.

·         By following the due procedure for appointment of newly appointed staff as mentioned above, the institution  is required to submit  a fresh list of   qualified faculty duly appointed as per the provisions of the NCTE Regulations    indicating qualification, percentage of marks, teaching experience etc. countersigned by the  Registrar/Competent Authority of affiliating university/body alongwith  attested  copy of professional qualification & experience certificate  (as per the format enclosed)

 

The institution shall submit the above details/ clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

  Hence the ERC decides to seek above clarification and appropriate action in compliance to Letter of Intent prior to recognition issued under Clause 7(9) of NCTE Regulations 2009  under section 14(3) (b) of the NCTE Act on the above points and direct the institution to submit the reply as per provisions of the NCTE Act, Rules & Regulations within 21 days.

  The Committee   deliberated and considered the case in detail. The Committee decides that before taking final decision following documents/clarifications are required to be submitted by the institution:-

 

·         The Principal appointed by the institution is over aged and not qualified as per NCTE norms as he has not secured 55 % marks in Masters Degree.

·         All the information not available in the website as per the NCTE Regulations 2009.

·         By following the due procedure for appointment of staff as mentioned above, the institution  is required to submit  a fresh list of newly appointed qualified faculty duly appointed as per the provisions of the NCTE Regulations    indicating qualification, percentage of marks, teaching experience etc. countersigned by the  Registrar/Competent Authority of affiliating university/body alongwith  attested  copy of professional qualification & experience certificate  (as per the format enclosed)

The original file of the institution, VTR, Video CD, reply submitted by the institution viz-a-viz provisions of the  NCTE Act, Rules, Regulations and guidelines  issued by NCTE-HQrs from time to time were considered by ERC. 

  The Committee   deliberated and considered the case in detail.   On perusal of the documents relating to appointment of Dr. Kulamani Tripathi, the Committee observed that the institution failed to submit any of the documents of  the concerned Govt. Authorities  which clearly states that  Dr. Tripathi was Retd. as a Professor/Head in Education. Moreover the Office Order dated 21st June 2010 issued by the State Govt. of Orissa clearly states that Dr. Tripathi was Retd. as a Reader in Education. Therefore, the contention of the institution that Dr. Tripathi is Retd. as Professor/Head in Education is not acceptable.

  However the ERC is of the opinion that a  last opportunity under section 14(3) (b) be given to the institution either to appoint a fresh Principal as per the NCTE Regulations, 2009 and the institution is required to submit the following:-

  ·         By following the due procedure for appointment of staff as mentioned above, the institution  is required to submit  a fresh list of newly appointed Principal duly appointed as per the provisions of the NCTE Regulations    indicating qualification, percentage of marks, teaching experience etc. countersigned by the  Registrar of affiliating university alongwith  attested  copy of professional qualification & experience certificate  (as per the format enclosed)

or

  the institution may submit a valid document from the concerned State Govt. authority showing  that Dr. Tripathi was Retd. as a Prof./Head in Education.

  The institution shall submit the above details/ clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

  Hence the ERC decides to seek above clarification and appropriate action in compliance to Letter of Intent prior to recognition issued under Clause 7(9) of NCTE Regulations 2009  under section 14(3) (b) of the NCTE Act on the above points and direct the institution to submit the reply as per provisions of the NCTE Act, Rules & Regulations within 21 days.

·         A building plan of the institution duly approved by the competent authority as per the NCTE Regulations 2009 alongwith the Building Completion Certificate as per the prescribed format. (format enclosed)

·         Certified copy of registered land documents as per the NCTE Regulations 2009.

·         The institution is required to appoint one lecturer in teaching of Mathematics, one in teaching of language apart from Hindi and one part time lecturer in Art Education and one in Director of Physical Education as per NCTE Regulations 2009.

·         By following the due procedure for appointment of staff as mentioned above, the institution  is required to submit  a fresh list of newly appointed qualified faculty duly appointed as per the provisions of the NCTE Regulations    indicating qualification, percentage of marks, teaching experience etc. countersigned by the  Registrar of affiliating university alongwith  attested  copy of professional qualification & experience certificate  (as per the format enclosed)

The original file of the institution, VTR, Video CD, reply submitted by the institution viz-a-viz provisions of the NCTE Act, Rules, Regulations and guidelines issued by NCTE-HQrs from time to time were considered by ERC.  The Committee also noted the  negative recommendation of the State Govt..

   The ERC reiterate its specific  view which was already taken that there is a  shortage of the teachers training institutions in the State of Jharkhand as revealed in the Demand and Supply Estimates of School Teachers and Teacher Educators (2007-08 – 2016-17) prepared by the NCTE Hqrs. with data from the State Govt. itself.  Therefore, the general recommendation of the Govt. not to further grant recognition to teachers training institution in the State is, therefore, not acceptable at present. 

  The ERC come to the conclusion that the  reply of the institution in compliance of Letter of Intent prior to recognition under clause 7(9) of NCTE Regulations 2009 is in order and found satisfactory.

  Hence, the Committee decides that letter of formal recognition under clause 7(11) of NCTE Regulations 2009 be issued to the institution from the academic session 2012-2013 as per the directions of the NCTE Hqr. vide letter  No. 49-6/2011/NCTE/N&S A41240 dated 11th August 2011.

  • The reply of the institution was considered by the Committee and observed that the institution has informed vide letter dated 23rd Aug 2011 that the matter and process of sorting out the deficiency is going on.  The institution be asked to submit the present status of the Multipurpose hall (2000 s.qft) as per the NCTE Norms.

 

The institution shall submit the above details/ clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

The Committee observed that as per the VT Report, the infrastructural   and instructional facilities are not available as per NCTE norms for conducting a  B.Ed course as per provisions of the NCTE Regulations, 2009.  Moreover, the institution was also failed to comply with the regulatory  provisions  under clause 7(5) of the  NCTE Regulations 2009 which clearly provides that “at the time of the visit of the team of experts to an institution, the institution concerned shall arrange for the inspection to be videographed in a manner that all important infrastructural and instructional facilities are videographed along with interaction with the management and the faculty, if available at the time of such visit.”   In addition the institution also failed to provide documents to the Visiting team to oversee the preparedness of the institution which is also clear violation of clause 7(14) of the NCTE Regulations, 2009.

Hence, the ERC decided to refuse the recognition to the institution for the proposed B.Ed. course   u/s 14 (3) (b)  of the NCTE Act, 1993

The Committee   deliberated and considered the case in detail.  The ERC after matching the facts from the CD submitted by the institution viz a viz infrastructure & instructional facilities of the institution, the reply   and other related documents submitted by the institution from time to time  observed the following:-

  1. The  infrastructure & instructional facilities  provided by the institution in its building  are very poor, inadequate and unsatisfactory to meet the requirement of the NCTE Regulations, 2009.  The ERC observed that   (i) room size is very small (iii)  The size of the Multipurpose Hall is also very small as observed in the CD.  The same   is also inadequately furnished, flat cots are provided in the Multipurpose Hall instead of sitting arrangements (iv)The furniture shown as per the CD submitted by the institution is also very old.  The same is either of old school or the same is being used for any other purposes by the institution. 
  2. The CD submitted by the institution also lacking in terms of clearly establishing the   important infrastructural facilities which is also clear violation of clause 7(5) of the NCTE Regulations, 2009.
  3. The figure & facts submitted as per (i) the building plan and CD also not matching as the building plan do no show the Multipurpose Hall, however the CD shows the same (ii) The certificate submitted by the institution in respect of DEO seems to be not signed by the DEO.  Moreover the certificate is also   incomplete (iii) The name & signature of the Jr. Engineer is mismatching many times.

 Hence, the ERC decided to refuse the recognition to the institution for the proposed B.Ed. course   u/s 14 (3) (b)  of the NCTE Act, 1993

The Committee deliberated and considered the case in detail. The Committee noted that the institution was asked to submit its reply on the following observation of the ERC as per its decision taken in its 120th meeting held on 24th-25th June, 2011.

  • As per the Visiting Team (VT) report the inspection could not be conducted due to unruly mob intervened in the process of inspection, shouting slogan that the land does not belong to the college.

The institution vide its letter dt.27.8.2011 informed the ERC  that   due to conspiracy and due to rivalry a group of miscreants intervened in the process of inspection.  After the negotiation of subscription it has been solved and notable that the miscreants have confessed their faults.  The institution also informed that slogans shouting over the land were false and baseless and the management of the institution lodged a complaint against those miscreants to Chapra Police Station with a G.D. entry No. 1135 dated 31.10.2010.

In view of the above situation and before arriving at a final conclusion for deputing the  Visiting Team (VT) particularly in   view of safety & security of the Visiting Team (VT) the Committee decides that the concerned district authority i.e. D.M may be apprised of the situation also requesting the authorities to inform the ERC, NCTE about the  situation in and around the institution and feasibility of deputing  the Visiting Team (VT) by the ERC.
