The 105th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was held on 9th-11th March 2010 at Conference Hall, ERC, NCTE, Bhubaneswar, Orissa.

The Sub-Group of the Eastern Regional Committee perused & considered all the cases and taking into consideration the  recommendations made  by the Sub-Group, the Eastern Regional Committee considered & decided the following matters/cases as per the proceeding noted below:-

The Committee noted that no reply has been received in response to ERC letter of intent under section 7(9) dt.14.01.2010 along with other relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that that Notice u/s 14(3) (b)  may be issued giving 30 days to submit the reply to 7(9) issued by the office of ERC.

Further, the Committee decided that letter to the State Govt. may be issued.

The Committee considered the reply 27.01.2010 received on 02.02.2010 in response to ERC Notice dt. 08.01.2010 along with relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that that Notice u/s 14(3) (b)  may be issued giving 30 days for the following deficiencies.

(i)  The institution had submitted two land documents, one on ownership and other on lease basis.  The application has been submitted in October 2008, hence only ownership documents can be accepted.  The ownership documents is for Plot No. 90, which is only 1300 sqm, which is less than required of 1500 sqm as per NCTE Regulations 2007.

The Committee considered the reply received vide its letter 29.01.2010 received in this office on 05.02.2010 in response to ERC Notice dt. 08.01.2010 along with relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that the institution may be directed to approach NCTE-Hqrs. for relaxation of land through State Government, as the power to relax is with the Chairperson-NCTE.

1.      Affidavit on Rs.10/- stamp paper submitted by the Principal is not in prescribed format & Educational qualification certificate and mark sheet of Principal not submitted.

The Committee considered the reply dt. 05.02.2010 received on 10.02.2010 in response to ERC Notice dt. 08.01.2010 along with relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that Notice u/s 14(3) (b) may be issued giving 30 days for the following deficiencies.

 

(i)                  As per notice dated 08.01.2010 and as per point (iv) the institution has not submitted the land documents for plot no. 02. The institution has submitted the land documents for plot no. 1 only and has submitted some documents in regional language.

(ii)                The building completion certificate submitted by the institution is not countersigned by the competent civil authority.

(iii)               As per building completion certificate the building is constructed at plot no. 1 & plot no.2 but as per building plan submitted the building plan is for plot no. 02 only.

(iv)             Date of registration not mentioned in the affidavit.

(v)               As per the experience certificate submitted it is observed that the Principal do not have 5 years experience in Secondary Teacher Education Institution.

Course from the session 2009-2010   may be issued as per the NCTE Regulations 2007.

The Committee considered the reply dt. 23.01.2010  received in this office on 08.02.2010 & 10.02.2010 in response to ERC Notice dt. 08.01.2010 along with relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that Notice u/s 14(3) (b) may be issued giving 30 days for the following deficiencies.

(i)                 Educational Qualification Certificate of the teaching staff not submitted by the institution.

(ii)               Experience Certificate of the Principal not submitted by the institution.

(iii)        Language learning lab not available.

The Committee decided that the documents submitted by the institution be checked thoroughly while placing the matter in subsequent ERC meeting.

The Committee considered the reply 02-01.2010 received in this office on 08.02.2010 in response to ERC Notice dt. 08.01.2010 along with relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that Notice u/s 14(3) (b) may be issued giving 30 days for the following deficiencies.

(i)        The Plot No. mentioned in the affidavit does not tally with the land documents.

(ii)       The Plot No. mentioned in the Building Completion Certificate tally with the land document submitted however, do not tally with the affidavit.

(iii)     Also the date of Registration as per affidavit is 16.08.2008 whereas as per land documents deed of sale made on 16.10.2008.

(iv)    The building plan approval given by the competent authority is for the house and not for educational institution.

(i)                  Principal’s teaching experience certificate not submitted.

(ii)                Mandatory Disclosure Format for teaching staff not submitted.

(i)    The institution has advertised for admission test Indicating that recognition had been granted when it is not a fact and only a letter of intent has been issued.

The Committee considered the reply dt. 22.08.2009 received on 25.08.2009 & 12.10.2009 received on 14.10.2009 in response to ERC Notice dt. 05.08.2009 along with relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that Notice may be issued giving 30 days for the following deficiencies.

 

(i)    Experience Certificate of Principal not submitted and in the affidavit the column regarding experience is also left blank.

 

(ii)   Affidavit submitted by the management regarding selection of staff has no nominee from the Affiliating body.  Policy of the selection committee is also not clear.

Khaza Nezam Ali College of Education, Mohalla Kabir Ganj, sasaram, Dist – Sasaram, Bihar – 821115 (D.Ed. (B.T.C) (Private) (Bihar School Examination Board) (Code No. APE00805)

The Committee considered the reply dt. 24.10.2009  in response to ERC Acceptance letter                               dt. 24.10.2009 along with relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that Notice u/s 14(3) (b) may be issued giving           30 days for the following deficiencies.

(i)      Certified copy of Registered Land Lease / ownership documents not submitted as per Regulation 8(7) & 8(8). (Duly notarized English version of land documents is required to be submitted).

 

(ii)    Copy of the approved Building Plan where the proposed (B.T.C.) D.Ed. Course will be run with Khasra No./Plot No.,  built –up area, total land area from the concerned approved Govt. Engineer duly countersigned by the concerned authority.

 

(iii)   Building completion certificate mentioning therein Khasra No., Plot no., details of total land area, built up area which should be as per the approved building plan & land  documents of the institution and the same should  be suitable to run teacher training course as per the NCTE norms  duly approved by Govt. Engineer and countersigned by the authority concerned.

 

(iv)  Affidavit on Rs. 100/- stamp paper regarding land with complete information. Date of Registration, information regarding land use permission from the Competent Authority w.r.t. Col. 5 of the affidavit format.
