The 107^th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was held on 5^th-8^th May 2010 at Conference Hall, ERC, NCTE, Bhubaneswar, Orissa.

The Sub-Group of the Eastern Regional Committee perused & considered all the cases and taking into consideration the recommendations made by the Sub-Group, the Eastern Regional Committee considered & decided the following matters/cases as per the proceeding noted below:-

Bihar University) (Code No. APE00973)	The Committee considered the reply dt. 12.04.2010 received in ERC office on dt. 15.04.2010 in response to ERC Notice dt. 16.03.2010 along with relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that recognition to B.Ed. course of the institution be refused u/s 14 (3) (b) for the following reason: (i) The Principal is not qualified as per NCTE norms. (ii) Discrepancy in land documents.
ER-107.7.	Court Case
ER-107.7.1	Dr. Ambedkar Hindi Sanskrit Vidyapeeth Bihar Cum Education & Training, Vill – Jokia, Po – Joika, Dist – Begusarai, Bihar – 851127 (Private) (B.T.C) (Hindi University, Allahabad.) (Code No. APE00944	The Committee considered the reply dt. 30.03.2010 received in ERC office on 12.04.2010 in response to ERC Notice dt.16.03.2010 along with relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that Order under Clause 7(11) of Regulations, 2007 for annual intake of 50 for the B.T.C. Course from the session 2009-2010 may be issued as per the NCTE Regulations 2007.

ER – 107.8.1	Bihar College of Teacher Education, Vill- Samanpura, PO- B.V. College, Dist.- Patna, Bihar- 800014 (Private) (B.Ed) (Magadh University) Code No. ERCAPP162	Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received from the institution dated 01.02.2010 received in ERC office dt.15.02.2010 in response to DLI dated 22.12.2009, issued by the office of ERC, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that as papers are found in general order Visiting Team may be sent for inspection of the infrastructure & instructional facilities provided for running the proposed teacher education programme as per the NCTE norms.
ER – 107.8.2	Kiran Teachers Training College, Vill- Sagarpur, Po- Sagarpur, Dist.- Madhubani, Bihar- 847239 (Private) (B.Ed) (L.N.Mithila University, Darbhanga) Code No. ERCAPP249	Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received in ERC office dt.24.02.2010 in response to DLI dated 22.12.2009, issued by the office of ERC, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that application of the institution for B.Ed. course be refused / Rejected as per NCTE Regulations 2009 for the following reason: 1. The FDR (Rs.3.00 Lacs) submitted towards Reserve fund issued after the last date of submission of application. 2. In support of Change of Land Use Certificate the institution had submitted a Land Use Certificate issued on 17^th February 2010, whereas as per Regulations, the same has to be prior to the date of application. 3. In support of Column 5 of the Affidavit, the institution had submitted a letter from the Society and not from the competent authority. 4. As per the building plan, the ground floor / plinth area is only 792.50 sq.ft, whereas as per Regulations, the institution should have a minimum of 1500 sqm of built up area on the ground floor only. However, the NCTE-HQrs vide letter No. F.No. 48-34/2010/NCTE/N&S/A13303 dated 9^th April 2010 had clarified that required built-up-area as prescribed in the concerned norms in the Regulations 2009 refers to the total built up area available in a single storey or multi-storey building constructed upon the prescribed land area. 5. The Non-Encumbrance certificate has been issued on 16^th February 2010. 6. The institution had submitted two different statements in the Affidavit : in the Affidavit submitted alongwith the application form, with regard to para 5, the institution had stated the letter No. 89 dated 25^th June 2009 and with regard to land it had stated the total land area as 3804.46 sqm whereas in the affidavit dtd 13^th Feb 2010 submitted alongwith the reply the institution has stated the letter No. 05 dtd 9^th Feb 2010 and the land area as 5297.39 sqm.. 7. As per building completion certificate, the building is under construction & work in progress. The Construction work will be completed likely in the last March, 2010.
ER – 107.8.3	Maa Bindhywasini College of Education, At- Sheohar, Po- Sheohar, Dist- Sheohar, Bihar – 843329 (Private) (B.Ed)(Baba Saheb Bhimrao Ambedkar - PAGE 4 – University) Code No. ERCAPP255	Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received from the institution dated 21.01.2010 received in ERC office dt.17.02.2010 in response to DLI dated 22.12.2009, issued by the office of ERC, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that application of the institution for B.Ed. course be refused / Rejected as per NCTE Regulations 2009 for the following reason: 1. The Fixed deposit receipt of Rs. 5.00 lacs and 3.00 lacs are in the name of Sh. Jagdishwari Pd. Mishra i.e. Individual. 2. Notarized copy of Land Use Certificate issue by the competent authority not submitted. The institution had submitted an Sworn Affidavit on Rs. 20 stamp paper stating that the land will be utilized for Educational purposes. 3. The Non-Encumbrance Certificate has been issued on 24^th January 2010, whereas as per Regulations and clarification of NCTE-HQrs, it should have been prior to date of application. 4. Certified copy of the registered land documents issued by the competent authority (Not submitted) 5. The built up area and plinth area not mentioned in the building plan submitted by the institution. 6. In the application form, the institution has mentioned the competent authority to approve the Building plan is Sheohar Municipality. The building plan has been approved on 15^th Jan 2010 by Certified Architect, Sheohar Nagar Panchayat who is not the competent authority. 7. The plinth area / ground floor of the building is approx 8000 sq.ft, whereas as per Regulations, the institution should have 1500 sqm of built up area on the Ground floor only. 8. The Size of multipurpose hall is 800 sq.ft, whereas as per Regulations, it should be 2000 sq.ft 9. Building Completion certificate with the Plot number, Khata No. Total area & Built up area, Plinth area etc. from competent civil authority (Not submitted). 10. The Affidavit on Rs. 100/- stamp paper is incomplete. The institution has not mentioned the Built up Area, Registering authority and the date of Registration of land in the affidavit on Rs. 100 stamp paper. 11. In the affidavit on Rs. 100/- stamp paper, the institution has mentioned that the land is on Ownership basis for a minimum period of 30 years. 12. The enclosure to Column 5 of the Affidavit not submitted. 13. In the application form, the institution has not mentioned the Website address of the society / institution. 14. Website of the institution is not launched / address not mentioned.
ER – 107.8.4	S.M. Shoaib Hashmi, Educational & Welfare Trust Group of Institutions, Pakariya Pathanpatti, Motihari (Private) (B.Ed) (Baba Saheb Bhim Rao Ambedkar, Bihar University) Code No. ERCAPP266	Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received from the institution dated 15.02.2010 received in ERC office dt.22.02.2010 in response to DLI dated 22.12.2009, issued by the office of ERC, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that application of the institution for B.Ed. course be refused / Rejected as per NCTE Regulations 2009 for the following reason: 1. Orignial FDR of Rs.5 lacs & Rs.3 lacs towards Endowment & Reserve fund not available/not received. 2. Certified copy of registered land documents not submitted. 3. Also as per the photocopy of land documents submitted, the Gift Deed is conditional 4. Original Affidavit on Rs.100/- stamp paper regarding land not submitted. 5. The building plan submitted seems to be tampered with (with regard to date of approval). 6. As per the building plan, the institution is having 584 sqm on the ground floor, whereas as per Regulations, the institution should have a total of 1500 sqm on the ground floor only. 7. In the application form, PAN No of the society, Website address of the society / institution is not mentioned. 8. In the application form, the institution has mentioned the date of completion of building as 15.09.2009, whereas as per the Building completion certificate issued, the construction of the building s in progress. 9. The Non Encumbrance Certificate has been issued on 12.01.2010, whereas as per Regulations, it should have been issued as on the date of application. 10. In support of Change of Land Use, the institution had submitted the Land Use Certificate issued by Sarpanch of the village. As per the certificate, other institutions are running on the said land. 11. Building completion certificate with plot no & khata no. total area and built up area from the competent Govt. authority not submitted. 12. Total area mentioned in the building plan do not tally with an affidavit. 13. Undertaking in original not submitted.
ER – 107.8.5	Saheed Ravikant Memorial B.Ed. College, Plot No. – 945, Vill. – Dalsagar, Po./Town/Dist. – Buxar, Bihar – 802102 (Private) (B.Ed) (Veer Kunwar Singh University) Code No. ERCAPP262	Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received in ERC office dt.24.02.2010 in response to DLI dated 22.12.2009, issued by the office of ERC, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that as all papers seem to be generally in order Visiting Team may be sent for inspection of the infrastructure & instructional facilities provided for running the proposed teacher education programme as per the NCTE norms.
ER – 107.8.6	Surendra Prasad Yadav Teachers Training College, Plot No. – 491/714, Vill. – A.P. Colony, Po. – Gaya, Town/Dist. – Gaya, Bihar – 823001. (Private) (B.Ed) (Magadh University) Code No. ERCAPP274	Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received in ERC office dt.24.02.2010 in response to DLI dated 22.12.2009, issued by the office of ERC, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that application of the institution for B.Ed. course be refused / Rejected as per NCTE Regulations 2009 for the following reason: 1. Land registrartion after due date i.e 3^rd February 2010 submitted, whereas as per Regulations, the same has to be issued prior to the date of application. 2. Notarized copy of change of land use certificate issued by the competent authority not submitted. 3. The land documents submitted are for the Plot No. 132, 714 which are the same as mentioned in application form and also the Affidavit, but the Sale Deed in the name of institution for the above Plot has been executed on 30^th December 2009 i.e. after the last date for submission of application. 4. In the Affidavit on Rs. 100/- stamp paper, the institution has stated the date of registration as 29.10.2009 for the above plot, whereas as per land documents, the documents have been registered on 30^th December 2009. 5. The Building completion certificate issued on 17^th Jan 2010 states the land area as 25.65 sqm and built up area as 1576.56 sqm. 6. Building Plan approved by Counselor and plinth area / Ground floor is 394.14 Sq. Mtr. Which is not as per NCTE Regulations. 7. There is no provision for Multipurpose Hall in the Building plan 8. The non-encumbrance Certificate has been issued on 3^rd February 2010, whereas as per Regulations, the same has to be issued prior the date of application.
ER – 107.8.7	East N West Teachers Training College, Vill – Patuaha,Po.– Patuaha, Town/City. – Saharsa, Dist. – Saharsa, Bihar – 852201 (Private) (B.Ed) (B.N.Mandal University, Madhepura) Code No. ERCAPP287	Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received in ERC office dt.15.02.2010 in response to DLI dated 22.12.2009, issued by the office of ERC, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that application of the institution for B.Ed. course be refused / Rejected as per NCTE Regulations 2009 for the following reason: 1. The deed/land document in the indivisual’s name which is not as per NCET norms and regulation. 2. The certified copy of land documents has been issued on 13.01.2010, whereas as per Regulations, the same has to be prior to the date of application. 3. The non-encumbrance Certificate has been issued on 14^th Jan 2010, whereas as per Regulations, the same has to be issued prior the date of application. 4. The institution had submitted the revised building plan approved on 16^th Jan 2010, whereas as per Regulations, the same has to be approved prior to the date of application. 5. Notarized copy of change of land use certificate issued by the competent authority not submitted. 6. Building completion certificate with plot No. & khata No., total area & built up area from the competent Govt. authority not submitted. 7. As per the building plan, the plinth area / ground floor area is 661.20 sqm, whereas as per Regulations, a minimum of 1500 sqm of built up area is required at the ground floor only. However, the NCTE-HQrs vide letter No. F.No. 48-34/2010/NCTE/N&S/A13303 dated 9^th April 2010 had clarified that required built-up-area as prescribed in the concerned norms in the Regulations 2009 refers to the total built up area available in a single storey or multi-storey building constructed upon the prescribed land area. 8. As per the building plan, the size of Multipurpose hall is less than 2000 sq. ft. 9. The institution had submitted the multicolor FDRs, as per the application form
ER – 107.8.8	Binay College of Education, Vill- Daudhat, Po.-Shahjadpur, Dist.- Bhagalpur, Bihar- 812005 (Private) (B.Ed) (T M Bhagalpur University) Code No. ERCAPP329	Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received from the institution dated 17.02.2010 received in ERC office dt.22.02.2010 in response to DLI dated 22.12.2009, issued by the office of ERC, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that application of the institution for B.Ed. course be refused / Rejected as per NCTE Regulations 2009 for the following reason: 1. The land registered in the name of an individual which is not as per norms and regulation. 2. The Certified copy of land documents issued on 6^th Nov 2009 and 17^th Feb 2010 submitted, whereas as per Regulations, the same are to be issued prior to the date of application. 3. The institution had submitted two land documents viz. documents registered on 24^th Sept 2009 for 26000 sq.ft in the name of individual for Khata No. 1, 42 and Khasra No. 1,2,3,4 Ka Part and 81 and another documents registered on 15^th Feb 2010 for 2160 sq.ft in the name of proposed institution for Khata No. 11, 42 and Khasra No. 84, 81. The institution is having only 2160 sq ft land in the name of institution / society, which is less as required in Regulations and also the same cannot be accepted as the same has been registered after the last date. Hence, the institution / society does not posses land in the name of institution / society as on the date of application. 4. The building plan seems to be tampered with (with regard to land area) and Khata No. 11 & Khasra No. 84 appears to be added subsequently as the land documents for the above Khata have been registered on 15.02.2010. 5. The size of multipurpose hall mentioned in the Building plan is 1500 sq.ft (approx) as against requirement of 2000 sq.ft 6. The Non-Encumbrance Certificate has been issued on 17^th Feb 2010, whereas as per Regulations, the same has to be prior to the date of application. 7. The Land Usage Certificate has been issued by the Sarpanch of the village, which is not notarized. 8. Covered/plinth area not given in the building plan. 9. Total area & built up area mentioned in the application form do not tally with building plan. 10. Undertaking not submitted.
ER – 107.8.9	Nur Mohamed Memorial College, 334, Dhuliyan, P.O.- Ratanpur, Murshidabad, West Bengal – 742 202 (Private) (B.Ed) (Kalyani University) Code No . ERCAPP174	Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received from the institution dated 20.02.2010 received in ERC office dt.08.03.2010 in response to DLI dated 22.12.2009, issued by the office of ERC, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that application of the institution for B.Ed. course be refused / Rejected as per NCTE Regulations 2009 for the following reason: 1. The land area is less than as per NCTE norms. 2. Certified copy of Registered Lease Deed/ Sale Deed/ Gift Deed in the name of the institution or Society/ Trust. (The land documents submitted is in the name of individual as not as per regulation) 3. Notarized copy of Conversion / Change of Land Use Certificate from the competent authority 4. FDR of Rs.5 lakhs & 3 lakhs in original not submitted. 5. Building plan submitted is not approved by competent civil authority. 6. A certificate / letter from the Registering Authority clearly indicating provisions of act/ law under which the trust has been registered) not submitted. 7. Total area and built up area mentioned in the building plan and building completion certificate is less than the norms. 8. The total area and built up area mentioned in the application and building plan and affidavit do not tally and is less then the required as per the norms. 9. The land is not in the name of institution / Trust. It is in the name of the individual which is not as per norms and regulation.
ER – 107.8.10	Rahat College of Education, At-Madhupur, PO-Madhupur, Deoghar, Jharkhand – 815353 (Private) (B.Ed) (S.K.M. University) Code No. APP99	Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received from the institution dated 20.03.2010 received in ERC office dt.24.03.2010 in response to DLI dated 19.11.2009, issued by the office of ERC, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that application of the institution for B.Ed. course be refused / Rejected as per NCTE Regulations 2009 for the following reason: (i) The Affidavit on Rs. 100 stamp paper and building plan has been sworn by the institution after the last date of submission of application. (ii) In the application form, the Website address of the institution / society is not mentioned. (iii) In the land documents, the sale deed itself states that the sale deed is for a residential house. (iv) In support of Change of Land Use, the institution had submitted a Certificate from the Executive Officer, Madhapur Nagar Parishad stating that the land may be used for RAHAT College of Education issued on 19^th March 2010, which not Notarised. No other supporting document has been submitted. (v) In the application form, the institution had stated that the building has been completed in October 2009 whereas in the reply the institution had submitted the Building plan approval dated 19^th March 2010 wherein the plan has been approved for construction of the building. (vi) The institution had got the approval for construction of building on 19^th March 2010 and also the Building completion certificate on 19^th March 2010. (vii) As per the building plan / building completion certificate, the plinth area of the building is 695.52 sqm, whereas as per Regulations 1500 sqm of built up area is required. (viii) The Non-encumbrance certificate has been issued on 20^th February 2010.
ER – 107.8.11	Mahatma Jyoti Ba Fuley Teachers Training College, Vill-Sindur, PO-Hazaribagh, City – Hazaribagh (Private) (B.Ed) (Vinoba Bhave University) Code No. APP136	Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received received in ERC office dt.22.03.2010 in response to DLI dated 27.01.2010, issued by the office of ERC, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that as all papers seem to be generally in order Visiting Team may be sent for inspection of the infrastructure & instructional facilities provided for running the proposed teacher education programme as per the NCTE norms.
ER – 107.8.12	J.D. National B.Ed. College, Vill- Janum, Angara, Po- Angara, Dist- Ranchi, Jharkhand – 835103 (Private) (B.Ed) (Ranchi University) Code No. APP184	Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received from the institution dated 15.02.2010 received in ERC office dt.22.02.2010 in response to DLI dated 22.12.2009, issued by the office of ERC, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that application of the institution for B.Ed. course be refused / Rejected as per NCTE Regulations 2009 for the following reason: 1. The institution had submitted the FDRs towards Endowment and Reserve Fund which are dated 9^th January 2010, i.e. after the last date of application. 2. Notarized copy of Land Use Certificate issue by the competent authority. 3. In the application form Website address of the society / institution is not mentioned. 4. The land in the name of the Society has been registered on 14^th Sept 2009 whereas the Non Encumbrance Certificate submitted is issued in the month of May 2009. 5. The Plot Area mentioned in the affidavit is 4453.16 sqm not tally with the Building Plan (In building Plan Plot area mentioned 5718.58 Sqm). 6. As per building plan Ground floor area / Plinth area is 825.37 Sq. Mtrs, which is not as per NCTE norms. 7. The Enclosure 5 of the Affidavit has been submitted from the trust only, which is not acceptable.
ER – 107.8.13	Maa Vindhya Vashini College of Education, Vill- Karamtand (Padma Gate), Po- Suryapura, Tehsil – Padma, Dist- Hazaribagh, Jharkhand – 825411 (Private) (B.Ed) (V.B. University, Hazaribagh) Code No. APP199	Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received from the institution dated 16.02.2010 received in ERC office dt.22.02.2010 in response to DLI dated 22.12.2009, issued by the office of ERC, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that application of the institution for B.Ed. course be refused / Rejected as per NCTE Regulations 2009 for the following reason: 1. Building plan is not approved by the Competent Authority. 2. The Certified copy of land documents issued on 08^th Jan 2010 submitted, whereas as per Regulations, the same are to be issued prior to the date of application. 3. The Non-encumbrance Certificate has been issued on 04^th Feb 2010, whereas as per Regulations, the same has to be prior to the date of application. 4. In the application form, Website address of the society / institution is not mentioned. 5. Affidavit on Rs. 100/- stamp paper on the prescribed format about land submitted on sworn on 13^th Feb 2010, whereas as per Regulations, the same are to be issued prior to the date of application. Further, the total area and also the Name of the Registering officer not mentioned in the Affidavit. The institution not filled up the Col.5 of the affidavit. 6. As per the building plan, the size of multipurpose hall is less than 2000 sq ft as prescribed in the Regulations. 7. Notarized copy of Land Use Certificate issued by the competent authority not submitted. 8. The covered area of the Building plan not as per NCTE Regulation. 9. The total area and built up area not mentioned in the Building Completion Certificate. 10. As per the Building plan submitted, the plinth area of the building is 884.00 sqm, whereas as per Regulations, it should be 1500 sqm. However, the NCTE-HQrs vide letter No. F.No. 48-34/2010/NCTE/ gulations 2009 refers to the total built up area available in a single storey or multi-storey building constructed upon the prescribed land area.
ER – 107.8.14	Subhash Teacher’s Training College, Vill- Koldiha, Po- Giridih, Dist – Giridih, Jharkhand – 815301 (Private) (B.Ed) (V.B. University, Hazaribagh) Code No. ERCAPP46	Upon consideration of the original file of the institution, Agenda note placed by the office of ERC, reply received from the institution dated 16.02.2010 received in ERC office dt.24.02.2010 in response to DLI dated 22.12.2009, issued by the office of ERC, NCTE Act, Rules and Regulations published by NCTE and guidelines of NCTE issued by NCTE-HQrs from time to time, the ERC decided that application of the institution for B.Ed. course be refused / Rejected as per NCTE Regulations 2009 for the following reason: 1.
