ER – 98.8.3 Gurupad Primary Teacher’s Training College Vill- Ranka Kalan, Ranka Raj, Tehsil – Ranka Raj, Dist- Garhwa, Jharkhand – 800125 (D.Ed.) (Private) (Jharkhand Intermediate Council) Code No. APE01149 The Committee noted that no reply received in response to Notice dated 05.06.2009 and considered along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that recognition to D.Ed. course of the institution be refused u/s 14 (3) (b) for the following reasons:
  1. The institution has not submitted reply to ERC notice dt. 5th June, 2009 within the prescribed time limit.
  2. The institution is required to submit the building completion certificate mentioning therein Khasra No., Plot no., details of total land area, built up area which should be as per the approved building plan & land documents of the institution and the same should be suitable to run teacher training course as per the NCTE norms duly approved by Govt. Engineer and countersigned by the authority concerned.
  3. Enclosure of Col.5 of affidavit has not been submitted.
ER – 98.8.4 Urdu Medium Govt. Primary Teacher’s Training Institute, Vill./Po.- Nalikul, Dist.- Hooghly, West Bengal- 712 407 (D.Ed.) (Government) (West Bengal Board of Primary Education) Code No.APE01140 The Committee noted that the institution has already been recognized by ERC, NCTE with annual intake of 60, therefore, the Committee decided to close the file of the institution.
ER – 98.8.5 Wali Institute of Teacher’s Education, Karnamadhabpur, Bilkanda 1, PS – Ghola, Kolkata – 700 110, West Bengal (B.Ed.) (Private) (Calcutta University) Code No.APE00549 The Committee noted that no reply has been received in response to ERC Reminder Letter dt. 01.07.2009 and considered along with other relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice u/s 14(3) (b) may be issued giving 7 days time for the following deficiencies:
  1. The reminder letter dt. 01.07.2009 seeking consent of the institution for inspection returned undelivered.
  2. The affidavit submitted by the institution not mentioned the date of registration and registering authority. The institution mentioned the Society address instead of the address of Registering authority and date of registration in the Affidavit.
ER – 98.8.6 Nabiul Fatima Women’s Teacher Training College, Vill/Po – Bahera, Tehsil/Taluka – Benipur, City/Dist – Darbhanga, Bihar – 847201 (B.Ed.) (Private) (Lalit Narayan Mithila University) (Code No. APE001019 The Committee considered the reply of the institution dated 30.06.2009 & 01.07.2009 received in ERC office on dt.07.07.2009 and 10.07.2009 in response to ERC Notice dt.05.06.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice u/s 14(3) (b) may be issued giving 7 days time for the following deficiencies:
  1. Certified copy of land document as per Regulation 8(7) and (8(8) not submitted. The institution is required to submit the same as per the NCTE Rules & Regulations.
  2. The institution submitted building plan without total area and built up area
  3. Fixed Deposit Receipt of Rs. 3.00 lakhs (in original) not submitted as Reserve Fund. The institution submitted some called deposited receipt which is not clear.

ER – 98.8.7 Primary Teacher Training College, Phulwaria-Bhagalpur, Vill – Phulwaria, Po – Baijani, City/Dist. – Bhagalpur, Bihar – 813112. (D.Ed.)(Govt.) (Bihar School Examination Board) Code No. APE00986 The Committee considered the reply of the institution dated 15.05.2009 received in ERC office on dt.07.07.2009 in response to ERC Consent / Clarification letter dt.27.03.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice u/s 14(3) (b) may be issued giving 7 days time for the following deficiencies:
  1. Certificate from the Govt. regarding infrastructure & instructional facilities as per the NCTE norms not submitted
  2. Building Completion Certificate where the proposed B.Ed. Course will be opened with Plot No., Khata No, built –up area, total area, khesera No. from the Competent State Govt. Authority not submitted.
ER – 98.8.8 Chapra Primary Teacher’s Training Institute, Vill- Gokhurapota, Po- Charatala, Tehsil – Krishnagar, Dist- Nadia, West Bengal – 741123 (D.Ed) (Private) (West Bengal Board of Primary Education) Code No.APE01129 The Committee considered the case of the institution along with the Visiting Team Report, relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and confirmed the earlier decision and decided that Recognition Order under Clause 7(11) of Regulations, 2007 for annual intake of 50 for D.Ed. Course from the session 2009-2010 be issued.
ER – 98.9.1 Miscellaneous
ER – 98.9.1.1 Court Case:Admission of students and running of the 2 years PTT/ETE/D.Ed. course by Model PTTI, P.O.Basantpur, Dist. Murshidabad, WB (Code No.APE00626) The whole matter was considered in the 97th Meeting of the ERC whereby the Committee noted the following:-
“The Committee considered the matter in light of the representation dtd. 10.06.2009 received in ERC office on 18.06.2009 with reference to ERC’s order No.94 dt.30.05.09 permitting the institution to admit students and run PTT/ETE/D.Ed. Course of 2 years duration from the session 2009-10 and interim order dtd. 16.05.2008 passed in writ petition no. 865 (W) of 2008 by the Hon’ble Calcutta High Court. The Committee noted that the institution has given the representation with the prayer for :-
(i) Either correcting the order dt.30.05.2009 accordingly and permitting Model PTTI to admit students and conduct the course from 2008-10 academic session.
(ii) Or withdrawing the order
The Committee further noted that such representations are being received from West Bengal Primary Teacher Training Institutions (PTTIs) and are also being forwarded by the Chairman NCTE, New Delhi with the reference of ERCs order issued in may, 2009 as per the decision of 95th ERC meeting held in April, 27th -29th, 2009 restricting/permitting the recognized PTTIs to admit students from 2009 onwards. Prima-facie, the committee was of the opinion that this letter / order should have been issued to recognized PTTIs in West Bengal which were granted recognition for PTT (D.Ed.) (Elementary Level ) Course of one year duration and that it should not be applicable to the institution granted recognition already granted recognition for PTT (D.Ed.) (Elementary Level ) Course of two year duration. The Committee also noted that the Hon’ble High Court of Calcutta has also passed an interim order in favour of the PTTI’s for admitting students from the session 2008-2010 and ERC decided that the matter be examined legally for withdrawal of ERC’s Order issued in May, 2009, in respect of PTTI’s recognized from the year 2007 onwards for conducting PTT (D.Ed.) (Elementary Level Course) of two years course. Suitable action as per the legal advice may be taken and ERC be kept informed. The matter may be placed in the next ERC Meeting.”
As per the decision of the 97th ERC meeting, the local advocate Shri B.C. Bastia was asked for his legal opinion on the matter. However Mr. Bastia opined that legal opinion can be furnished only after the receipt of the certified copy of the interring order dated 02.05.2008 from the advocate concerned. The concerned advocate, M/s. A.G. Gutgutia has been asked to furnish his legal opinion vide this office letter dated 01.07.2009, the same has been received vide letter dt.15.7.2009 received through FAX. The legal counsel in the matter of Khamargachi Primary Teacher’s Training Institute has opined the following:-
“After carefully perusing the papers and documents sent regarding above and the discussion held it appears that there was no necessity for issuance of letter dated 30.5.2009 to the above institution in the light of earlier letter of recognition dated 18.9.2009”
The same legal opinion has also been given in the matter of Model Primary Teacher Training Institute.
The Committee after considering the above decided that ERC’s order issued in May, 2009 would be applicable only to the PTTIs recognized earlier for one year course and will not be applicable to institutions already recognized for two year course.
The Committee ,therefore, decided that necessary orders/corrigendum be issued immediately as per the above decision of the ERC.

Vidyasagar Primary Teachers’ Training Institute, Vill –Dhamait, Po-Amdan, PS-Panskura, Dist-Purba Medinipur, West Bengal – 721 131 (PTT) (Private) (West Bengal Board of Primary Education) Code No.APE00647 The Committee considered the reply of the institution dt.29.06.2009 received in ERC office on dt.09.07.2009 in response to ERC Notice dt.05.06.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice u/s 14(3) (b) may be issued giving 7 days time for the following deficiencies:

(Private) (University of Gourbanga) Code No.APE01011 The Committee considered the case of the institution along with the Visiting Team Report, relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice u/s 14(3) (b) may be issued giving 7 days time for the following deficiencies:
  1. Two teachers are not qualified as per NCTE norms. The institution is required to submit details of appointment requisite no. of teaching staff as per the NCTE norms and submit the required affidavits as per the prescribed format.
  2. The building of the institution is under construction.
  3. Playground is on sharing basis.
  4. Science lab is not available.
  5. Library Books are less than as per NCTE norms.

(Private)( Vinoba Bhave University) Code No.APE00994 The Committee considered the case of the institution along with the Visiting Team Report, relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Recognition Order under Clause 7(11) of Regulations, 2007 for annual intake of 100 for B.Ed. Course from the session 2009-2010 may be issued after verification of the website of the institution and land documents.

(Private) (University of Kalyani) Code No. APE01093 The Committee considered the case of the institution along with the Visiting Team Report, relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice u/s 15(3)(b) may be issued giving 7 days time for the following deficiencies:
  1. Built up area is 2622 sq.mts, which is less than NCTE norms. Institution is recognized for B.Ed. course and D.Ed. course in the name of Model PTTI.
  2. List of teaching staff not submitted by the institution in prescribed format. The institution is required to submit details of appointment requisite no. of teaching staff as per the NCTE norms and submit the required affidavits as per the prescribed format.
  3. (Private) (West Bengal Board of Primary Education) Code No.APE00730 The Committee considered the reply of the institution dated 10.07.2009 received in ERC office dt.13.07.2009, along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice u/s 14 (3) (b) may be issued giving 7 days time for the following deficiencies:

1.One teacher is not qualified as per NCTE norms. The institution is required to submit details of appointment requisite no. of teaching staff as per the NCTE norms and submit the required affidavits as per the prescribed format.

(Private) (Magadh University) Code No. APE00813 The Committee considered the reply of the institution dated 21.06.2009 received in ERC office dt.07.07.2009 in response to ERC letter dated 05.06.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice u/s 14(3) (b) may be issued giving 7 days time for the following deficiencies:
  1. Downloaded copies from the website not submitted.
  2. The institution vides its letter dtd. 20.05.09 had agreed that the institution had earlier submitted the Plot No. 947, 949, 951 & 963 only and the institution will operate Plot No. 911 & 912. Before inspection the institution has not submitted Plot No. 911 & 912 in the land document, affidavit & completion certificate. After inspection the institution submitted plot No. 911 & 912 in which the land document executed on March, 09. This is not as per NCTE Regulation.
ER–98.6(I) (1S).4 Primary Teacher Training College, Tarar, Po – Bhakharua More (Daud Nagar), Dist – Aurangabad, Bihar – 824113 (B.T. Elementary Level) (Govt.) (Bihar School Examination Board.) Code No. APE00458 The Committee noted that no reply has been submitted by the institution in response to ERC letter dated 05.06.2009 and considered along with other relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice u/s 14(3) (b) may be issued giving 7 days time for the following deficiencies:
  1. Appointment of teachers by the State Govt. along with the supporting documents and list of the teaching staff in prescribed format is required to be submitted.
  2. The institution is required to update the website displaying an affidavit in the prescribed form duly attested by Oath Commissioner/Notary Public as per clause 8 (8) and 8(9) of the NCTE Rules & Regulations alongwith the copy of an affidavits on Rs.100/- Non-Judicial stamp paper from the institution to the effect that it has appointed staff on the recommendations of the Selection Committee duly constituted as per the policy of the State Govt/Central Govt./University/UGC or the concerned affiliating body and separate staff statement on an affidavit on Rs.10/- Non-Judicial stamp paper as per the prescribed format with the details etc. as per 7(9) of the NCTE rules & regulations.
  3. The institution is required to submit downloaded copies of the website showing that all the above documents has been uploaded in the website of the institution as per the NCTE Rules & Regulations.
ER–98.6(I) (1S).5 Millat Teacher’s Training College, Vill – Bhowara (Madhubani), Rahika, Po – Bhowara, Bihar – 847212 (B.P.Ed.) (Private) (L.N.Mithila University, Code No. APE001007 The Committee considered the case of the institution along with the Visiting Team Report, relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Recognition Order under Clause 7(11) of Regulations, 2007 for annual intake of 50 for B.P.Ed. Course from the session 2009-2010 be issued after verification of the website of the institution. Prof. Faiyaz Ahamad, Member ERC abstained while deciding the case of the institution as he belongs to the institution.
ER –98.6(I) (1S).6 Mithila Teacher’s Training College, Vill/PO. – Basuara, Dist – Madhubani, Bihar – 847212 (B. Ed.) (Private) (L.N.Mithila University) Code No. APE001000 The Committee considered the reply of the institution dated 11.07.2009 received in ERC office dt.20.06.2009 in response to ERC letter of intent dated 30.06.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice u/s 14(3) (b) may be issued giving 7 days time for the following deficiencies:
  1. As per the list submitted by the institution. The appointed Principal is not qualified as details of the experience of the Principal at Secondary level is not clearly given as one of the institution is recognized for D.Ed. & B.Ed.
