On careful perusal, observation and consideration of reply from the institution along with the original file, all documents of the institution, related clarifications/ guidelines received from the NCTE Hqrs., the NCTE Act., Rules, Regulations 2009 stipulated by the NCTE, norms and standards, the ERC noted that the following deficiencies still exists :-

1.           As per the point 1. of the notice the institution was to submit the transfer of land document in the name of the institution. However, the institution has submitted the lease land document which the society has given on lease to the institution.

2.           The VT and the other related document, along with applications, rules, regulations, NCTE Act are placed before the committee to take appropriate decision in the matter, the observation of the land documents are as follows:

3.           The land is on private lease which can not be accepted for consideration of grant of recognition as per Regulation 2007 and 2009.

4.           As per the appeal order dt.05.01.2010 inspection has been conducted and the institution was also asked to submit the transfer of the land from Oriental Association for education and research to Burdwan Institute of Education. The institution has submitted the document related to transfer of the land as mentioned above, hence the land document is appropriate as per Regulation required.

5.           Letter cannot be treated as CLU rather it appears to be forged.

6.           The building plan submitted by the institution is not in the name of the institution so this cannot be treated appropriate for consideration

On the basis of the observations made by the ERC while considering the case, the ERC noted that the land is on lease basis, the building is in the name of the trust, hence, decided that the institution stands no merit and refusal order u/s 14 (3) (b) be issued.

Dhupguri College of Education, Vill- Rey Para, PO- Dhupguri, Dist- Jalpaiguri, West Bengal – 35210 (M.Ed.) (Private) (University of North Bengal) Code- APE001148

On careful perusal, observation and consideration of reply from the institution along with the original file, all documents of the institution, related clarifications/ guidelines received from the NCTE Hqrs., the NCTE Act., Rules, Regulations 2009 stipulated by the NCTE, norms and standards, the ERC observed the following:

Ψ  As per the Experience Certificate it is observed that the Principal served in Eastern Dooars B.Ed. Training College as a faculty from 08.05.2005 till 31.05.2010. However, the institution, Eastern Dooars B.Ed. Training College is recognized by ERC on 31.10.2006.

However, as per the VT remarks :

Ψ    The size of the Multipurpose hall is 1500 sq.ft.

Ψ    As per the VT the building work is in progress. And as per the affidavit available in VTR file, Actual Building is being completed very with white wash very soon. Therefore, I shall furnish the staff room, common room and Library within the month of June 2010. As work is in entire progress work is going day and night.

Ψ    As per the VT Report, the building work is in progress.  The report also says that construction is completed.  However, as per the Affidvit of Rs. 100 dated 9.6.2010 submitted to the VT Members, the actual building is being completed even with while wash very soon. This particular statement nullifies thte report of VT regarding completion of construction of building.

Ψ    The institution has been granted 7 (9) even after the non-compkliance of the building for the institution.

The institution has not submitted adequate documents for reply to 7 (9).

On the basis of the observations made by the ERC while considering the case, the ERC decided that the Show Cause Notice u/s 14 (3) (b) be issued on the institution to submit the list of the teaching staff Countersigned by the competent authority of the affiliating university.
