PROCEEDINGS OF 129th MEETING OF THE ERC-NCTE HELD ON 20th-21st December, 2011

The 129th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 20th-21st December, 2011 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar.

Shri Ali Imam, Member could not attend the meeting due to some unavoidable reasons.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Dr. Sunil Yadav (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision.

The Eastern Regional Committee after due consideration of the records available in files of the institutions including their reply received from time to time viz-a-viz provisions of NCTE Act, Rules, Regulations, Guidelines and directions from NCTE Hqrs. took the decisions as under :-

The Committee deliberated and considered the case in detail and made following observations:- Considering the Hon’ble High Court of Jharkhand Order and direction of NCTE Hqrs. vide letter No.F. 64-230/2011/NCTE/Legal/A45399 dated 14.12.2011, the Committee is of the view that institution be asked to select the staff as per the laid procedure and duly approved by the Registrar of affiliating University on each page be submitted to the ERC, NCTE. The institution shall submit its compliance along with all necessary documents accompanied with an Affidavit in support of reply of the above point within 30 days of issue of the letter.

The original file of the institution, VTR, Video CD, reply submitted by the institution viz-a-viz provisions of the NCTE Act, Rules, Regulations and guidelines issued by NCTE-HQrs from time to time were considered by ERC. The Committee deliberated and considered the case in detail and made following observations:- The ERC upon the direction of Hon’be High Court of Sikkim in W.P(C) No. 42 of 2011 dated 7.11.2011 for the disposal of the matter regarding recognition of School of Education, decided to send a VT to assess the state of the affairs of the proposed institution in terms of the Act., Rules and Regulations of NCTE for further steps on the part of the ERC in this regard. However, the ERC on perusal of the report of VT kept on record that the proposed institution obtained land on lease basis from the private party for the construction of building for the proposed institution in accordance with the Norms regarding such constructions but the VT report also kept on record that no construction has yet been started on the said premises. The NCTE Rules & Regulations categorically said that the proposed institution should furnish Building Completion Certificate by the competent Authority and upon receipt said certificate the NCTE may take further steps for the recognition of the institution. Therefore, ERC decided to dispose the application/matter with sincere advice to the University Authorities to take up the construction work immediately in terms of the aforesaid Rules and Regulations. Therefore, the University/Institution is requested to construct the building immediately as per NCTE Regulations and further requested to take up the matter of recognition with NCTE upon completion of such construction.

No. 8704(W) of 2011 viz-a-viz provisions of the NCTE Act, Rules, Regulations and guidelines issued by NCTE-HQrs from time to time were considered by ERC. The Committee deliberated and considered the case in detail. The Committee decided that before taking final decision following documents/ clarifications are required to be submitted by the institution:- Building completion certificate is not signed by the competent Govt. Authority. Regarding extension & expansion certificate for Multipurpose Hall and Class rooms, certificate from competent Govt. Authority is to be submitted. The institution shall submit the above details/ clarification along with all necessary documents accompanied with an Affidavit in support of reply of the above points. Hence the ERC decided to seek above details/clarification on the above points and direct the institution to submit the reply as per provisions of the NCTE Act, Rules & Regulations within 21 days.

The original file of the institution, Appeal Order, viz-a-viz provisions of the NCTE Act, Rules, Regulations and guidelines issued by NCTE-HQrs from time to time were considered by ERC. The Committee deliberated and considered the case in detail. The Committee endorsed that direction of NCTE Hqrs. u/s 18 of NCTE Act-1993 No. 89-157/2011-Appeal/6th Meeting-2011/A43965 dated 4.11.2011 vide which ERC was directed to process the application of the institution on merits. The institution is deficient regarding following documents- Certified copy of the land documents is not submitted. FDR is not submitted. CLU is not submitted. Building plan not submitted The institution shall submit the above details/ clarification along with all necessary documents accompanied with an Affidavit in support of reply of the above points. The Committee deliberated and considered the case in detail. The Committee decided that before taking final decision following documents/ clarifications are required to be submitted by the institution:- The Committee considered the case referred back by the appellate authority of NCTE vide order No. F.89-201/2011 Appeal/7th meeting-2011 A45162 dated 9.12.2011, and on perusal of record, the Committee observed that the institution is deficient regarding – FDR’s towards Endowment Fund and Reserve Fund are not submitted in original. Certified copy of the land documents is not submitted. Building plan approved by the competent Govt. Authority not submitted. Notarized copy of CLU issued by the competent Govt. Authority not submitted. The original affidavit duly filled as per NCTE format not submitted. The Committee deliberated and considered the case in detail and made following observations:- After due consideration of the reply submitted by the institution, the Committee is of the opinion that letter of Intent under Clause 7(9) of NCTE Regulations 2009 be issued and to ask to submit the list of teaching staff duly approved by the competent Authority by signing on each of its page. The institution be also asked to submit following documents:- Advertisement in leading newspapers. Letter of Affiliating Body, nominating experts / representative for the Selection Committee. Minutes of the Selection Committee duly constituted as per the norms of the affiliating body. Approval of the Affiliating body to the selected faculty in the prescribed format. An affidavit on Rs.100/- stamp paper to the effect that the institution has selected staff as per NCTE/State/University norms in the prescribed format. An affidavit on Rs.10/- non judicial stamp paper by the individual faculty member selected by the institution. Details should be filled in by every faculty member selected in the prescribed format. Educational & Professional qualification certificates of all teaching staff showing their eligibility for appointment as per the NCTE norms and experience certificate of the Principal/HOD. Account opening form duly filled in for conversion of FDRs into joint account or document establishing that the FDR of Endowment Fund and Reserve Fund have been converted into a joint account in case it is self-financed institution. An undertaking from the Management of the institution as per the prescribed format. Down loaded copies of the website of the institution with the hyperlink of the same as per provisions of 7(10) of the NCTE Regulations, 2009. The institution after appointing the requisite faculty or staff as per the provisions of sub-regulations 7(9) and after fulfilling the conditions under sub-regulation 7(10) shall submit its compliance along with all necessary documents accompanied with an Affidavit in support of reply of the above points within 30 days of issue of Letter of Intent prior to recognition.
