1.        The Committee considered the letter No. 48-37/2009/NCTE (N&S)/A8956 dated 8^th January 2010 received from NCTE-HQrs regarding confirmation of Minutes and the Committee was of the view that the matter  being placed before ERC are first considered by the Sub-Group and the decision of the Sub-Group is further considered by the full Committee.  The decision of the Sub-Group is being signed by all the members of ERC who are present during the meeting, hence, it may be treated as confirmation of the decision by ERC members and the proceedings and decision of the ERC may be finalized accordingly.

The Committee considered the above and decided the following :-

2.    Letter may be sent to Director, Training, Government of Bihar, Patna alongwith the representation submitted by Sh Shashi Kant Jha for necessary action and endorsing a copy to the person concerned.

3.    Letter may be sent to the institution for appropriate action.

The Committee considered the reply dt. 13.01.2010 received on 20.01.2010 in response to ERC Notice letter                                       dt. 04.12.2009 along with relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that Notice                      u/s 14(3) (b)  may be issued giving 30 days for the following deficiencies.

(i)            The institution be directed to submit a fresh Affidavit with regard to land on Rs. 100/- Stamp paper on the prescribed format.

Further, the Committee decided that the reference to the State Government for comments may also be sent.

Course from the session 2009-2010 may be issued as per the NCTE Regulations 2007.

The Committee considered the reply               dt. 14.01.2010 received on 22.01.2010 in response to ERC Notice                dt. 08.01.2010 along with relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that Order under Clause 7(11) of Regulations, 2007 for annual intake of 100 for B.Ed. Course from the session 2009-2010 may be issued as per the NCTE Regulations 2007.

The Committee considered the reply               dt. 25.01.2010 received on 27.01.2010 in response to ERC Notice dt. 08.01.2010 along with relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that clarification letter may be issued on the institution giving 30 days for the following deficiencies.

·         No supporting document about principal’s appointment / superannuation submitted.

The Committee noted that no reply has been received in response to letter issued by the office of ERC on 22.01.2010 as per the decision of the Appellate Authority to appoint faculty and sumit compliance report alongwith the supporting documents and decided that reply may be awaited.

The Committee considered the reply               dt. 25.01.2010 received on 27.01.2010 in response to ERC Notice dt. 08.01.2010 along with relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that clarification letter may be issued on the institution giving 30 days for the following deficiencies.

·         Teachers list not in the prescribed format.

·         Principal is still working in another institution as per NOC submitted by the institution.

·         The experience certificate of the Principal is from an institution which is recognized from 2005.  Thus, the five years experience of the Principal is not complete.

The Committee noted that Recognition order under para 7 (11) of NCTE Regulations 2007 has been issued on the institution on 15.01.2010, as per the decision of the Appellate Authority.
