  1. Requisite no. of teaching staff does not possessing qualification as per NCTE norms.
ER – 97.6(I).5 Jiaganj Institute of Education & Training, Vill- Jiaganj, Po- Jiaganj, Dist- Murshidabad, West Bengal – 742123 (B.Ed.)(Private) (Kalyani University) (Code No.APE00955) The Committee considered the reply of the institution dt. 12.06.2009 received in ERC office dt. 15.06.2009 in response to ERC Clarification Letter 05.06.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice u/s 14(3) (b) may be issued giving 20 days time for the following deficiencies:-
  1. The institution has informed that the Principal Shri Premananda Paul has resigned from other institution namely Bhagabati Devi PTTI, however the persons name also appear in other institution namely Panagarh PTTI.
  2. Requisite number of teaching staff (1+7) possessing qualification as per NCTE norms not available.
ER – 97.6(I).6 DIET, Baghmara, Bolsalgre, Po- Baghmara, South Garo Hills, Meghalaya – 794102 [(ETTC) (D.Ed.)] (Govt.) (Directorate of Educational Research and Training) Code No. APE00750 The Committee considered the reply of the institution dt. 02.06.2009 received in ERC office dt. 10.06.2009 & reply dt. 17.06.2009 handed over by the State Govt. representative on the table, along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that State Govt. should ensure that requisite No. of teachers as per NCTE norms are made available by suitably transferring qualified teachers from other institutions. The Committee decided that Recognition Order under Clause 7(11) of Regulations, 2007 for annual intake of 50 for ETTC (D.Ed.) Course from the session 2009-2010 may be issued after verification of website and subject to the receipt of the downloaded copies of the website, list of teaching staff in prescribed format, Language learning lab, Facilities provided, Details of website including in its URL and an affidavit on Rs. 100/- Non-Judicial stamp paper by the institution as per the prescribed format for selection & appointment of a academic staff.
ER – 97.6(I).7 Department of Physical Education, Kalyani University, Dist- Nadia, West Bengal – 741235 (B.P.Ed.) (University Department) (Kalyani University) Code No.APE00823 The Committee considered the reply of the institution dt. 12.06.2009 received in ERC office dt. 17.06.2009 in response to ERC notice dated 09.05.2009, along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided to grant Permission under Clause 7(11) of Regulations for Additional intake of 50 (thus making the total intake 100) in existing B.P.Ed. Course from the session 2009-2010. The Committee authorized the Regional Director to issue Permission Order under 7(11) Regulation 2007, after receiving the information regarding area earmarked by the University for the existing and the proposed Physical Teacher Training Courses as per NCTE norms and separate list of teaching/non teaching staff for the existing & proposed courses and verification of website and receipt of downloaded copies of website.
ER – 97.6(I).8 Prabhat Kumar College, PO & PS – Contai, Dist- East Medinipur, West Bengal – 721401 (B.Ed.) (Private) (Vidyasagar University) Code No.APE00732 The Committee considered the reply of the institution dt. 05.06.2009 received in ERC dt.16.06.2009 in response to ERC notice dated 09.05.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Recognition Order under Clause 7(11) of Regulations, 2007 for annual intake of 100 for B.Ed. Course from the session 2009-2010 may be issued after verification of website and receipt of the downloaded copies of the website and the institution is also to submit experience Certificate of the Principal as per NCTE norms duly countersigned by the Competent Authority and also submit a clarification that the built up area earmarked for B.Ed. section as from the certificate submitted by the institution it appears that only 930.541 Sq. Mts. of the total built up area is earmarked for the B.Ed. section.
ER – 97.6(I).9 Elite B.Ed. College, Vill- Chotokhejuria, Po- Adconagar, Plot No. – A, City- Saptagram, Dist- Hooghly, West Bengal – 712141 (B.Ed.) (Private) (Calcutta University.) Code No.APE00879 The Committee considered the reply of the institution dt. 15.06.2009 received in ERC dt.16.06.2009 in response to ERC clarification letter dated 05.06.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Recognition Order under Clause 7(11) of Regulations, 2007 for annual intake of 100 for B.Ed. Course from the session 2009-2010 may be issued after verification of website and receipt of the downloaded copies of the website and an affidavit on Rs. 100/- stamp paper regarding selection Committee for the appointment of two new lectures as per the NCTE norms in the prescribed format.
ER – 97.6(I).10 Ganauri Ramkali Teachers’ Training College, Nawada, Vill – Industrial Area, Police Line, Po – Mahanandpur, City/Dist– Nawada, Bihar (B.Ed.) (Private) (Magadh University) Code No. APE001034 The Committee considered the reply of the institution dt. 15.06.2009 received in ERC dt.17.06.2009 in response to ERC letter of intent dated 05.06.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Recognition Order under Clause 7(11) of Regulations, 2007 for annual intake of 100 for B.Ed. Course from the session 2009-2010 may be issued after verification of website and receipt of the downloaded copies of the website. The institution had submitted computer printout/scanned copy of document instead of downloaded copies.

The Committee also while considering the case took note of a complaint also received from Karyanand Sharma Vill – Kendua, Via – Akauna, Dist – Nawada.
ER – 97.6(I).11 Millat Teacher’s Training College, Vill – Bhowara (Madhubani), Rahika, Po – Bhowara, Bihar – 847212 (B.P.Ed.) (Private) (Additional Course) (L.N.Mithila University.) Code No. APE001007
 
The Committee considered the reply of the institution dt 13.06.2009 received in ERC office on 17.06.2009 in response to ERC notice dated 11.06.2009, along with the relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice u/s 15(3) (b) may be issued giving 20 days time for the following deficiencies:
  1. The institution has not submitted earmarked building plan clearly showing availability of land & built up area for the proposed course and also for the existing course approved by the NCTE. Clear information regarding separate & exclusive land and building of the institution for running the Teacher Education Programme not given.
  2. The institution vide its letter dtd. 13.06.2009 has submitted an affidavit. As per the affidavit the area specified exclusively for the B.P.Ed. course is less than the requirement as per the NCTE norms. As per the affidavit submitted earlier the built up area mentioned was less than required for existing and proposed course.
  3. On the basis of testimonials submitted in respect of the HOD appointed the person does not possess experience as per NCTE Norms.
  4. Affidavit of Rs.100/- stamp paper regarding selection committee not given.
 
ER – 97.6(I).12 Gautam Budh Teacher’s Training College, At – Sureshnagar, Po – karai Persarai, Dist – Nalanda, Bihar – 801304. (ETT) (Private) (Bihar School Examination Board, Patna.) Code No. APE00847 The Committee considered the reply of the institution DT. 09.06.2009 received in ERC office dt. 17.06.2009 in response to ERC Notice dt. 18.05.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that a Notice u/s 14(3) (b) may be issued giving 20 days time for the following deficiencies:-
  1. Requisite numbers of teaching staff possessing qualification as per NCTE norms have not been appointed.
  2. Experience certificate in respect of the principal from Elementary Teacher Training not submitted. As per the affidavit the person possesses qualification in a B.Ed. college which is not as per norms.
  3. The institution has not submitted downloaded copies from its website covering, inter alia, the details of the institution, its location, name of the course applied for with intake, availability of physical infrastructure (land, building, office, classrooms, and other facilities/amenities), instructional facilities (laboratory, library etc.) and the particulars of their proposed teaching and non-teaching staff etc. with photographs. Only a few pages from the website is to be submitted.

Indra Singh B.Ed. Teacher’s Training College Vill- No. – 66, Tehsil – Garhwa,Dist- Garhwa, Jharkhand – 822101 (B.Ed.) (Private) (Ranchi University) Code No. APE00911

The Committee considered the reply of the institution dt. 15.06.2009 received in ERC office on 18.06.2009 in response to ERC notice dated 15.05.2009, along with the relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice u/s 14(3) (b) may be issued giving 20 days time for the following deficiencies:
  1. The name of the Principal Dr. Harish Chandra Giri also given in the other institution file namely Solanki B.Ed. College , Bihar. The institution may clarify with supporting document.
  2. The affidavit on in respect of individual staff are submitted without photographs affixed as per the format.
  3. The institution has submitted colour print out / scanned copies of some of the documents. The institution has not submitted downloaded copies from the website covering, inter alia, the details of the institution, its location, name of the course applied for with intake, availability of physical infrastructure (land, building, office, classrooms and other facilities /amenities), instructional facilities (laboratory, library etc.) and the particulars of their proposed teaching an non-teaching staff etc. with photographs.

Representation of the institutions in response to show cause notice.

ER – 97.6(II).1 Bhonpur Binita College of Education, PO – Bhonpur, Via- Boinehee, PS- Pandua, Dist- Hooghly, West Bengal -712134 (B.Ed.) (Private) (University of Burdwan) Code No. APE00843 The Committee noted that no reply received in response to ERC notice dated 09.05.2009 and considered the reply of the institution received in ERC office on 15.05.2009 received in this office on 21.05.2009 in response to ERC notice dated 26.03.2009, along with the relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that Notice u/s 14(3) (b) may be issued giving 20 days time for the following deficiencies:
  1. The institution has submitted the approved building plan, building completion certificate and certified copy of land documents in Regional Language alongwith land title certificate and non-encumbrance certificate for plot No. 1895. However the affidavit, land document and building plan submitted by the institution earlier with the application were for plot No. 2662 & 136.It appears that the institution has change its premises after the date of application and after the inspection conducted on 07.05.2008 & 19.08.08.
  2. The building completion certificate shows that the building is completed in all respect on 26.03.2009 i.e. after the 2nd inspection.
  3. Certified copy of the registered land documents submitted are in regional language and notarized English version of land document not submitted.
  4. The CD submitted after the inspection does not have any authenticity.
ER – 97.6(II).2 Mahendra Das B.Ed. Teacher’s Training College, Mithia, Nechua, Jalalpur, Dist – Gopalganj, Bihar – 841503 (B.Ed) (Private) (Vinoba Bhave University) Code No. APE00852 The Committee considered the reply of the institution dtd. 08.06.2009 received in ERC office on 15.06.2009 in response to ERC notice dated 18.05.2009, along with the relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that letter of intent for appointment of teaching / non teaching staff supporting with required affidavits as per the format enclosed alongwith the downloaded copies of the website as per clause 7(9) of Regulation , 2007 may be issued giving 20 days time also with a direction to the institution to comply the following deficiencies :
  1. The person appointed as Principal has not submitted experience certificate in a secondary level teacher training institutions as per Norms.
  2. As per the individual affidavit on Rs. 10/- stamp paper given requisite number of teachers do not possess qualification as per the NCTE norms.
  3. Affidavit on Rs. 100/- regarding selection committee not submitted by the institution.
ER – 97.6(II).3 Government Teacher’s Training College Phulbani, Vill/PO-Phulbani, Plot No.– 397,184,380,156,Dist- Kandhamal, Orissa-762001 (B.Ed.) (Govt.) (Berhampur University) Code No.APE00961 The Committee noted that no reply has been received in ERC office in response to ERC letter dated 18.05.2009 and considered other relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that reminder letter may be issued giving 20 days time with a direction to the institution to comply the following deficiencies:
  1. The institution has not appointed requisite number of teaching staff qualified as per NCTE norms.
  2. The institution has not submitted download copies of the website displaying an affidavit in the prescribed form duly attested by Oath Commissioner/Notary Public as per clause 8(8) and 8(9) of the NCTE Rules & Regulations alongwith the copy of an affidavits on Rs. 100/- Non- Judicial stamp paper from the institution to the effect hat it has appointed staff on the recommendations of the Selection Committee duly constituted as per the policy of the State Govt/ Central Govt./University/UGC or the concerned affiliating body and separate staff statement on an affidavit on Rs. 10/- Non-Judicial stamp paper as per the prescribed format with the details etc. as per 7(9) of the NCTE rules & Regulations.
  3. As per book, total number of books is 2000 which is less than the requirement as per the NCTE norms.
ER – 97.7 Court Cases.
ER – 97.7.1 S.Wakil Ahmad Teacher Training College, Darbhanga – L.P.A. No.23 / 2005 filed by NCTE. (ERC/05-149/2004) The Committee considered the matter in light of the legal opinion furnished by Sri S. N. Pathak the advocate of ERC, NCTE at Patna High Court vide letter dtd. 22.04.2009 alongwith the Legal opinion dt.06.11.2007, 05.06.2008 and 24.04.2008 given by the advocate Sh. S.N.Pathak and the opinion dt.22.08.2008 given by the advocate Sh. B.C.Bastia alongwith the other relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that the advocate Sri S. N. Pathak may be asked to reconcile/ clarify the two contradictory report given by him in the matter enabling this Committee to take appropriate action. The Committee further decided that the opinion of the local advocate may also be taken in view of the contradictory opinion given by Sri S. N. Pathak. On receipt of the opinion from advocate the matter may be placed before the ERC.
ER – 97.7.2 Admission of students and running of the 2 years PTT/ETE/D.Ed. course by Model PTTI, P.O.Basantpur, Dist. Murshidabad, WB (Code No.APE00626) The Committee considered the matter in light of the representation dtd. 10.06.2009 received in ERC office on 18.06.2009 with reference to ERC’s order No.94 dt.30.05.09 permitting the institution to admit students and run PTT/ETE/D.Ed. Course of 2 years duration from the session 2009-10 and interim order dtd. 16.05.2008 passed in writ petition no. 865 (W) of 2008 by the Hon’ble Calcutta High Court. The Committee noted that the institution has given the representation with the prayer for :- (i) Either correcting the order dt.30.05.2009 accordingly and permitting Model PTTI to admit students and conduct the course from 2008-10 academic session. (ii) Or withdrawing the order The Committee further noted that such representations are being received from West Bengal Primary Teacher Training Institutions (PTTIs) and are also being forwarded by the Chairman NCTE, New Delhi with the reference of ERCs order issued in may, 2009 as per the decision of 95th ERC meeting held in April, 27th -29th, 2009 restricting/permitting the recognized PTTIs to admit students from 2009 onwards. Prima-facie, the committee was of the opinion that this letter / order should have been issued to recognized PTTIs in West Bengal which were granted recognition for PTT (D.Ed.) (Elementary Level ) Course of one year duration and that it should not be applicable to the institution granted recognition already granted recognition for PTT (D.Ed.) (Elementary Level ) Course of two year duration. The Committee also noted that the Hon’ble High Court of Calcutta has also passed an interim order in favour of the PTTI’s for admitting students from the session 2008-2010 and ERC decided that the matter be examined legally for withdrawal of ERC’s Order issued in May, 2009, in respect of PTTI’s recognized from the year 2007 onwards for conducting PTT (D.Ed.) (Elementary Level Course) of two years course. Suitable action as per the legal advice may be taken and ERC be kept informed. The matter may be placed in the next ERC Meeting.
ER – 97.7.3 Admission of students and running of the 2 years PTT/ETE/D.Ed. course by Khamargachi PTTI, P.O.Khamargachi Dist. Hoogly, WB (Code No.APE00645) Same as above in agenda item No. 97.7.2
ER – 97.7.4 Mahabodhi Teachers Training College, Tapovan, Belaru, Dist.Gaya Bihar, Code No.APE01099 – regarding. The committee considered the representation of the institution dtd. 14.04.2009 received in this office on 04.06.2009 and dtd. 06.06.2009 received in this office on 15.06.2009 protesting against the refusal order issued vide No. 16486 dtd. 13.05.2009 and making allegations. The committee decided that the facts about the case be communicated to the NCTE Hqrs. as desired and in the matter of the Writ Petition bearing C.W.J.C. No.5535 of 2009 filed by Rajendra Kumar – Vs- State of Bihar & Ors. in the Hon’ble High Court at Patna for an order directing the respondent to get the inspection done by the verification team in respect of the said institution, suitable legal action be taken.
ER – 97.8 Reply in response to Letter/ Notice giving to fulfill the deficiencies within 90 days.
ER – 97.8.1 Barddhaman College of Education, Vill – Malkita, PO – Vita School, Town – Burdwan, Dist – Burdwan, West Bengal – 713 102 (B.Ed.) (Private) (University of Burdwan) Code No.APE01159
1. The institution has not submitted land documents for the proposed Teaches Training Institution. As per land documents the land has been allotted for training college for handicapped persons but the institution want to use It for B.Ed. College. The land has been leased out for 30 years for construction of training centre for physically handicapped person from May, 1999.
ER – 97.8.2 Jhargram Bani Bhavan Elementary Teacher Education Programme Vill- Old Jhargram, PO- Old Jhargram, Dist- Midnapore, West Bengal – 721507 (D.Ed.) (Private) (West Bengal Board of Primary Education) Code No.APE01100 The Committee noted that no reply has been received in response ERC notice dated 09.05.2009 and considered the reply received in ERC office on 09.06.2009 in response to ERC notice dated 14.03.2009 of the institution along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that recognition to B.Ed. course of the institution be refused u/s 14 (3) (b) for the following reasons:
  1. No reply received in response to ERC Notice dtd. 09.05.2009.
  2. Certified copy of land lease /ownership documents not submitted as per Regulation 8(8) & 8(7).
  3. Approved Building Plan from competent authority with plot no. Khata No. Built up area, Total area, Khesra no. etc not submitted for the proposed D.Ed. course. As stipulated in the instructions enclosed with the application proforma prescribed under clause 5(1) of the NCTE (Recognition Norms & Procedure) Regulations, 2007 approved building plan along with completion certificate (if the building has already been constructed) from the concerned competent authority is required to be submitted.
  4. Building completion certificate from the competent authority mentioning the plot no. Khata No. Built up area, Total area, Khesra no. etc not submitted for the proposed D.Ed. course (if the building has already been constructed) from the concerned competent authority is required to be submitted. The building completion certificate submitted from the Jhargram Municipality is for Vidyasagar Bani Bhawan not in the name of the institution.
  5. The letter of permission for use of the land for the proposed institution not submitted with reference to para 5 of the affidavit.
 
ER – 97.8.3 Hope Educational and Welfare Trust, Vill & PO- Beldubi, PS- Panchla, Dist- Howrah, West Bengal – 711322 (B.Ed.) (Private) (Calcutta University) Code No.APE01035 The Committee considered the reply of the institution dtd. 01.06.2009 received in ERC office on 09.06.2009 and dtd. Nil received on 16.06.2009 in response to ERC consent letter dated 19.05.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that the Visiting Team may be sent immediately. The VT Team may be directed to collect the Certified copy of the registered land documents alongwith notarized English version of the same as submitted by the institution earlier ( as per the affidavit to the ERC, NCTE) as the certified copy submitted by the institution appears to be a photocopy. Original Certified copy is to be handed over by the institution to the VT members.
ER – 97.8.4 Taiyab Memorial Teacher’s Training Institute, Vill- Barhadih, Po- Sarkardih, Tehsil – Gobindpur, City- Gobindpur, Dist- Dhanbad, Jharkhand – 829109 (ETE) (Private) (Vinoba Bhave University) Code No.APE00966 The Committee considered the reply of the institution dtd. 08.06.2009 received in ERC office on 16.06.2009 and reply dtd. 25.04.09 received on 28.04.09 in response to ERC Notice dated 11.05.2009 and 27.03.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided a notice under section 14(3) (b) prior to refusal may be issued giving 20 days time for the following deficiency:-
  1. The institution has submitted photocopies & notarized copy of the land documents. Certified copy of the lands documents not submitted.
 
ER – 97.8.5 Vidyanagar Govt. Primary Teachers Training Institute, Vill.- Vidyanagar, Tehsil- Kalna, West Bengal- 741 302 (D.Ed.) (Government) (West Bengal Board of Primary Education) Code No.APE01105 The Committee considered the matter and noted that the deficiency letter was issued to the institution on 28.11.2008. Further the consent letter were issued to the institution on 26.03.2009 and 12.05.2009 as per the decision of the ERC keeping in view that the institution is a Govt. institution. The committee noted that no reply has been received in response ERC consent letter dtd. 12.05.2009. However the committee considered the reply of the institution dtd. 24.04.2009 received in this office on 07.05.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that recognition to D.Ed. course of the institution be refused u/s 14 (3) (b) for the following reasons:
  1. No compliance made by the institution to the requirements as pointed out vide ERC deficiency letter within stipulated time.
  2. The institution did not submit certificate from the Govt. regarding infrastructure & instructional facilities as per the NCTE norms
 
ER – 97.8.6 Baliapur Institute of Technology, Vill- Samlapur, Po- Sindri, Dist- Dhanbad, Jharkhand – 828122 (B.Ed.) (Private) (Vinoba Bhave University) Code No.APE01113 The Committee considered the reply dtd. 02.06.2009 received in ERC office on 02.06.2009 in response to ERC Notice dated 11.05.2009 along with relevant documents, NCTE Act, Regulations and guidelines of NCTE published from time to time and decided that the Visiting Team may be sent and a letter of consent be issued to the institution for its readiness for inspection of the infrastructure & instructional facilities provided for running the proposed teacher education programme as per the NCTE norms. The VT may be requested to examine and identify the exclusive building and the land for the proposed Teacher Training Institution as the institution is also running a Technical Institution. The VT may collect the supporting document regarding the availability of the infrastructure facility exclusively for the B.Ed. Course like separate Building Plan , Building Completion Certificate etc.
